All construction must be in compliance with the approved construction plans
All trees must be barricaded, as shown on plans, prior to any construction. Any trees not barricaded will not
count towards landscaping points. Barricades must be 1' per caliper inch of the tree diameter.
The Contractor shall take all necessary precautions to prevent silt and debris from leaving the immediate
construction site in accordance with the approved erosion control plan as well as the City of College Station
Drainage Policy and Design Criteria . If it is determined the prescribed erosion control measures are ineffective
to retain all sediment onsite, it is the contractors responsibility to implement measures that will meet City, State
and Federal requirements. The Owner and/or Contractor shall assure that all disturbed areas are sodden and
establishment of vegetation occurs prior to removal of any silt fencing or hay bales used for temporary erosion
control. The Owner and/or Contractor shall also insure that any disturbed vegetation be returned to its original
condition, placement and state. The Owner and/or Contractor shall be responsible for any damage to adjacent
properties, city streets or infrastructure due to heavy machinery and/or equipment as well as erosion , siltation
or sedimentation resulting from the permitted work.
Any trees required to be protected by ordinance or as part of the landscape plan must be completely fenced
before any operations of this permit can begin.
In accordance with Chapter 13 of the Code of Ordinances of the City of College Station, measures shall be
taken to insure that debris from construction, erosion, and sedimentation shall not be deposited in city streets ,
or existing drainage facilities.
I hereby grant this permit for development of an area outside the special flood hazard area . All development
shall be in accordance with the plans and specifications submitted to and approved by the City Engineer in the
development permit application for the above named project and all of the codes and ordinances of the City of
College Station that apply .

Item 10.14 on Consent Agenda for July 10 Council Meeting
Monday I notified you that staff added an item to the Consent Agenda conditionally vacating a drainage
easement so a new home could be built at 8623 Rosewood in Emerald Forest. All construction related
cost will be the responsibility of the property owner , Mr and Mrs . Joe Ferreri. Attached is a cover sheet,
vacating ordinance with conditions , and exhibits . Staff recommends approval of the ordinance with the
following conditions as stipulated in the ordinance :
1 . That the applicant relocate the creek bed crossing the applicant's property from the existing drainage
easement to the replacement drainage easement.
2. That the applicant relocate the existing public sanitary sewer main located on the applicant's property
to the replacement drainage easement.
3 . That the applicant dedicate the replacement drainage easement on the applicant's property either by
re-plat or by separate instrument in compliance with the City's regulations .
Staff has discussed these conditions with the Ferreri's and explained that a building permit cannot be
issued until the conditions are met , if the Council approves the ordinance .

Item: Presentatio n, discussion and possible actio n on an ordinance making certain findings of
fact and conditionally vacating a nd aba ndonin g of a portion of a forty (40) foot drainage
easement which crosses and li es within Lot 17 , Block 1, Emerald Forest, Phase 2, City of
College Station.
Item Summary: The applicant has recently purchased the property at 8623 Rosewood, and
intends to build a new home on the property subject to relocati ng and improving the drainage
easement and improving 70 feet of sewer lin e. T hey have submi tted a re-plat of the property that
was approved by P&Z at their May 15, 2003 meeting and provides a replacement drainage
easement. The existi ng 40 foot drainage easement will be vacated and abando ned by the City
on ly upon completio n of the fo llowing co nditi ons :

required. Buildin g Official , Zoning Official, Fire Marshall, and City Engineer have indicated no
objection to thi s abandonment application.

AN ORDINANCE MAKING CERTAIN FINDINGS OF FACT AND CONDITIONALLY
VACATING AND ABANDONING A PORTION OF A FORTY (40 ) FOOT WIDE
DRAINAGE EASEMENT, WHICH CROSSES AND LIES WITHIN LOT 17, BLOCK 1,
EMERALD FOREST, PHASE 2 IN THE CITY OF COLLEGE STATION , TEXAS.
WHEREAS, the City of College Station has received a n application for the vacation and
abandonment of a portion of a forty (40) foot wide drainage easement, which crosses and lie s
within Lot 17 , Block 1, Emerald Forest, Phase 2 in the City of College Station , sai d portion of
the drainage easement being more particularl y described on Exhibit "A" attached hereto ; and
WHEREAS on July 10 , 2003, the City Council of the City of College Station, Texas, heard the
application of P atty & Allen Swoboda for the vacation and a bandonment of the aforementioned
portion of the forty (40 ) foot wide drainage ease ment th at crosses and lie s within Lot 17 , Block
1, Emerald Forest, Phase 2 according to the plat recorded in Volume 453, P age 905 , of th e
Official Record s of Brazos County, Tex as; and
WHEREAS , in order for any portion of a n easement to be vacated and a bandoned by the City
Council of th e City of College Station , the Counci l mu st make certain findings of facts ; and
WHEREAS , after hearing the application of P atty & Allen Swoboda to vacate and abandon a
forty (40) foot wide drainage easement, the City Council of the City of College Station, finds the
following fact s :
1. A forty (40) foot wide drainage easement cros se s the applicant 's property and inhibits its
de velopment.
2 . A creek bed is currently located in the drain age easement.
3 . A public sanitary sewer main is currently lo cated in th e drain age easement.
4 . T he appli cant submitted a re -plat of the property that has been approved by the
City's Planning and Zonin g Commission , whic h provides for a replacement
drain ag e easement on the property, as depi cted on Exhibit "B" attached hereto.
5. The land use in the neighborhood appears to be stable a nd the u se to which thi s
property is being put is not likel y to change within the foreseeable future and is
similar to the use to that of the nei g hborhood ; and
WHEREAS , the City Council after hearing the a pplication and findin g the s pecifi c fact s as stated
above now concludes and finds that:
1 . The fact that the location of the forty ( 40) foot wide drainage easement that
crosses the app li cant's property wo uld deprive the applicant of the reasonable use
of hi s property ;
2. The fact that the applicant s ubmitted a re-p lat of the property to the City which
provides for a replacement drain age easement on the applic a nt's property ;
3. The fact th at the applicant intend s to rel ocate the exi s ting creek bed a nd public
sanitary sewer main th a t cross the applicant's property to this replacement

drainage easement, thus mitigating any negative impact to the City related to the
vacation and abandonment of the existing portion of the drainage easement;
4. The fact that the land use is not lik ely to change within the foreseeab le future
provides a basis for granting applicant's request to vacate and abandon a portion
of a drainage easement necessary for the preservation and enjoyment of the
substantial property right of the app li cant.
5. The fact that the vacation and abandonment of a portion of the drainage easement
is not detrimental to the public health , safety or welfare or injurious to the
property in the area ; now therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,
TEXAS, that a portion of a forty (40) foot wide strip of land previously platted as a drainage
easement, which crosses and li es within Lot 17 , Block 1, Emerald Forest, Phase 2 in the City of
College Station, as described on Exhibit "A" attac hed hereto, be vacated and abandoned by the
City o nl y upon completi on of the following conditions:
1. That the applicant relocate the creek bed crossing the appli cant's property from
the ex isting drainage easement to the rep lacement drainage easement
2. That the appli cant relocate the existing pub lic sanitary sewer main from the
existing drainage easement to the rep lacement drainage easement.
3. That the app li cant dedicate to the City a replacement drainage and utility
easement on the applicant's property e ith er by re-plat or by separate instrument in
compli ance with the City's regulations;
Provided , however, that the City reserves all rights in the existing drainage easement
until such time as the above conditions are met by the app li cant and accepted by the City .

Joe Ferrari & Rosewood Channel Improvements
Lee Adams of MDG left me a message this afternoon to convey the results of his onsite meeting with Mr .
Ferrari 's contractor this morning .
The existing sewer line is shallower than Lee assumed, so he will have to increase the length of pipe
replacement from 70 to 120 feet.
With those costs included, the increase in construction cost quoted by the contractor is approximately
$20k. If memory serves the original quote was in the $10k range .
Lee will be speaking with Mr. Ferrari directly regarding the cost increase and will let me know if he will be
submitting revised plans for approval.

ENGINEERING
1. Proposed channel section appears to have an unlined bottom. Please see velocity
allowances for designed channels and surfaces.
2. The cross-tie channel lining and retaining walls of the proposed improvement is not
acceptable as publicly maintained infrastructure .
3. Please review drainage calculations for "n" values shown .
4. It appears the proposed channel only leaves 2-ft cover for sewer line. What is
proposed for safe-guarding the sewer?
