Dear Jennifer:
Enclosed please find the Affidavit of Patricia Towery , Senior Property Specialist for Sprint,
regarding the above-referenced Application. Attached to the Affidavit is a propagation map
reflecting radio frequency coverage in the City of College Station, Texas (the "City") in Sprint's
licensed bandwidth. Also attached thereto is a map reflecting the site number, site name, site
add re s and coordinate s, and structure type and height for all of Sprint's sites currently operat ed
within the City and its ETJ. Finally, Ms. Towery affirms that, currently, the proposed site is the
only new coverage or capacity PCS site proposed by Sprint through the end of 2006 within the
city Jim.its or ETJ of the City.
All of the attached documentation and information is confidential and proprietary to Sprint and is
being delivered to you in satisfaction of your Ordinance. In this connection, you are hereby
instructed that the attached are not to be made a part of the public record and shall be held as
confidential by the City. Sprint requests that it be given sufficiently prompt notice of any public
information request regarding the attached information to enable it to seek injunctive relief
against disclosure .
Sprint is unable to project its radio frequency coverage or capacity and new PCS site needs
beyond 2006 . Sprint objects to the City's Ordinance requirem ent that it provide a "grid p lan

information and documentation are being delivered , without waiving Sprint's objections, in an
effort to satisfy the Ordinance .

1. "My name is Patricia A. Towery. I am over the age of 18, I have never
been convicted of a felony, and I am fully competent to make this
affidavit. I am a Senior Property Specialist for SprintCom, Inc. ("Sprint"),
and I have personal knowledge of the facts stated herein, which facts are
true and correct.
2 . "Attached hereto as Exhibit "A" is a Propagation Map reflecting the
approximate radio frequency coverage, in Sprint's licensed band width, for
the PCS sites currently operating in the area immediately surrounding the
Sprint's proposed telecomunnications site on Krenek Tap Road in College
Station, Texas (the "Proposed Site").
3. "Attached hereto as Exhibit "B" is a map which reflects the site number,
site name, site address and coordinates, and structure type and height for
all Sprint PCS sites currently operated within College Station and its ETJ.
Also , Exhibit "B" details any currently proposed equipment upgrades for
the sites listed thereon. These proposed upgrades are designed to
maximize the existing Sprint PCS sites assuming approval, construction
and activation of the Proposed Site.
4. "Currently, the Proposed Site is the only new coverage or capacity PCS
site proposed by Sprint through the end of 2006 within the city limits or
ETJ of College Station, Texas.

Dear Mr. Crain:
The City of College Station Planning and Development Department is in receipt of yo ur
response to the memorandum dated August 20, 2004 in reference to the Wright Cell
Tower Conditional Use Permit Application. The following information will need to be
submitted by the December 30th deadline at 10:00 am to make it to the February 3 , 2005
Planning and Zoning Commission meeting .
We request that yo u a lso send copies of the letters you se nt out, and all response letters or
docum entation yo u received for the following subject properties :
• Beautiful Savior Lutheran Church -1007 Krenek Tap Road
• Raw land South of Dartmouth and West of Kren ek Tap Road .
• Raw Land North of Dartmouth and West of Krenek Tap Road .
• Shell convenience store/gas station at the intersection of Dartmouth and Southwest
Parkway.
• Planters and Merchants State Bank located on Southwest Parkway just west of the
Dartmouth intersection.
• The apartment complex loc ated on D artmo uth directly b ehind P&M State Bank & the
Shell station owned by Herratige at Dartmouth.
• The Haven apartment comp lex loc ate d on Dartmouth immedi ate ly across from Teal
Street.
• The dupl ex tract known as "Teal Street" located on Dartmouth just east of the
So uthwe st Parkway intersection.
• Waterwood Townhomes owned by Jim Stewart currently under construction on
Krenek Tap Road.
• Windsor Point Apartments located on the south side of Southwest Parkway, west of
Central Park Lane intersection.
• Eastmark Apartments located on the north side of Southwest Parkway, at Central
Park Lane intersection .
Staff has also determined that the following information (see.high lighted items below is
still needed to meet the requirements for a complete submittal as defined in Section
6.3 .Q. Wireless Telecommunication Facility (WTF) of the UDO:
Section 6.3.Q.8 Application Procedures
• b. "An inventory of the applicant's existing and future towers that are either within
the City, the City's ETJ , or within at least 1 mile of the City's boundary where the
ETJ does not extend that far".
Included with the application was an Inventory map of Sprint PCS sites within
College Station and College Station's ETJ, however the following information
was not included.
"The inventory shall include specific information about the location, tlesign and
eight of each tower. The owner must have on file with the development services
department a master list of all existing tower and structures owned or controlled

ENGINEERING
1. The mylar of the revised Final Plat and digital file were never submitted for filing.
Site Plan cannot be approved until Plat is filed.

ENTRY AND TESTING AGREEMENT and
POWER OF ATTORNEY
THIS ENTRY AND TESTING AGREEMENT ("Agreement") is made and entered
into as of the 30th day of July, 2004, by and between Arthur and Nancy Wright Family
Limited Partnership ("Owner") and SprintCom, Inc., a Kansas corporation
("SprintCom"), concerning certain real property owned by Owner located at 903 Krenek Tap
Road, City of College Station, Brazos County, Texas and more fully described in Exhibit A,
attached h ereto (the "Property").
A. SprintCom has an interest in leasing the Property for u se as a tower or
antenna site for the receipt and transmission of wireless com munications signals; and
B. In order for SprintCom to determine the viability and feasibility of the
Property as a tower or antenna site, it is necessary for employees, agents or independent
contractors of SprintCom to enter upon and inspect the Property and/or temporarily locate
communications equipment on the Property to conduct short t erm radio propagation tests,
and to make application with loc a l , state and federal governm ental entities for approval of
the Property as a tower or antenna site; and
C. Owner and SprintCom desire to provide for the entry upon, inspection and/or
testing activities, and applications concerning the Property pursuant to the terms contained
in this Agreement.
NOW, THEREFORE , in consideration of the mutual promises, covenants,
undertakings, and other consideration set forth in this Agreement, Owner and SprintCom
agree as follows:
1. Consent. Owner consents and agrees that SprintCom, its emplo yees, agents
and independent contractors ("Authorized Parties") may enter upon the Property to conduct
and perform some or a ll of the following activities ("Permitted Activities"): surveys,
geotechnical soil borings and analyses, phase I envir onmental site assessments, boundary
surveys, radio propagation studies, and such oth er tests and inspections of the Property
which SprintCom may deem necessary or advisabl e. SprintCom agrees to be responsible for
any and all costs related to the Permitted Activities, including installation on and operation
and removal of equipment on the P roperty.
2. Filings. Owner consents and agrees that the Authorized Parties m ay make
and file applications on Owner's behalf to such local, state and federal governmental entities
whose approval SprintCom may consider necessary or a dvisabl e to have the Property
approved as a tower or antenna site, including, but n ot limited to, governmental approvals
for zoning variances or other zoning permits, rezoning applications, building permits, and
wetland permits. Owner hereby agrees that an executed copy of this Agreement is as
effective as the original. However, if requested by the Authoriz ed Parties, Owner agrees to
execute su ch other and further documents as may be required by the governmental entity in
question to evidence Owner's consent to the action which is proposed to b e taken.
3. Access. Owner agrees that the Authorized Parties may enter upon the
Property to perform the Permitted Activities upon execution of this Agreement and may have
access to the Property as set forth in Site Agreement execute d by both parties and dated
11/20/03.

4. Removal of Property. SprintCom agrees that it will, upon the conclusion of
the term of this Agreement, r e mov e any equipment installed on the Property as a part of the
Permitted Activities, repair any damage to the Property that might have been caused in
connection with any of the P ermitted Activities, and will return the Property to the condition
it was in b efore SprintCom's entry onto the Property. In the event any equipment installe d
on the Property by SprintCom is not timely removed, Owner will have the right to remove
such equipment and SprintCom agrees to be responsible for the reasonable costs of such
removal.
5. Indemnity. SprintCom agrees to indemnify, save harmless, and d efend
Owner, its directors, officers , employees, and property management agent, if any, from and
against any and all claims, actions, damages, liability and expense in connection with
personal injury and/or damage to property arising from or out of any occurrence in, upon or
at the Property caused by the act or omission of the Authorized Parties in conducting the
Permitted Activities. Any d efense conducted by SprintCom of any s uch claims, actions,
damages, liability and expense will be conducted by attorneys chosen by SprintCom, and
SprintCom will be liable for the payment of any and all co urt costs, expenses of litigation ,
reasonable attorneys' fees and any judgment that may be entered therein.
6. Insurance. At Owner's r equ est, SprintCom agrees to provide a certificate of
insurance evidencing SprintCom's general liability insurance cov erage.
7. Governing Law. The parties agree that the interpretation and con struction
of this Agreement shall be governed by the l aws of the state of T exas without regard to such
state's conflict of laws provisions.

Statement relating to the proposed Sprint Wireless Telecommunications
Facility at 903 Krenek Tap Road

With regard to the location of the proposed Sprint cell tower on my Krenek Tap Road property :
An access road is required to service the proposed tower and I simply cannot afford the risk of
jeopardizing the future development potential of a tract of land worth several hundred thousand
dollars. I cannot allow an access road to be in the interior portion of the tract. The road must be
as short as possible and located just south of the drainage easement and on the east edge of the
property. As an accommodation to the City we have already moved the site almost 100 ' further
away from Krenek Tap Road. This equates to an additional 3000 square feet of real estate tied
up with an easement.
It is the professional opinion of some local deve lopers that the marginal cost of any other
location would reduce the value of the property more the marginal benefits of the Sprint lease
and therefore make the Sprint lease unprofitable to me.

An inventory of the applicant's existing and future towers that area either within the City , the City 's ET J ,
or within at least 1 mile of the City's boundary where the ET J does not extend that far , as outlined in
Unified Development Ordinance in Section 6 .3.Q.8.b Application Procedures. The owner must have on
file with the City a master list of all existing tower structures owned or controlled by the owner. The
existing towers must be overlaid and shown on the City of College Stations Geographical Information
System .
The linear separation distance from other transmission towers within a one-mile radius of the proposed
tower site. The linear separation distance from all residentially-zoned properties, residential structures
and applicable thoroughfares as outlined in Section 6 .3.Q.4 .b , Proximity to Major Thoroughfares , within
500 feet of the proposed tower.
A visual impact analysis , presented as color photo simulations, showing the proposed site of the WTF ,
as outlined in Unified Development Ordinance in Section 6 .3 .Q .8 .e Application Procedures .
Plans for the antenna and the antenna tower shall be prepared and signed by a licensed professional
engineer and designed to withstand sustained winds of at least 80 miles per hour.
Affidavit confirming compliance with FAA regulations , FCC regulations and regulations of any other
agency of the Federal Government with the authority to regulate telecommunication facilities .
Grid Plan (propagation map) of the service area for existing and future structures for a period of not
less than 5 years . The submission should include the "search ring" overlaid onto the City of College
Station Geographic Information Systems showing aerial photograph , parcel lines , and streets . The
"search ring" must be the area required for siting the proposed facility .
A letter addressed to the City declaring an intent and willingness to construct a proposed tower that
would allow additional service providers to locate on the tower.
Documentation of need and alternatives according to Section 6 .3 .Q .10 of the Unified Development
Ordinance Documentation.

Parking Islands . Raised landscape islands , (6 " raised curb) a minimum of 180 sq . ft . are
required at both ends of every parking row (greenspace area contiguous to the end island
maybe applied toward the required 180 sq . ft.). Additionally , 180 sq . ft . of landscaping for every

Medians . Show any and all traffic medians to be constructed on site .
A fifteen foot parking setback from R.O .W . to curb of parking lot is required . Pavement may
encroach into this 15 ' setback by up to 7 contiguous parking spaces . A double parking island
(360 square feet) must be provided between each group of seven spaces . In no case may the
pavement be less than 6 ' from the property line .

Show proposed and existing fire hydrants . Fire hydrants must be located on the same side of a
major street as a project, and shall be in a location approved by the C ity Enginee r. Any
structure in any zon ing district other than R-1 , R-1 A , or R-2 must be within 300 feet of a fire
hydrant as measured along a public street , highway or designated fire lane .
Show fire department connections . FDC 's should be within 150 ' of the fire hydrant. In no case
shall they be any further than 300 ' apart, and they shall be accessible from the parking lot
without being blocked by parked cars or a structure .
Show fire lanes . Fire lanes a minimum of 20 feet in width with a minimum height clearance of
14 feet must be established if any portion of the proposed st ructure is more than 150 feet from
the curb line or pavement edge of a public street or highway .
Fire hydrants must be operable and accepted by the City , and drives must have an all weather
surface as defined in the Zoning Ordinance Section 9 before a building perm it can be issued.
