As a neighbor, I understand his needs and de sire to have a ca rp ort built, and hi s plans, in my opinion, seem reasonable. I, therefore , have no objections to Mr. Jones' plans to add such a carport as long as t he following two conditions are met. 1. The Zoning Board of Ad j us t me nt, City of College Station, has determined that the proposed addition is accep t able under the currently applicable rul e s and regul ation s gov erning the City Zoning Ordinances, includi ng general appearance, fi r e hazard and others. 2. The current or all f uture owners of the property at 2901 Brothers Blvd. will not be held responsible, legally or otherwise, for any damages or violations of city zoning ordinances or others arising directly or indirectly from the proposed addition. City Attorney FROM: Jane R. Kee, Zoning Official RE: Chalon Jones' carport at 2809 Brothers On 9/7/83 Mr. Jones applied for a permit to construct a three car carport. He wanted to. build to the side property line. There is a five feet utility easement along that side, however. He went to ZBA 10/18/83 to request a variance to the side setback. If granted he was going to try to get the easement abandoned. As you see from the attached minutes the ZBA denied his request. He was allowed to construct a 2-car carport which would meet the setback. On 10/26/83 Mr. Jones received a permit for the two-car carport. Sometime after all final inspections were completed construction began on the illegal portion. Steven Burns (building inspector) received a complaint from a neighbor (Mr. Khee Choon Rhee) on 3/14/84. He went to investigate and issued a verbal stop work order. The propose( corner of carport matches exactly the existing driveway which is 16" from side property line. Only doing a 2-car carport (i.e. maintaining the 7.5' offset) would actually create an appear ance of being unfinished because the covering up above would not match the concret e drive beneath. Th i s varianc e is n e cessary due to the following uni q t!e and sp e cia l conditions of the land not found in like districts: Previous garage was enclosed for additional bedroom and bath. Old driveway will accommodate 3-car carport without any change or add~tions. We have 3 cars and would like to cover them. The pitch of the roof of the carport will exactly match the pitch of the roof on the front of our house giving a planned effect instead of an add-on ·effect. The space above the carport will also provide excellent storage in the highly-pitched area. The follm1in g alternatives to the requested vari a nc e are possible: My Plan "B" is to build a 2-car carport. This seems kind of silly to me because the existing driveway would be 8' wider than the carport above . It would look unfinished or added-on. This variance will not be contrary to the public interest by virtue of the following f~ct~: The variance would provide a covered carport entir e ly encompassing the e x i s ting driv eway and would pr e sent a more finish e d. uniform and complete appearance. She further Informed the Board that there is a 10 foot easement between Lots 5 & 6, so the l lmit of the variance could be for no closer than to 5 ft. from the property line. She explained that an electric line for a street light is In this easement; however, the appl leant could go to the City Council to request abandon- ment of the easement;· She further explained that a variance may be required concerning the regulation of maintaining 15 feet between structures, should the easement be abandoned as the adjacent structure Is approximately 11 feet from the side line . . __ ., Chalan Jones came forward, was sworn in and asked to make a presentation to the Board. Jones showed me his plans for the proposed addition of a 3-car carport at the end of his drive-way. As a neighbor, I understand his needs and desire to have a carport built, and his plan s , in my opinion, seem reasonable. I, therefo re, have no objections to Mr. Jones' plans to add such a carport as long as the following two conditions are met. 1. The Zoning Board of Adjustment, City of College Station, has determined that the proposed addition is acceptable under the currently applicable rules and regulations governing the City Zoning Ordinances, including general appearance, fire hazard and others. 2. The current or all future owners of the property at 2901 Brothers Blvd. will not be held responsible, legally or otherwise, for any damages or violations of city zoning ordinances or others arising directly or indirectly from the proposed addition. He has shown me his plans for adding his 3-car carport, and I am in a greement with his plans to add such a carport; even though it violates th e 7-1/2 foot side offset line. The appearance of his home will be en- ha nced by the carp o rt, and it will consequently be an improvement to the ne i ghborhood. On e key point is that the proposed carport will be behind my house so that it will not create a "crowded" appearance or be a possible fire haza rd. Box 9960 College Station, Texas 77840 Dear Mr Mayo: ( 0 p y This letter is to request the assistance of the City of College Station in resolving the problems associated with the new addition of a carport at Mr. Chalan Jones' residence at 2809 Brothers Blbd., College Station, Texas. In my opinion, the new addition (second stage expansion) to Mr. Jones' new carport (first stage expansion) clearly violates city ordinances and will definitely have such adverse effects on my property at 2901 Brothers Rlvd., College Station as fire hazard, crowded appearance, possible increase in fire insurance premium, possible decrease in the value of the property and difficulty of selling. I therefore respectively request that decisive actions be taken by the City of College Station to resolve the problems according to the rules, regulations and ordinances of the City of College Station. I am sure that you are familiar with this particular problem, however, I would like to furnish you with the following brief information. On June 4, 1981, Mr. Jones presented me with a letter to sign in support of his application for a building permit to the Zoning Board of Adjustment, City of College Station (a copy attached). Rather than signing the letter of unconditional endorsement prepared by Mr. Jones, I prepared a letter of conditional endorsement (a copy attached) and delivered it in person to Mr. Jones on the same day. More than two years later, on October 10, 1983, the Zoning Board of Adjust- ment sent me a certified letter informing me of the October 18 Board meeting during which Mr. Jones application was to be reviewed. I did not attend the Board meeting because I was informed by a Planning Department personnel (name not known) that the Board would not approve any application unless it meets city ordinances whether I were .present at the meeting or not. Presumably, as the result of the Board meeting, a building permit was issued to Mr. Jones and a new carport was built. Although I did not measure the distances to see if the first stage expansion met all the requirements, i.e., 10 feet utility easement and 15 feet between roof-lines, it seemed to meet all such requirements and I was satisfied with the result. In this respect, I thought Mr. Jones was also satisfied with the out-come. To my surprise and dismay, however, another construction began about three weeks ago to expand the new carpot. The new addition (second stage expansion) to the new carport extends within one foot from the property line and a portion of the new addition overlaps with my house, leaving only a , ... . . Page 2 Mr. Mayo 4/9/84 very short distance between the two roof-lines. I felt at that time that building a permanent structure so close to the existing house was a violation of the city ordinances, gave crowded appearance, and would pose serious fire hazard. I therefore contacted a city building inspector by phone and expressed my concerns over the new addition. The building inspector I talked to a couple of hours ago called me back after his inspection of the situation, and informed me that the construction of the building was sound and that as long as the roof-line of the new addition does not cross-over the property line, he could not find anything wrong with it. The inspector's explanation was not satisfactory to me, so I called the Enginnering and Planning Department for additional information. Ms. Jane Kee, Planning Official with department, informed me that she was aware of the situation, that the new addition was illegal as the City did riot issue a building permit for the new addition, that no further construction should be taking place, and that appropriate actions being taken to resolve the problem. However, the construction started again early Saturday morning (April 7), completing the outside walls and half-way completing the roof. I sympathize with Mrs. Jones' desire to have an additional space for his many cars, but I do not see any compelling reasons that the City of College Station should grant a building permit for the new addition, particularly when such an addition adversely affects the neighbor and, most of all, violates city ordinances. I therefore respectively request that the City of College Station take appropriate actions immediately to resolve the problem.
