TEXAS 77840 July 9, 1979 MEMORANDUM: TO: FROM SUBJECT: Zoning Board of Adjustment Jim Callaway, Zoning Official Agenda Items, Meeting of July 17, 1979 Agenda Item Number Two (2) -this request is for the addition of certain improvements to an existing duplex located at 300 l~. Dexter. The improvements are explained in detail in a letter from Mr. Hickman which is included elsewhere in this packet. The improvements are substantially complete at this time. These improvements were noticed by ~y office and a building inspector while inspecting that property for other zoning related matters. The owner, Mr. Hickman, was notified of local ordinances and codes requiring permits for such improvements. Once notified Mr. Hickman proceeded to take every possible action necessary to secure the required permits and inspectiogs. Because of the non-conformity of the use of his structure, Mr. Hickman was referred to my office when he applied for the necessary permit. Agenda Item Number Three (3~ -This request is for the expansion of a structure that does not conform wHh the setback requirements of the Zoning Ordinance. The use of the structure, a game room and storage, does comply. The existing structure does not comply with side or rear setback requirements (see site plan submitted by applicant). The requested expansion would also not comply wfth the rear setback requirement, but the infringement would be the same as the existing structure. I would like to poi.nt out that the faci.lUi.es proposed for the expansfon (b.athroom with a shower, wet bar} create a structure which could easily be converted into a lfving unft. The addition of any cooking facflities (such as a simple hot plate) would create a duplex as defined by our exfstfng ordinances. While the applicant may have no intentions of using this facility for a dwelling unit, any future owner could easily do this. The only way we could be aware of the conversion of this structure to an illegal duplex would be through the complaints of adjacent property owners. Dexter Mr. Hickman will apply for the appropriate permit upon the Board's approval of the additions to the structure. The permit will reflect any changes necessary to make the structure sound as well as the work which has been completed without a permit. Mr. Hickman has obtained the services of an engineer to specify any necessary changes in the structure and permit approval will be based upon that engineer's recommendations. Should the Board choose not to grant the expansion, this office will require demolition or restoration to original condition of unapproved portions to be accomplished within thirty (30) days of the Board's actions. We have not filed charges of violation of the Building Code and we do not foresee doing so in view of Mr. Hickman's cooperation and prompt action to date .
