I MINUTES ZONING BOARD OF ADJUSTMENT May 15, 1979 MEMBERS PRESENT: Chairman Harper, Bailey, Boughton, Mathewson MEMBERS ABSENT: Jones VISITORS PRESENT: Zoning Official Callaway, Planning Assistant Longley AGENDA ITEM NUMBER l -Approval of the Minutes of the Meetings of March 20, 1979 and April 17, 1979: Chairman Harper reported that copies of the Minutes of March 20, 1979, had been forwarded to those former board members who had served on the Board at that meeting and that these Minutes were acceptable to all such former members he had been able to contact. Mathewson moved that the Minutes of the meeting of March 20 be approved. The motion was seconded by Bailey and unanimously approved. Mathewson moved that the Min~tes of the meeting of April 17, 1979 be approved. The motion was seconded by Boughton and unanimously approved. Chairman Harper advised the Board that items number three (3) and four (4). had been withdrawn, leaving only item number two (2) for the Board's consideration. AGENDA ITEM NUMBER 2 -Consideration of a Request for a Variance from . . Agency Records Control. Mathewson stated that the Zoning Board of Adjustment's function in the case is a moot question~ that the variance should be denied, that the question of a second detached sign should be addressed by the Planning and Zoning Commisssion by an amendment to the Ordinance, and that the item should be taken off the table so as to dispose of the case. Dr. Wallace McMath stated that he felt the Board had indicated in the past that if an ordinance providing for a second detached sign was not adopted the Board would provide for such a sign by granting a variance. Chairman Harper stated that there were no unique and speci.a 1 circum- stances existed as necessary for the basis for granting a variance -for the Agency Records Control Site. Chairman Harper moved that the requested variance for a second detached sign, as requested by Agency Records, be approved because a hardship existed and there was no detriment to the public interest. The motion was seconded by Mathewson and failed by the following vote: Aye: None Against: Unanimous OTHER BUSINESS: Mathewson suggested that the Zoning Board of Adjustments not hear any variance request which required action on the part of the Planning and Zoning Commission unless such variance was first presented to the Commission with the Board hearing appeals only. ( Mi.nutes -2- The Board reaffirmed its policy of requ1r1ng that all request for a vari"ance having been formally refused a buildfog permit prior to submission to the Board. The Board further stated that any item which would require consideration by the Planning and Zoning Commission as well as action by the Board be considered first by the Planning and Zoning Commission prior to submission to the Board and that the Commission be requested to forward recommendations where appropriate . City of College Station POST OFFICE BOX 9960 1101 TEXAS AVENUE COLLEGE STATION. TEXAS 77840 July 9, 1979 MEMORANDUM: TO: FROM SUBJECT: Zoning Board of Adjustment Jim Callaway, Zoning Official Agenda Items, Meeting of July 17, 1979 Agenda Item Number Two (2) -this request is for the addition of certain improvements to an existfog duplex located at 300 W. Dexter. The improvements are explained in detail in a letter from Mr. Hickman \'lhich is included elsewhere in this packet. The improvements are substantially complete at this time. These improvements were noticed by ~y office and a building inspector while inspecting that property for other zoning related matters. The owner, Mr. Hickman, was notified of local ordinances and codes requiring permits for such improvements. Once notified Mr. Hickman proceeded to take every possible action necessary to secure the required permits and inspectiogs. Because of the non-conformity of the use of his structure, Mr. Hickman was referred to my office when he appli'ed for the necessary permit. Agenda Item Number Three (3~ -This request is for the expansion of a structure that does not conform wHh the setback requirements of the Zoning Ordinance. The use of the structure, a game room and storage, does comply. The existing structure does not comply with side or rear setback requirements (see site plan submitted by applicant). The requested expansion would also not comply with the rear setback requirement, but the infringement would be the same as the:existing structure. I would li.ke to poi.nt out that the facn Utes proposed for the expansion (bathroom with. a shower, wet bar) ·create a structure which could easily be converted into a lfving unft. The addition of any cooking faci .lities (such as a simple hot plate) would create a duplex as defined by our existing ordinances·. While the applicant may have no intentions of using this facility for a dwelling unit, any future owner could easily do this. The only way we could be aware of the conversion of this structure to an illegal duplex would be through the complaints of adjacent property owners. City o f Col lege Station POST OFFI CE BOX 9960 I I O I T EXAS AVENUE COLLEGE STA TION, T E XAS 77840 July 10, 1979 MEMORANDUM: TO: Zoning Officf~l FROM: Bill Koehler, Building Official SUBJECT: Construction at 300 W. Dexter Mr. Hickman will apply for the appropriate permit upon the Board's approval of the additions to the structure. The permit will reflect any changes necessary to make the structure sound as well as the work which has been completed without a permit. Mr. Hickman has obtained the services of an engineer to specify any necessary changes in the structure and permit approval will be based upon that engineer's recommendations. Should the Board choose not to grant the expansion, this office will require demolition or restoration to original condition of unapproved portions to be accomplished within thirty (30) days of the Board's actions. We have not filed charges of violation of the Building Code and .. we do not foresee doing so in view of Mr. Hickman's cooperation and prompt action to date. ., -: \· ., ~ ]~--·-"'-· -··-··--:__; ~-----:J .. :.;,;.·_' .... - J 1 • =-....._ __ ....;..._ -- .,_: ... .·~· ..... ... . This is not· a request for a variance, but is rather a request for approval of changes in a "non-conforming" structure. The changes may be summarized as follows: 1. The addition of an exterior deck to the se~ond level of the structure as shown in the accompanying drawing 2. The addition of approximately 200 square feet of windows to ventilate the attic, insulation of the attic, and flooring so as to allow storage there 3. The addition of a 30 square foot balcony at the attic level (also shown in drawing) My reasons for these changes may be summarized as follows: 1. The deck outside the second level will improve the energy efficiency of the entire house. It will provide · shade foy -- the first level and it will provide a cool and private outside space for the second level. Air conditioning needs should thereby be substantially reduced for the entire building. 2. The changes in the attic will insulate and ventilate a space that wa s previously ·entirely unventilated. The hip-roof design of this building, together with its minimal overhang make soffit vents impossible . In the summer air will circulate freely through the open windows and insulation will , minimize radiant heat from the sun through the roof. In the winter the closed windows will collect the heat of the sun and the insulation will retard its dissipation. The result will be lower heating and cooling costs for the entire structure. A byproduct of this improvement will be attic storage space . 3. The captured solar energy in winter should enable the growth of plants during those months during which it would be too ,cold for them to grow outside. In this connection L _included in my plan a small a small balcony outside one of the windows where plants can be aired on those winter days when weather permits. In accordance with City Ordinance number 850, these changes do not increase-the area of the building devoted to a non-conforming use, nor do they prevent a return of such property to conforming use (section 11-B-3-b). These changes do not prolong the life of the nonconforming use. Moreover, they may be construed as less detrimental to the envirorune~t than the original use (section 11-B-3-c) in that the entire structure becomes more energy efficient upon their completion . 7:; d~h<~- Larry A.
