DuBois offered corrections . Hawley moved that the minutes be approved as
corrected . The motion was ·seconded by Harper and unaniinous ly approvea.
2 . Con sideration of a request for expansion of a non-conforming struc-
ture from Lorenzo Preston at 103 Hol l eman Dr ive :
Koehler presented the application and plans . He po inted out that the
construction was on the side away from the setback encroachment and would
not itself exceed setbacks .
Jon es moved that the permit be grant ed because the addition conforms
though the main structure does not , and the nature of the neighborho od
will not be changed . Th~e motion was sec.anded by Harper and un animously
approved .

Hughey nioved that the miYJ.utes be approved as read. The motion was seconded by
Storts and unanimously approved.
Agenda Item No. 2 --Briefing by the Citv Attorney:
Lewis discussed the functions of a Board of Adjustment, the scope of authority
of the Board, the nature of the proceedings, the light in which courts might
. view their actions under appeal and the degree of discretion allowed Boards . of
Adjustm.a11t in various matters.
Agenda Item No. 3 --Consideration of a request for variance from Abe Cyrus at
1303 Augustine:
Koehler explained that the applicant had requested separate consideration of the
. patio cover and the residenti~l structure as both had been found to be too near
the rear line. He pointed om that the house had been built in 1973, that
Mr. Cyrus had bought fro:m the first owner, a..YJ.d that inspection practices at
the time of construction were not such as to detect such problems. He said
that the patio cover had been built by the present o~er and that no permit
had been obtained.
Mr. Abe Cyrus said that he was not aware of the problem with the principal
. structure and that it would not be possible to remedy it without demolition and
total re-construction to a different pla.'1. · He said that he was unaware of the
need for permit for the patio cover and u.n.aware that there yas any difference
in regulation of a slab at grade and superstructure. ·
Cpt. Joe McNabb said that he recognized the hardship involved in correcting
·the principal structure and would not advocate its removal •. He said that
the patio cover was built in Ju.YJ.e of 1977. He questioned its quality and
compliance ·with restrictions and said that its proximity to his property was
an :infringement upon his property and objectionable to him.
Mr. David Morris said that the cover did not appear to him to be objectionable
and that he had no doubt as to its safety. Koehler said that, with one minor
correction, the structure would be adeqi.iate for its purpose.
Hughey moved to grant a v ariance for t!i.e c ontinu ed existence of the !Jain
structure, not to include the patio cover, for the reason of t he ext,rcne
hard ship involved in r e:movi_.ng it after it had been in existence and changed
ha.rids. The motion was seconded by Hawley and 1.ma..ri:llnously approved.
Hugh ey r em.ark ed that the objection of the adjoiner to the patio cover
was pertLrient to the public intere s t i...YJ. the c ase , and that while the Bo ard
had granted varia..rice to similar structu.res in the past, it had not been
to the expressed detriment of adjoinLDg properties.
Koep_ler said that, in his opinion, allegations of other non-permitted con-
struction on the prope rty had no bearing on the variance requested and
should be ta.Ken up in separate actions or proceedings.
Runnels moved that a variance be granted to allow the continued existence
of the patio cover. The motion was seconded by Hughey and failed by the
following note:

Against: Runnels, Hughey, Storts, Hawley, Harper.
Agenda Item No. 4 --Consideration of a request for variance from

Koehler explained that the request was to allo'w the extens ion of a carport
which existed 15 feet fror.i. the edge of an alley and that the extension would
result in a clearance of :µ feet. He said that Mr. Badgett and Hr. Gay,
adjoining neighbors had ixamined the plans and said they had no objection .
He said there ·would be no ~interferenc e with utilities.
Mr. Keneipp pointed out that, without the variance, the ·original st:t;'U.cture
would be lost and that he would have to remove several large trees. He
said th~t most of the structures in the neighborhood had been built when
garages were allowed much nearer the line than the proposed structure.
Runnels moved that a varia..rice be granted to allow the structure to be built
as proposed in that the existing structure .and irreplaceable trees would
otherWise be lost and in that the proposal was not out of character with the
existing neighborhood. The motion was seconded by Hughey and 'Unanimously
approved •.

Reference our previous s9nversation regarding completion of the modific~ion
project at this addre /~1f5!} the previous owner, authorization is reques{~to
construct either a two-car gar garage or carport/storage area, per the
attach~d schematics. Since this property includes a non-conforming structure
(for which certificate of variance has been issued) in that the house exceeds
the minimum 25 foot set-back from rear boundary line by five feet, authori-
zation of the Zoning Board of Adjustment will be required.
The side-entering garage was enclosed with brick, including a fireplace and
chimney, by the previous owner . This action was approved by the Zoning Board
of Adjustment, over the objections of Capt. McNabb, USAF, whose property ,
fronting on Angelina Court, lies immediately behind this; the patio cover,
erected within the 25 foot set-back was objected to by Capt. McNabb , and
was consequently removed . The second chimney, to which he also objected, al-
though a good seventy feet from his own dwelling, was approved.
On 17 October 1978, additional interior modification, including installation
of a third bathroom, hallway walls, and ventillation and wiring alterations
were also approved by the Board , over the initial objection of Capt. McNabb.
The present application is for a 20x24 two car garage or carport/storage area,
to be constructed of wood and/or brick, and with a peaked roof shingled with
the same material as the house . The structure will be free · standing, and will
in no way infringe upon the 25' rear and 7 1/2' side boundary limits specified
in the current Zoning Ordinance. Its purpose is to provide storage for a
camper, small boat, and numerous bicycles which presently sit out in the
driveway. The construction will be in keeping with, and will serve to further
enhance , the present attractive property. Building standards and zoning re-
quirements will be met .

met .

We have reviewed your plans submitted for Building Permit No . 6925.
As you know, the Zon ing Board of Adjustment must approve construction
in this non-conforming structure.
Your plans meet the Building Co de requir ements of the City except
that you will need to add a bath receptacle with ground fault
circuit interruption and you will have to mo ve switch locations to
match the doorways .
You may proceed with your construction at your ovm risk and without
prejudice to the Board 's decision. This letter ~dll stand in lieu
of a building permit until the Board 's approval.
Should the Board fail to approve the con s truction, yo u will be re-
quired to restore the house to its configuration prior to the commence-
ment of your work .

structure ~s single family dwelling built in 1975 (building permit issued to Geo .
Riley in Apr 1975). Bu ilding is presently classified as a non-conformin~ structure
in that setback is approximately 20 feet from rear property line ~instead of 25 feet
a s specified in the College station Zoning Ordinance dated August 1976. Property
line extends 138.16 feet on north and 104.7 on south. Variance to rear property
setback granted by Zoning Adjustment Board (permit 4454) 21 April 1978.
Originally a 3 bedroom dwelling, the house has been converted by enclosing the former
garage by the addition of a brick exterior wall and chimney, interior wall, fire-
place and exterior door.
ADDITIONAL CONSTRUCTION/ALTERATIONS
P ro~e d construction (see plan attached) includes the following: l) installation of
4 " sewer l ine from left front side of the house around to main sewer line in rear.
(Pe r mit for required plumbing has been issued, sewer line laid, fixtures stubbed in,
and inspection by City uilllty Inspector completed.) 2) Installation of three interior
wa ll s , 3 doors and one window (exterior).3) Installation of turbo-vent over kitchen

Alterations are designed to provide an additional bedroom, bath 9 closet,and hallway
g iving access t o exterior door (existing) without going throu the bedroom in order
to reach the kitchen from the driveway. Min or improvement ntilation/cooling syse1
