Minutes
Zoriing Board of Adjustment
November 21, 1978
Members Present: Acting Chairman Harper, Members DuBois, Hawle y ,
Jones, Ringer (Council Liaison)
Staff Present: Building Official Koehler, City Planner Mayo.
(1) Approval of minutes of the meeting of October 17, 1978: DuBois
mo v ed that the minutes be approv e d as p resented. Th e mo t ion
was seconded by Jones a nd unanimo us ly a pproved.
(2) Consideration of a request for variance from Agency Records
Control. This item was deferred due to the absence of any
representative.
(3) Consideration of a request for variance from Joe Courtney.
Mr. Jim Blake, the purchaser of the property, saif that the
reduced space presented no problem to the use of the property.
Koehler presented the material furnished by the applicant and
concurred that there would be no interference with public faci-
lities and that other drives on the street had a similar pro-
blem to a lesser degree.
The Chairman moved that the variance be granted due to the ex-
istence of similar situations in the area, the fact that there
has been no observed detrimental effect, and in consideration
of the substantial cost and inconvenience of correction com-
pared to the lack of benefit to be derived thereby.
The motion was seconded by Ringer and unanimously approved.
(4) Consideration of a request for variance from John Painter.
Koehler said that the proposal would not interfere with public
utilities and that two other structures in the block had less
than the presently required setback. He offered the opinion
that the main purpose of rear setback was to assure light and
open space.
Mr. Painter saif that the original garage had been enclosed by
a previous owner and that he had been in contact with the owner
of the property to the rear who had no objection to the pro-
posal.
The Chairman moved that the variance be granted due to other
nearly similar structures, the lack of detriment to the ad-
jacent owner, and because sufficient open space exists else-
where on the lot. The motion was seconded by Ringer and unani-
mously approved.
(5) Consideration of a regular meeting date.
Harper moved that the third Tuesday of each month at 7:00 P. M.
would be a regular meeting date, and that a meeting would be
held at those times unless specifically cancelled. The motion
was seconded by Hawley and unanimously approved.
(6) Other business. Koehler suggested that the Board could act on
the written information furnished by Agency Records Control in
the deferred item (2).

The Chairman moved that item (2) be considered. The motion
was seconded by Hawley and u nanimous ly approved.
Mayo said that the existing buildings were built before an-
nexation and were now 42 spaces short of meeting minimum re-
quirements. Proposed construction would require at least an
additional 69 spaces for a total of 111 spaces plus an allowance
for employees and loading spaces. He pointed out that adjoin-
ing properties were under developement and that adjacent streets
could not be counted upon to accomodate overflow p arking. He
said that the owner had told him that the proposed additional
building would involve no new employees and that the owner did
not want to add any parking spaces to his existing facilities.
Mayo said that he had observed a lack of spaces for vehicles
present when he visited the site. He recommended that the
Board require at least 69 spaces plus two loading spaces and
pointed out that the City should consider any reasonable use
to which the building might be put when imposing minimum re-
quirements.
The Chairman moved that a variance be grant ed to require only
69 spaces rather than the normal 111 spaces plus employee spaces
and loading spaces because existing use does not indicate a
severe a need as the ordinance requires and the existing faci-
lity may be regared as a non-conforming use; provided however
that the variance be received at the end of one year to deter-
mine if actual use requires an additional 42 spaces plus an
additional 4 loading spaces as would be required by normal ap-
plication of the Zoning Ordinance. The motion was seconded by
Hawley and unanimously approved.
Adjourn There being no other business, the meeting was declared
adjourned.

TO: Zoning Board of Adjustment
FROM : Building Offi cial
SUBJECT : Requ est for Variance from A. R. C.
The City Planner has made studies of this case which indicate
that the numbe r of spaces actually required would be less than
that c alled for i n the ordinance . He has found that some new
spaces will be r equired , however .
The appl icant states that t here is no effect on the public
interest . Th is is true as long as the surroundi ng area i s
unde veloped , but there is a subdivision under construction
on ad j acent property. Overflow parking on the adjoining
street would be in some measure , detrimental t o these future
r esidents .
The Planner 's memorandum and recommend ation i s attached .

RE:
Zoning Board of Adjustment
City Planner; Al Mayo
Application of ARC
Agency Recors Control, represented by Dr. Wallace McMath, is
proposing to build 'a third building on their site. Dr. McMath
does not feel they need additional parking because he says
they will not hire additional people. They intend to relocate
existing personnel. The following is a summary of our investi-
gation of the existing and proposed situation:
Existing buildings 12,188.41 square feet
24,682.23 square feet
Total 36,870.64 square feet
Existing employees' parking lot -105 spaces
Existing visitors' parking lot -29 spaces
Np apparent loading spaces provided
Ordinance 850 parking requires 1 space I 300 sq~are feet
1 space/ 2 employees
1 loading space/ 10,000 sq. feet
36,870.64/300=123 spaces
Assume (conservatively) 1 person per car in employee lot only.
105/2 = 53 spaces
36,870.64/10,000 = 4 loading spaces
Total required: 176 parking spaces, 4 loading spaces
Total provided: 134 parking spaces, 0 loading spaces
Therefore, the existing project provides 42 parking spaces less
thean required and 4 less loading spaces. This is approximately
a 24% deficiency. I would also note that on three different
inspections at various times of the day the situation is that
all but three to five spaces are occupied in the employee lot
but there are at least that many parking in unmarked areas.
the visitors' lot is usually full with no more than three to
five vacant spaces, but with ten to twelve cars additional park-
ing in unmarked spaces. I would also note that the parking
plan is very poor and some marked spaces are not functional.
Now, the additional problem is the proposed building. The
building area is 27, 58 7 square feet. 'Ib·is would require an
additional 69 spaces plus an unknown number for employees plus
two loading spaces. Dr. McMath does not propose any spaces now.
I understand that they do plan some in the future-.~My obser-
vation of the existing situation is that they need additional
spaces now. An additional building can only make the situation
worse without additional parking provided. One more point that
should be noted, even though the use requires very little park-
ing, is that two warehous es exist a short distance behind the
main building s on the site. These total 22,396 square feet.
They are pres ently building a third warehouse at 10,000 square
feet. There is adequate space for parking there.

COLLEGE STATION. TEXAS 77840
We are not able to issue a building permit where the site plan
does not include en ough parking spaces to satisfy the require-
ments of Section 7-C of the Zoning Ordinance.
A study by the Planning Department indicates tha t 111 parking
spaces and 6 loading spaces are necessary for your exi s ting
.and proposed buildings to meet the requirement of the ordinance,
and this is the minimwn number which we :vould accept.
The correct procedure in a case such as yours, ~m e re the number
of spaces is fixed r a ther than "to be determined by the Co mmi ssi on",
would be to resolve the Il!.atter of the number of spaces through
appeal to the Zoning Board of Adjustment and then to obtain approval
of the Planning Commission for the layout of any new spac e s re-
quired.

Culpepper Plaza Variance
COLLEGE STATION, TEXAS 77840
The reconstruction o f the sign at Culpepper Plaza is for the purpose
of r epa iring wind damage. The external configuration o f the com-
pleted work will be the same as the e x isting sign.
The sign is non-conforming due to size and height limitations imp osed
after the structure was permitted. The hei ght of the sign is 47 feet,
where as the allowable he ight is now 35 feet. The area is now 1034
squar e feet as opposed to 825 square feet allowable.
The work consists of redesign and reconstruction of parts o f the sup-
porting structure and thus is mor e than ordinary minor repairs which
we could allow without action of the Board.
Th e contractor informs me that the cost of the work is less than 60
per-cent of the current value of the sign. Because of recent major
increa ses in costs of such signs, his is about the only reliable
apprai sal of current values in my opinion.

was seconded by Jones and unanimously approved.
(2) Consideration of a request for variance from Agency Records
Control. This item was deferred due to the absence of any

(3) Consideration of a request for variance from Joe Courtney.
Mr. Jim Blake, the purchaser of the property, saif that the
reduced space presented no problem to the use of the property.
Koehler presented the material furnished by the applicant and
concurred that there ·would be no interference with public faci-

The Chairman moved that the variance be granted due to the ex-

The motion was seconded by Ringer and unanimously approved.
(4) Consideration of a request for variance from John Painter.
Koehler said that the proposal would not interfere with public

The Chairman moved that item (2) be considered. The motion
was seconded by Hawley and unan imously a pproved.
Mayo said that the existing buildings were built before an-
nexation and were now 42 spaces short of meeting minimum re-
quirements. Proposed construction would require at least an
additional 69 spaces for a total of 111 spaces plus an allowance
for employees and loading sp a ces. He pointed out that adjoin-
ing properties were under de v elopeme nt a nd that adjac e nt streets
could not be counted upon to accomodate overflow parking. He
said tha t the ow ne r had told hi m tha t the proposed add itiona l
building would involve no new employees and that the owner did
not want to add any parking spaces to his existing facilities.
Mayo said that he had observed a lack of spaces for vehicles
present when he visited the site. He recommended that the
Board require at least 69 spaces plus two loading spaces and
pointed out that the City should consider any reasonable use
to which the building might be put when imposing minimum re-

The Chairman moved that a variance be granted to require only
69 spaces rather than the normal 111 spaces plus employee spaces

RE:

City Planner; Al Mayo
Application of ARC
Agency Recors Control, represented by Dr. Wallace McMath, is
proposing to build a third building on their site. Dr. McMath
does not feel they need additional parking because he says
they will not hire additional people. They intend to relocate
existing personnel. The following is a summary of our investi-
gation of the existing and proposed situation:
Existing buildings 12,188.41 square feet
24,682.23 square feet
Total 36,870.64 square feet
Existing employees' parking lot -105 spaces
Existing visitors' parking lot -29 spaces
Np apparent loading spaces provided
Ordinance 850 parking requires 1 space I 300 square feet
1 space/ 2 employees
1 loading spac e / 10,000 sq. feet
36,870.64/300=123 spa ces
Assume (conservatively) 1 person per car in employee lot only.
105/2 = 53 spaces
36,870.64/10,000 = 4 loading spaces
Total requ£red: 176 parking spaces, 4 loading spaces
Total provided: 134 parking spaces, 0 loading spaces
Therefore, the existing project provides 42 parking spaces less
thean required and 4 less loading spaces. This is approximately
a 24% deficiency. I would also note that on three different
inspections at various times of the day the situation is that
all but three to five spaces are occupied in the employee lot
but there are at least that many parking in unmarked areas.
the visitors' lot is usually full with no more than three to
five vacant spaces, but with ten to twelve cars additional park-
ing in unmarked spaces. I would also note that the parking
plan is very poor and some mark~dspaces are not functional.
Now, the additional problem is the proposed building. The
building area is 27,587 square feet. 'Ibis would require an
additional 69 spaces plus an unknown number for employees plus
two loading spaces. Dr. McMath do e s not propose any spaces now.
I understand that they do plan some in the future -.~My obser-
vation of the existing situation is that they need additional
spaces now. An additional building can only make the situation
worse without additional parking provided. One more point that
should be noted, even though the use requires very little park-
ing, is that two warehouses exist a short distance behind the
main buildings on the site. These total 22,396 square feet.
They are presently building a third warehouse at 10,000 square
feet. There is adequate space for parking there.

Dear Dr. McMath:
COLLEGE STATION, TEXAS 778~0
We are not able to issue a building permit where the site plan
does not include enough parking spaces to satisfy the require-
ments of Section 7-C of the Zoning Ordinanc e.
A study by the Planning Department indicates that 111 parking
space s and 6 loading spaces are necessary for your existing
and p r oposed buildings to meet the requirement of the ordinance,
and this is the min~ number which we ~ould accept.
The co:::-rect procedure in a case such as yours,· where the number
of space s is fixed rather than 11 to be determined by the Co mm ission11 ,
would be to resolve the matter of the number of spaces through
appeal to the Zoning Board of Adjustment and then to obtain approval
of the Planning Co mmission for the layout of any new spaces re-
quired.
If you desire to appeal t~is determination and seek a variance to
parki=lg requirement please contact Sherry Albrecht, the Zoning
Board Secretary, by letter within ten days of this date.

Culpepper Plaz a Var iance
COLLEGE STATION, TEXAS 77840
The re construction o f the sign at Culpepper Plaza is for the purpose
of repairing wind damage. The external configuration o f the com-
plet ~d work will be the same as the existing sign.
The sign is non-conforming due to size and height limitations imposed
after the structure was permi tted. The height of the si gn is 47 feet,
wherea s the allowable he ight is now 35 feet. The area is now 1034
square feet as opposed t o 825 square feet allowable. . .
The work consists of redesign and reconstruction of parts of the sup-
porting structure and thus is more than ordinary minor repairs which
we could allow without action of the Board.
The contractor informs me that the cost of the work is less than 60
per-cen t of the current value of the sign. Because of recent major
increas es in costs of such signs, his is about the only reliable
appraisal of current values in my opinion.
