our discussions with you, Dennis Goehring, Hart Pe ep le s ,
Morris Hamilton, Gary Woodard and myself, we feel that
the design options presented to us are limited in s cope
a nd will cause additional expenditure of funds by the
Bank . We believe the building a s designed has the i nh e e n t
saf ety factors as implied by codes and are therefore
requesting a meeting with your arbitration board a s soo
as practicable so that some grounds for common accord m ~y
be reached.

This letter is 'Written to summarize our conversation of }fay 4
concerning the Bank of A&M building.
We had previously agreed that revision of the mechanical plans
w-ill be made to provide for return air from second floor tennant
spaces to b e handled without routing it thr ough the second floor
corridor and to maintain the integrity of the one-hour tennant
separations. \{e have also concluded that the garden lobby roof needs
to be vented according to th~ requirements of NFPA-204 and the v enting
should be -of-an -automatic non-power actuation at anywhere from 150°F
to 200~F. Low melting point plastics would be satisfactory for this
p u rpose if yo u choose to use them.
We discussed the requirement of vertical opening protection for
the building as it is presently planned. I have concluded that some
method of pro t ection of paths of e g ress and prevention of heat and
S!!loke spread through occupied spac e s is a necessity for a re as onable
level o f life and property safety. We have discussed the following
alternatives as methods of accomplishing this which would be acceptable
to this office:
(1) Leave the garden lobby open to the floors at the stair area --
h2at and smoke from a fire at any location would vent through the lobby
and not be forced to concentrate in the stairwell, or
(2) Enc los e the stairwell entirely with a one hour rated wall
and door system, or
(3) Provide at least 50% of required exit capacity from the second
floor directly to the outside without traversing the lower floor and
meet all applicable req uirements o f NFPA 101, Ch. 6, Art . 1112.
At your suggestion we revi e wed a f ourth alternative of providing a
s w o~e sensor actuated alarm system which would act throughout the
building and also automatically alarm the fire station. We have concluded

that this would be satisfactory if each ground floor space adjacent to the
ground floor vestibule was equipp ed with an automatic sprinkler system
as well. The Fire Marshal tells me that such a system would be intended
for initial suppression only and tha~ pumper connections would not be
necessary.

Agenda Item No . 1 --Approval of the minutes of the meeting of December 16,
1975.
Ringer moved that the minutes be approved as read. The motion was seconde d
by Jone s and unanimously approved.
Agenda Item No. 2 --Consideration of a variance request from Dr. J. M.
Szabuniewcz.
Mr. Koehler pointed out that the applicant's plan observed all applicable
building lines and that a multi-family structure could be built on the same site
without having to observe the 60 foot minimum lot width. He said that the
minimum wid th provision of the ordinanc e for duplex zoning did not anticipate
construction in existing parts of town.
Jones stated that the construction proposed would be an improvement to the
nei ghb orhood and moved that the variance be granted. The motion was seconded
by Runnels and una nimously approved,

Mr. Goehring explained that one of the temporary drive~in windows would overlap
the side street setback lines, that they could not be put anywhere else on the
site without creating traffic problems on the adjoining major thorofares,
that State banking laws prohibited remote locations or the closing of the
facilities, and that the building would be in service about 90 days until the
permanent windows were completed elsewhere on the site.
Mr. Koehler said that the City Staff's study agreed with Mr. Goehring's statement
and that the ordinance allowed f or temporary building s incident to construction
to be used for non-conforming land use.
Weiss moved that the variance be granted. The motion was s econded by Ringer
and unanimously approved with Jones abstaining.
