Jones asked if spaces could not be required at such time as changing
use dictat ed their need . Mayo pointed out that changing occupancy could

adjoining property w~s being proposed for office use in addition to the

Hawley asked what rat io of parki ng spaces to employees the applicant

Hughey expressed reservations about "unique and special conditions of the
land •••• tt i,,d.thin the meaning of the ordinance . Hawley remarked that the
Board existed to determine a common sense approach to the letter of the
ordinance within the public interest, and suggested establishing for' this
op eration a ratio of spaces per employe e and providing for a review after one
year of actual use .
Th e Chair moved that, whereas Agency Records Control ha d added 35 spaces
unkno'Wll to the Board in their last consideration, a variance be granted
to require no more additional spaces because sp ecial conditions of the
land and its use would result in unecessary hardship resulting from un-
ecessary spaces and no detriment to the publ~c interest appears tecause
existing use does not indicate as severe a need as the ordinance require s ;
provided that within one year of the issuance of the Certificate of
Occupancy for the propo s ed new building , the Planner's office will review
the use of the parki ng areas and if , in their opinion, additional spaces
are required, the Board would he'll' any appeal of the nlLmber of sp~ces thus
determined and required . The motion was seconded by Jones and v~s approved
by the following note :

Agenda Item No . 3 -Consideration of a request to reconstruct a non-
conforming structure from J . c. Culpepper:
Koehler explained that the proposal was to repair wind damage by internal
structural modification and was thus beyond what he could authorize as
ttordinary minor repairs11 without a building permit . He introduced his
memorandum detailing the nature of the non-conformity.
Mr . Culpepper said that, in the absence of the permission requested, his options
would be to reconstruct to the newly imposed standards; or more likely ,
to reconstruct with the same materials and design used previously. He said
that his proposal would avoid the potential of f u ture wind damage .
The Chair moved that the Board consider the case i n light of Section 11-B.3 (a )
and appro ve the request as the substitution of one non-conforming use for
another , the extent of the substituted use being less detrimental to the
environment than the first . The motion was seconded by Hawley and unanimously
approved .

Expansion of a non-conforming structure at 301
The building is non-conforming due to a shortage of rear s etback.
The proposed addition does not itself encroach on any building line.
Parking is adequate for the proposed use and area, and the parking
layout is not subject to Planning Commission review.
The applicant intends to convert the bui lding to a ··recreation hall.
Agenda Item No. 3. Reconstruct ion of a n on-con forming structure at
1806 Sabine Court.
The proposal is to add a second story to a portion of an existing
structure which encroaches on a rear setback line. The lot is of
an unusual shape at the end of a cul-de-sac.
This proposal differs from one prev iously cons idered o f this
property in that there will be no extention o f building line
encroachments.
The Board declined to take action on the previous proposal .due in
part to a lack of information. The applicant has furnished more
comprehensive plans for his present application.

presently operati ng th e sta tion and woul d lik e to ma ke an
addition to the present structure . I will continue to use
the pre se nt offic e for the retai ling of gasoline , and I ·
am g oi ng to use only the si d e island on Boyett Street for
the sal e of this ga soline . The part of the station where
th e t hree ( J ) serv.lce bay are as are loc ated will be c.onverted
to a game room and I n~e d to construct a nonconforming
structure as shown in my plans wh ich are attached.
The v alue of th e nonconformi n g structure will be less than
60% o f the appraised v alu e of the conformi ng s tructure .
Also, th e new nonconforming structure will be construct ed in
such manner allowing me to return at a future date to th e
present conforming structure if necessary .

Request for reconstru ction of a non-conforming structure
at 18 06 Sabine Court, Colle ge Station, Texas ; or mo re
specifically described as: Lot 4 Block 1, Southwood
addition Section Four, College Station, Texas, according
to the plot recorde d in Volume 265, Page 157 of the Dee d
Records of Brazos County Texas.
We re spectfully request of you, the board, _to grant in
favor of reconstruction over a now conforming structure for
the purpose of creating a suite for the widow, Mrs. Doris
Schaeser, mother of Doris Hill property owner.
The suite is to be added above the existing garage which
in itself encroaches t he twenty-fiv e foot set back requirement
adopted by The City of College Station after the initiai
construction _of the existing structure some ten years ago. The
encroachment is approximately four feet eight inches. This
request is rendered as there is no other feasible alternative
for any addition to the existing structure due to the
irregularity of the prop e rty lines .
We do not feel that the request is of an unreasonable nature
as the structure is designed to architecturally coordinate with
the existing structure as can be clearly s een in the elevations
and Photo A.
Furthermore, the structure to be constructed will not be
out of coordination with the remainder of the subdivision as
there such other additions as 'follows.

garage added apparently.

Construction of the suite will in no way invade anyones
privacy as the nearest structur e is some 118' away (measured
nearest point to nearest point -See Photos C & D).

Th e construction consists of tearing off the existing
roof, and hauling off any waste materials, The exist ing
jois t will be replaceq with one by twel ves for floor joists
with a floor consi stin g of a double laye r o f plywood.
Regular framing constructi on will take p l ace after this poin t .
The new c onstruction will be approximately eleven feet higher
t han the exist ing structure, there by creating a suite with a
bath, kitchen, and an efficiency type of liv ing area.
Co nstru ction of s tairs will als o be added on the back side
of the hous e for acces s . App roximate encroachment on the set
b a ck requireme nt by the stairs is approximately seven feet.

As per our phone conver sation earlier today, I am sending you
the requested information on the Holiday Oil Compnay request
to the Zoning Board of Adjustment.
Mr. Holiday does propose to use the three (3) service bay area
you mentioned for the purpose of installing a gameroom, as you
stated. This fact had slipped my mind. The present office
will continue to serve as his off ice for the retailing of
gasoline. The side island, on Boyett Street , which is presently
in use will continue as the only service island under the
proposed plans.
The proposed addition will be in the amount of 492 square feet.
The property is presently zoned C-1. The reason that this
service station is a non-confirming use is that the lot is
exceptionally small and therefore the building violates the
setback requirement of the Zoning Ordinance No. 850.
The case will be heard Tuesday, December 19, 1978, at 7:00 p.m.
in the Municipal Courtroom of the new Police and Municipal
Court Building. Please feel free to either come as a represen-
tative of a property owner or call for any other information
you feel you might require.
