Co n trol. This item was de fe r r e d due to the absence o f any
representative.
(3) Consideration of a request for variance from Joe Courtney.
Mr. Jim Blake, the purchaser of the property, saif that the
reduced space presented no problem to the use of the property.
Koehler presented the materi a l furnished by the applicant and
con curre d that the r e would b e no i n te rferen ce with public fa c i -
lities and that oth er drives on the street had a simi l ar p r o-
blem to a lesser degree.
Th e Chai r man moved that the v ariance be granted due to the e x --
istence of similar situa tion s in th e area , the fact that the re
has be e n no observed detrime ntal ef f ect, and in consideration
o f the substantial cost and inconve nience of correction com-
pared to the lack of benefit to b e d e rived thereby.
The motion was seconded by Ringer and unanimously app r oved.
(4) Consideration of a request f o r variance from John Painter.
Koehler said that the propos a l would not inter f ere wi th public
utilitie s and that two other structures in the block had less
than the presently required setback. He offered the opinion
that the main purpose of rear setback was to assure light and
open space.
Mr. Painter saif that the original garage had been enclosed by
a previous own e r and that he had been in contact with the owner
of the property to the rear who had no objection to the pro-
posal.
Th e Chai r man moved that the variance be granted due to other
nearly similar structures, the lack of detriment to the ad-
jacent owner, and b e cause su f ficient open space exists else-
where on the lot. The motion was seconded by Ringer and un a ni-
mously approved.
(5) Considera tion of a regular me eting date.
Harper moved that the third Tuesday of each month at 7:00 P. M.
would b e a regular meeting d a te, and that a meeting would be
h e ld at those time s unl e ss specifically cancelled. The motion
wa s seconded by Ha wley and unanimously approved.
(6) Othe r business. Ko e hler sugg ested that the Board could act on
the written informa tion furnished by Agency Records Control in
the deferred item (2).

Mayo sa id that the existing buildings were built before an-
ne xa tion and were now 42 sp a ces short of meeting minimum re-
quireme nts. Proposed construction would require at least an
additional 69 space s for a total of 111 spaces plus an allowance
for employees and loading spaces. He pointed out that adjoin-
in g prop ertie s were under developement and that adjacent streets
could not be counted upon to accomodate overflow park i ng . He
said that the owner had to ld h i m t hat the p rop os ed additional
building would involv e no new emp loyee s and that the owner d id
not want to add any parking spaces to his existing facilities.
Mayo said that he had observed a lack of spaces for vehicles
present when he visited the site. He recommended that the
Board require at least 69 spaces plus two loading spaces and
pointed out that the City should consider any reasonable use
to which the building might be put when imposing minimum re-
quirements.
The Chairman moved that a variance be granted to require only
69 spaces rather than the normal 111 spaces plus employee spaces
and loading spaces because existing use does not indicate a
severe a need as the ordinance requires and the existing f aci-
lity may be regared as a non-conforming use; provided howeve r
that the variance be received at the end of one year to deter-
. mine if actual use requires an additional 42 spaces plus an
additional 4 loading spaces as would be required by normal ap-
plication of the Zoning Ordinance. The motion was seconded by
Hawley and unanimously approved.
(7) Adjourn There being no other business, the meeting was declared
a dj ourned.

Agenda Item Number 1 Approval of the minutes of the meeting of
September 19, 1978:
DuBois moved that the minutes be approved as presented. The
motion ~Jas seconded by Jones and unanimously approved.
Agenda Item Number 2 --Consideration of a request for permit
to modif'v-a non-conforming structure by Dr. Peter Helfert at
1303 Augustine Court:
Koehler explained that the permit requested -was for interior modi-
fications to a bathroom and that the ~~rk would not modify the
exterior of the structure in any -way. He introduced the permit appli-
cation and his letter of Septe~ber 25, 1978 authorizing the owner to
proceed at his risk of Board approval.

Mrs. Helfert asked if there were any ~ay to remove the status of a
non-conforming structure.
CPT. Joe McNabb spoke of disagreements with the previous o~mer and
questioned the propriety of the previous permits , ins pec tions and
construction on the site.
Hughey moved that the permit be approved in that the construction
proposed would have no effect on the conformity or life of the struc-
ture and no public interest ·would be served by denial. The motion
-was seconded by Ringer an~ unanimously approved.

There -was no other business.
Agenda Item Number 4 --Adjourn:
Ringer moved that the meeting be adjourned. The motion -was seconded
by Hughey and unanimously approved.

The City Planner has made studies of this case which indicate
that the number of spaces actually required wo u ld be less than
that called for in the ordinance . He has found that some new
spaces will be required , however .
The a pplicant states that there is no effect on the public
interest . This is true as long as the surrounding area is
undeveloped , but there is a subdivision under construction
on ad j acent property. Overflow parking on the adjoining
street would be in some measure , detrimental to these future
residents .

Application of ARC
Agency Recors Control, represented by Dr. Wallace McMath, is
proposing to build a third building on their site. Dr. McMath
does not feel they need additional parking because he says
they will not hire additional people. They intend to relocate
existing personnel. The following is a summary of our investi-1.
gation of the existing and proposed situation:
Existing buildings 12,188.41 square feet
24,682.23 square feet
Total 36,870.64 square feet
Existing employees' parking lot -105 spaces
Existing visitors' parking lot -29 spaces
Np apparent loading spaces provided
Ordinance 850 parking requires 1 space I 300 square feet
1 space/ 2 employees
1 loading space/ 10,000 sq. feet
36,870.64/300=123 spaces
Assume (conservatively) 1 person per car in employee lot only.
105/2 = 53 spaces
36,870.64/10,000 = 4 loading spaces
Total required: 176 parking spaces, 4 loading spaces
Total provided: 134 parking spaces , 0 loading spaces
Therefore, the existing project provides 42 parking spaces less
thean required and 4 less loading spaces. This is approximately
a 24 % deficiency. I would also note that on three different
inspections at various times of the day the situation is that
all but three to five spaces are occupied in the employee lot
but there are at least that many parking in unmarked areas.
the visitors' lot is usually full with no more than three to
five vacant spaces, but with ten to twelve cars additional park-
ing in unmarked spaces. I would also note that the parking
plan is very poor and some mark~dspaces are not functional.
Now, the additional problem is the proposed building. The
building area is 27,587 square feet. 'Ib is would require an
additional 69 spaces plus an unknown number for employees plus
two loading spaces. Dr. McMath does not propose any spaces now.
I understand that they do plan $ome in the future-.~My obser-
vation of the existing situation is that they need additional
spaces now. An additional building can only make the situation
worse without additional parking provided. One more point that
should be noted, even though the use requires very little park-
ing, is that two warehouses exist a short distance behind the
main buildings on the site. These total 22,396 square feet.
They are presently building a third warehouse at 10,000 square
feet. There is adequate space for parking there.

We are not able to issue a building permit were the site plan
does not include enough parking spaces to satisfy the require -
ments of Section 7-C of the Zoning Ordinance.
A study by the Planning Department indicates that 111 parking
spaces and 6 loading spaces are necessary for your existing
and proposed buildings to meet the requirement of the ordinance,
and this is the minim~ number wich we ~ould accept.
The correct procedure in a case such as yours, where the number
of spaces is fixed rather than 11 to be determined by the Commission11 ,
would be to resolve the :matter of the number of spaces through
appeal to the Zoning Board of Adjustment and then to obtain approval
of the Planning Commission for the layout of any new spaces re-
quired.
If you desire to appeal this determination and seek a variance to
parki!ig requirement please contact Sherry Albrecht, the Zoning
Board Secretary, by letter within ten days of this date.
Miss Albrecht will arrange With you to get what information the
Board will need to consider the case.

SUBJECT: Variance , 3332-3334 Bluestem
1. The builder 's subcontractor inadvertantly poured a drive-
wy for this duplex which is not of the required on-site park-
ing depth . We discovered this at the final inspection and also
discovered twelve other duplexes in this block with substantially
the same problem. The other duplexes involve three other builders
and have been occupied for up to two years.
2. The purchaser would prefer to leave the drive as it is for
the following reasons :
1 . The house is on a cul-de-sac which is unlikely ~
ever to be extended or widened.
2 . The parking provided will not require any car to
protrude to the curb line .
3. The existing drives in the area are substantially
the same and create no problem.
4. The lot is in a curved portion of the cul-de-sac
and the shortage is not readi ly discernable .
3 . The Water and Sewer Department does not recommend that the
City make the service re -locations that we would have to do in
order to allow the builder to re-build the drive to full com-
pliance . The Building Department does not recommend that we
attempt an after the fact adjustment of tl'E other drives , and
requiring full compliance here under the circumstances appears
to serve no practical purpose .

Dear ~lr . Nelson,
The duplex on lot 35, block 1, Southwood Terrace has been
inspected and found to be in compliance with the Building
Code and local ordinances regulating building with the
sole exception that the paved driveway dimensions do not
meet the required minimum.
The builder, the owner and this department have referred
this matter to the Zonirig Board of Adjustment for wa i ver
of this requirement for the reasons stated in the attached
memo randum .
Should the Board not grant the relief requested, the
remedy would be to add the required pavement to that
mich exists. The property would in either case be in
compliance at the conclusion of the Board's action.

SUBJECT : Request for Variance at 1119 Merry Oaks
The proposed garage structure would not interfere with
utilities or easements . Access will not be allowed to
Carol Street, since Carol is a collector . The applicant
is aware that the garage and house would have to be con-
nected .
The property to the rear is now undeveloped but will
likely be developed as single family residences . Most
of the houses in the subdivision observed the 25 foot
setbacks presently required . We know of two which appear
to be 20 feet from the rear line .
The Fire Marshal has no objection to the proposal.

Item #5 At this time the Zoning Board of Adjustment has
no regularly scheduled meeting date or time, As
such, when the City recieves a case which should
be brought to the attention of the Board, a meet-
ing must be called. Not only does this cause a
hardship on the members from time to time, we al-
so have been questioned by the public as to the
irregularity of the Board's activities.
As a permanent committee appointed by the College
Station City Council, I would like to suggest that
the Zoning Board of Adjustment, as other committees,
set a regular day of the month to meet. I would
suggest the third Tuesday of the month at 7:00 P.M.,
as that is the day the Board has been meeting lately.
With this arrangemant, you would be aware a meet-
ing is scheduled, rather than being notified a week
in advance.

DuBois moved that the minutes be approved as presented. The
motion ~>as seconded by Jones and unanimously approved.
Agenda Item Number 2 --Consideration of a request for p ermit
to modif'-r a non-conforming structure by Dr. Peter Helfert at
1303 Augustine Court:
Koehler explained that the per.nit requested -was for interior modi-
fications to a bathroom and that the work would not modify the
exterior of the structure in any ....,ray. He introduced the permit appli-
cation and his letter of Septe!llber 25, 1978 authorizing the owner to
proceed at his risk of Board approval.
Mrs. Helfert asked if there were any vray to ·remove
non-conforming structurer

CPT. Joe McNabb spok e of disagreements ID.th the previous o"t-mer and
questioned the propriety of the previous permits, inspections and
construction on the site.
Hughey moved that the permit be approved in that the construction
proposed 'WOuld have no effect on the conformity or life of the struc-
ture and no public interest ·would be served by denial. The motion·
i.ra.s seconded by Ringer and unanimously approved.

The City Planner has made studies of this case which indicate
that the number of spaces actually required would be less than
that called for in the ordinance. He has found that some new
spaces will be required, however.
The applicant states that there is no effect on the public
interest. This is true as long as the surrounding area is ,
undeveloped, but there is a subdivision under con struction
on adjacent property. Overflow parking on the adjoining
street would be in some measure, detrimental to these future
residents.

Agehcy Recors Control, represented by Dr. Wallace Mc.Math, is
proposing to puild a third building on their site. Dr. McMath
does not feel they need additional parking because he says
they will not hire additional people. They intend to relocate
existing personnel. The following is a summary of our investi -. '·
gation of the existing and proposed situation:

24,682.23 square feet
Total 36,870.64 square feet

Existing visitors' parking lot -29 spaces

Assume (conservatively) 1 person per car in employee 10t only.

36,870.64/10,000 = 4
Total required: 176
Total provided: 134

Therefore, the existing project provides 42 parking spaces less
thean required and 4 less loading spaces. This is approx imately
a 24 % deficiency. I would also note that on three different
inspections at variou~ times of the day the situation is that
all but three to five spaces are occupied in the employee lot
but there are at least that many parking in unmarked areas.
the visitors' lot is usually full with no more than three to
five vacant spaces, but with ten to twelve cars additional park-
ing in unmarked spaces. I would also note that the parking
plan is very poor and some ma:rk~dspaces are not functional.
Now, the additional problem is the proposed building. The
building area is 27,587 square feet. '!his would require an
additional 69 spaces plus an unknown number for employees plus
two loading spaces. Dr. McMath does not propose any spaces now.
I understand that the y do plan some in the future-.~My obser-
vation of the e x isting situation is that they need additional
spaces now. An additional building can only make the situation
worse without additional parking provided. One more point that
should be noted, even though the us e requ ire s very little pa r k -
ing, is that two warehouses exist a short distance behind the
main buildings on the site. These total 22,396 square feet.
They are presently building a third warehouse at 10,000 square
feet. There is adequate space for parking there.

We are not able to issue a building permit where the site plan
does not include enough p:u-king spaces to satisfy the require-
ments of Section 7-C of the Zoning Ordinance.
A study by the Planning Department indicates that 111 parking
spaces and 6 loading spaces are necessary for your existing
.and proposed buildings to :meet the requirement of the ordinance,
and this is the minim~ nU!llber which we ~ould accept. .

The correct procedure in a case such as yours,"~mere the number
of spaces is fixed rather than 11 to be determined by the Commissioni•,
would be to resolve the matter of the number of spaces through
appeal to the Zoning Board of Adjustment and then to obtain approval
of the Planning Commission for the layout of any new spaces re-
quired.

1. The builder's subcontractor inadvertantiy poured a drive-
way for this duplex which is not of the required bn-site park-
ing depth. We discovered this at the final inspection and also
discovered twelve other duplexes in this block with substantially
the same problem. The other duplexes involve three other builders
and have been occupied for up to two years. ~
2. The purchaser would prefer to leave the drive as it is for
the following reasons:
1. The house is on a cul-de-sac which is unlikely ~
ever to be extended or widened.
2. The parking provided will not require any car to
protrude to the curb line • ...
3. The existing drives in the area are substantially .
the same and create no problem.
4. The lot is in a curved portion of the cul-de-sac
and the shortage is not readily discernable.
3. The Water -and Sewer Department does not recommend that the
City make the service re-locations that we would have to do in
order to allow the builder to re-build the drive to full com-
pliance. The Building Department does not recoIILrnend that we
attempt an after the fact adjustment of tlB other drives, and
requiring full compliance here under the circumstances appears
to serve no practical purpose.

To: Zoning Board of Adjustment

Re: Regular Meeting Time
Item #5 At this time the Zoning Board o f Adjustment has
no regularly scheduled meeting date or time. As
such, when the City recieves a case which should
be brought to the attention of the Board, a meet-
ing must be called. Not only does this cause a
hardship on the members from time to time, we al-
so have been questioned by the public as to the
irregularity of the Board's activities.
As a permanent committee appointed by the College
Station City Council, I would like to sugge s t that
the Zoning Board of Adjustment, as other committees,
set a regular day of the month to meet. I would
suggest the third Tuesday of the month at 7:00 P.M.,
as that is the day the Board has been meeting lately.

With this arrangemant, you would be aware a meet-
ing is scheduled, rather than being notified a week
in advance.
