ZONING BOAP,D OF ADJUSTMENT
PROCEDURE FOR FILING A REQUEST FOR VARIANCE
(1) In or der for th e Board to consider a case, th ere mus t be on fil~~ a
complete applica tion for a build ing permit whic h li::1s b ee n rejected by the
Buil ding Offi cia l and a completed "Request for Variance " application .
If some unique circumstance renders a full design impra ctical , and if
th e Boar d consent s , th e appea l may b e b ased on a d ecision r en d ered in writing
b y t he Bu ildin g Officia l in re ply to th e applicant 's written inquiry as to the
effect of a. par ticula r zo ning requirement on a propo sed p lan . A complete
application for v ariance must a l so b e filed alon g wit h a ny drawings or data
n ecessary to show the nature and exten t of the v ariance .
(2 ) Th ere wi ll b e no it em place d on th e Board agenda nor any notice
publis h e d until all of th e ma terials mentioned above a r e complete and in
h and . We provide no ma t er ials to the Board in support of a variance except
th a t whi ch we receive from the applicant and can r e produc e in-h ouse (8 1/2 x
1 4 max size , line work).

(c) Owners within 200 fee t may b e deter mined by scal e from the

property l ine o f the lot or tr act in qu est ion , or , if the
tra c t is bounded by a stree t, f r om th e opposite sid e of the
street .
(cl) The n ames and a ddr esses must b e as they appear o n City tax
rolls , even if they are wrong or out of date .

(a) The building d e partment will a ss ist you in finding th_ zoning
o f the tract , identifying th e s ec tion o f the ordinanc e and
spec ifying the variation.
(b) The rema ining thre e secti on a ddr ess t h emselves to the three
findings th a t the Board must mak e in ord er to g rant a variance.
If the Board cannot agree with a ny on e of th ese , th e y wlll not
b e a ble to grant th e varian ce .
(c ) The application will b e se nt to the Building Of fici al, City
Engineer and Fire Marsh a l for comment on a ny facts within their
knowledge which may b ear on th e case .
(S) Notice of t he h ear ing will be publi shed on th e We<ln e day preceeding
th e mee ting a nd will b e mailed by the building d e partment to th e owners
within 200 fee t . The complete ap plic ation mus t b e rec e ive d b y the close
of b usiness on the Mo n<lay pr eceeding the date of publication i n order for us
to meet the pub l isher 's d ea dline .
(6) Should a ny p erso n d e sire to a pp eal a decis ion o f th e Board, h e s hould
so statP. af t e r the conclusion ·o f t h e hearing . Tlt e chairman will comp l ete

hi s statement of findings which will constitute filing of the deci sion .
Minutes of the meeting , subject to approval of the Board , will be prepared
by the close of business on the following day . A dupli cate tape of the
pr oceedings will be made available to the appellant 's attorney upon request
and upon receipt of comp ensation for the 1 20 minute cassettes us ed for the
duplication. No transcript is made of the hear ings . Minutes of the pro-
c eedings are paraphrased as appropriate , in the judgement o f th e recorder ,
to reflect points of the discussion pertinent to the decisions rendered .

The purpose of this letter is to obtain a variance on a
lot located at 308-310 Amherst Court in College Station.
The building was sited within the front building line.
I have enclosed a copy of the survey showing the encroach-
ment.
Bill, you are the person who will best be able to help me
in this matter. I need a letter from you or the variance
committee to satisfy the lending institution.
I understand the committee meets November 15. I trust
that a variance could be granted and a letter will be
issued. Your help in obtaining such a variance would be
deeply appreciated.

inspection by our inspector . The builder discovered the error upon
final survey and brought it to our attention .
