This variance is necessary due to the folloWing unique and special conditions . of the land not found in li.~e districts: Mr Gatti•s specific location in the Northgate areanecessitates clear visability of the sign as the main business is not visable from University Drive and is set back more than 200 feet from College Avenue. No Frontage on either street exists. MR GATTI'S sign is small as compared to the_ huge "MC DONALDS" sign; therefore,_it is essential that aX:Pi-i"iEqllOCirbntx a small portion of the sign is allowed to flash and mov~ in order that it be visable. Thi s variance is necessary to allow Mr Gatti's to me et adjacent c6mpetion in the food business. The follow-i_ng alternatives to the requested variance are pos sible : Tbjs sign was constructed at a cost in exceee-of $8,000.00 . It is unique in character and design. Complying with the City of College· Station's request to "dismantle and deactivate" it is not just a matter of throwing a swi t ch. Complete redesign and replacement is necessary in order to avoid a state o f dillapidation in appearanc e involving the image of Hr Gatti·~ of College Sta Hen.. The motion was seconded by Henry Hawley and unanimously approved . Agenda Item No . 2 --Con sideration of a reque s t for variance from Tony Jones Con struction Company at J08 -310 Amherst : Bill Koe hler explained that the building had been built over the front set- back line on a cul-de-sac lot and that it had not been discovered by either the City in s pector or the builder until the structure was ready for occupancy. He pointed out that the structura l modifications to the building would involve living room and kitchen areas and would thus r equire a rebuilding of at least half of the structur e . He said that there would be no interference with utilities , that all other s ite requirements were met and that the building line encro achment i s not discernable except by surv eyor 's -measurements and effects no other property. Henry Hawl ey mo ved that the variance be granted a s requested, L~ that .all requirements for variance were met . The motion was seconde d by J ohn Hughey and unanimously approved . Agenda Item No . 3 -~ Con s ideration of a reque s t fGr variance from H & S Ti r es at 509 UniYersity Dr ive : Bill Koehler explained that the r equ est wa s to replace a s i gn on an exi sting base which had been in disuse f or over one year , showed other non-conformities in t he area and s tated that the height limit would have to be varied in order for the sign to be visible to traffic on University Drive . Mr . Lonnie Scasta said that the business had operated without the sign and found that credit card business required a product identification . He estimated that the · proposed sign would he about the same . size and height as the . ii ARC0 11 . sign in the ne:xi; block . Larry Ringer pointed out that continued variances could perpetuate nq.n-conforrn- i ty throughout the area and that it mi ght be appropriate to limit height or size wh ile allowin g the existing ~a se to be u sed . John Hugh~y rema;r-~eQ that rio strong case of hard ship had been shown and that it was the intent of the City to bring about eventual conformity with s ize and height requirements . Henry Hawley pointed out that hardship could arise from non-conformity of competitor s in sight of the business .
