Aoproval of the minutes of the meeting of February 15, 1977: Hughey moved that the minutes be approved as rsad. The motion was seconded by Storts and unanimously approved . 2. Consideration of a request for variance from Dr. James R. Bradley at 209 Dominik Drive: This item was deferred to allow time for Dr. Bradley's representative to be present. 3. Consideration of a request for variance from Mr. Phil Springer at 801 University Drive. Koehler stated that the application was for expansion of a non•conforming use rather than a variance as shown on the agenda. Mr. Springer said that the value of the addition was about 127. of the value of the structure, that the sign did not conform to the size and hwight limits established in December of 1976 and was intended to advertise a drive·thru service permitted prior to that time and requiring a substantial investment. Weiss observed that the value of the expansion was within ·the l imits provided by ordinance. Board members concurr ed that the addition proposed would not increase the extent of non-conformity in any substantial way and would not prolong the like of the structure. Weiss moved that the permit be approved. The motion was seconded by Hughey and unanimously approved. 2. Consideration of a request for variance froM Dr. James R. Bradley at 209 Dominik Drive: Koehler explained that the ordinance required greater parking for a medical clinic than for a retail commercial use and presented Dr. Bradley's application. He said that he _had .been contacted by two nearby owners who said that they had no objection to the request. The Board noted the following points: ) i ·, There · was no nearby on-street parking for overflow,. The building layout indicates a possibility of expansion of t he prac - tice by employing addi t ional assistants, increasing parking requirements beyond the pre s ent esl:i inat e . A future owner or practicioner could change the nature of the p ractice to operate without appointments and thus increase parki ng r squi reme nts . The Board agr~ed to defer action until the me e ting oi . April 19, 1977 in order that the applicant might have a chance to respond and directed the Building Of f icial to infor.ia tha applicant. 4. The board noted the following points which they considered pertinent to the case: In the event that your parking needs exceed the space available, even though at infrequent times, there is no public on-street pa~king anywhere near your site. (On-street parking will not be alhiwed on Dominik and there are no nearby side streets.) Future develop~nt of adjacent sites might be adversely effected if ov~rflow from this opera~ion attempts to park in another parking lot. The layout of tha building indicates that i~ would be possible to expand the practice (i.e •. Koehler Building Official MINUTES Zoning Board of Adjustment April 19 , 19'77 MEMBERS PRESENT : Acting Chairman Runnels , Membe r s Comstock , Storts , Council Liaisson Ringer serving as alternate member . MEMBERS ABSENT : Chairman Weiss , Member Hughey 1. App r oval of the minutes of the meeti ng of March 15 , 1977: No corrections being offered , the minutes were declared approved . 2. Determination of a request for vari ance from Dr . James R. Bradley at 209 Dominik Dr: Buil ding Official Koehler reviewed the progress .of the case at the previous meeting. Dr . Bradley s t ated that the Board was correct in its assumptions of the number of empl oyees who could be required in the future . He pointed out that more than three patients waiting would be an impracticality for a dentist and that two local dentist , Dr . King and Dr . Payne had told him that they never had more than 10 persons in their offices at any one time . He said that his plan had already been amended to provide 10 spaces . Runnels moved that the variance be granted to allow 10 spaces to be provided. The moti on was seconded by Storts and unanimously approved . J . Consideration of a request for variance from Cruse Cor p oration at 118 Richards St.: Koehler reviewed the points made in the application and said that he knew of no practical problem which would be created by the prox:ilnity of the structures proposed. Mr . Cruse stated that he had been unfamiliar with building in older parts of the Ci ty when he made the design and contractual arrangements with the prospective purchaser . Mr . Sam Ford stated that in his opinion , there would be no opposition from anyone in the neighborhood to the proposal. Runnels moved that the variance be granted as requested . The motion was seconded by Storts and unanimously approved. 4. Consideration of a request for variance from Area Progress Corporation at 1305 FM 28 18 : Koehler reviewed the statements of the application and said tha t the ordinance would normally require 17 spaces rather than the 11 provided. He pointed out that both access and parking were to be common to adjacent commerc i al lots . Mr . John Heyde · stated that Area Progress Corporation would pave rear areas in completing the center and pointed out that the plans showed mo st of the building area to be workrooms not generating any substantial amount of parking demand . Dr . White , the lessee , said that his practice would require only himself and one assistant with a maximum of three customers by appointment . Runnels moved that the variance be granted as requested . The motion was seconded by Ringer and unanimously approved . 5. Other business : There was no other business . 6.
