TO WHOM IT MAY CONCERN:
The Zoning Board of Adjustment of the City of College Station
will consider a request for a variance from John Garner, at
their called meeting in t he Council Room in the College Station
City Hall at 7:30 P.M. on Tuesday, June 21, 19'77, the facts of
the case being as follows:
The applicant requests a variance to the rear setback require-
ments of the Zoning Ordinance in order to construct a residence
on his property at 701 Thomas.

The following spec i fi c variation from the ordinance is requested: ___ _
I request a variance in building line setback from the rear
property line (parallel to Th omas St.) to place the rear wall of
my house exactly 5 ft. from t h e rear property line.
Thi s variance is necessary due to the fallowing unique and _!pecial conditions;.
of the land not found in like districts: -.,
Two J arge oak trees in t h e central portion of t h e 1 at necessitate
a request for yariance. These two trees have reached their maturity
and provide an a menity not only to t h e lot but to/~~~ghborbood as
well . Moreovex-, they will provide shade for the house, which lies
north of t h em.
The following alternatives to the requested variance are possible=~-----~
Unfortunately, there would be n o alternative but t o destroy and
remove the t rees if t h e variance is not granted. If t h e h ouse were
placed to t h e f ront or sides, a similar varian ce would still be needed.

The Zoning Board of Adjustment has examined the fact s presented herein and
reflected in the minutes of the public meeting of and have
determined that the requested variance (IS / IS NOT) contrary to the public
interest and that unique and special conditions (DO /DO NOT) exist as stated
herein .and as reflected in the minutes of the Board's proceedings and the variance
as requested herein (IS / IS NOT) approved subject to the following terms and
conditions:

NOTE: Any p erson or persons or any taxpayer or any officer, department, board,
coIII!D..ission or committee of t he City, jointly or severally, aggrieved by any
d e cision of the Board of Adjustment, may present to a court of record a petition,

specifying the grounds of t h e illegality. Such petit ion shall be presented to the
c ourt w.i:thin ten (10) days after the filing of the decision in the office of the
