Request for variance from Fred Sicilia, at 100 Moss Street: The setbacks normally required for the proposed structures are 7t feet from the interior side lot line, 15 feet from the side street line (T exas Avenue), 25 feet from the rear line and 15 feet from the existing s t ructure. The garage could be attached t o the existing house, eliminating the 15 feet clearance requirement. 11ost of the structures in the block wer e built prior to the passage of the present ordinance and out buildings were not required to me et a 25 feet rear setback. The right-of-way of Texas Avenue is u..~usually wide at this lot, there being approximately 70 feet from back of curb to the p roperty line. If t he variance were granted, I would recommend that a minimum. of 5 feet t o the interior lot line be required in order to be consistent with the locations of other structures in the neighborhood. There is a 10 foot utility easement along the rear line which cannot be encroached up on unless the Council abandons the easement by ordinance. 2 . Re quest for reconstruction of a non-conforming use by Allen Swoboda at 2601 Texas Avenue; The sign which is to be replaced existed prior to annexation by the City. The owner took down the old sign and began re- c onstruction before he became aware of the requirement for permit. Th e mobile home park has no exposure to Texas Avenue or any major thoro- fare and was built at a time when it could rely on a sign constructed off-premises. A sign of some sort might be of value to the public generally to i dentify an otherwise obscure entrance. If the variance is granted I would recommend that the sign be moved back a t least 10 feet from the property line in order to enhance sight dis t ance from Krenek Road to the northbound lane of Texas Avenue. The Board may wa nt to consider imposing the condition that the sign be removed at such t ime as Kr enek Ro ad is constructed to the width required for a collector or t horofare street. 3. Request for remodelling of a non-conforming sign by Mich ael Davis a t 204 Texas Avenue: The existing s t ructure is less than 10 feet fFom the r ight-of-way. The owner proposes to change copy (which would not ordi- n arily require a permit) and to make a structural alt erat ion by removing lighting. Photographs by the owner s ho~in g s ight dis t ances ~ill be avail- able a t the meeting. 5. Request for variance from Wickes Lumber Company at 101 West Loop: The owner has applied for a building permit to add to an existing storage building after having completed the construction. The existing building may have been the result of a variance, as the orig- . i na l permit shows a reduced setback to the side property l~ne and bears a no t e indicating that the City imposed a screen fence restriction. There is no record of a variance in the Council minutes but this is not uncommon. It appears that the Board has the alternatives of permitting the construction that has been done, or refusing to grant the permit whereupon we will order the s t ructure to be r em oved. Mrs. Ringer presented the application for variance and added that the proposed addition would not protrude toward the rear as far as does the existing structure. An adjoining neighbor, pointed out that there would remain at least 100 feet between structures in the block. Weiss observed that the alley was not in use by the City. Mr. Ferrari presented his application and explained that he proposed to add a linen room to his existing laundry room. He pointed out that there had never been an access to Meadowland street through the site of the proposed addition. Weiss observed that about 3/4 of the distance along Meadowland is occupied by buildings in the same alignment and that this structure would have no effect on the life of the non-conforming structures. If the reguested variance is not granted, an undue hardship would be imposed on the owner and his sons who will occupy the · house. Thus, the aesthetic quality woyld be lessened. Also, there are many buildings on Tex as Avenue that are mu~h closer to the h~ghway than this garage will be. Indeed, th e position of-.the house is a variance to the present code.
