If some u ni que circumstance renders a full d esign imp_ractical, and if
th e Board conse nts, th e app e al ma y b e b ased on a dec ision rendered in writing
by t he Building Official in reply to the applicant's ~ritten inquiry as to the
effect o f a particular zoning requir eme nt on a proposed plan. A complete
~ppli cati on for variance mu s t also be filed along with any drawings or data
n ecessiry to show the nature and e x tent of the varianc~.
(2) There will be no item pla ced o n the Board agenda nor any notice
published until all of th e materials mentioned above are complete and in
hand. He provide no materials to the Board in support of a variance except
that which we rec eive from t he applicant and can reproduce in-house (8 1/2 x
14 max size, line work).

(a ) Th e building dep ar tment will fill in the date of the hearing
and the dat e of notification.
(b) The applicant will fill o u t th e rest of the . fonn.
(~) Owners within 200 feet may be determined by scale from the
1"=100 1 scale st r eet ma p series on file in our office.-··-
Owne rs whose p ro p er ty in any part falls within the 200 foot
distance should b e listed. Measurement starts from the
prop e rty line o f the lot or tract in qu es tion, or, if the
tra ct is bound ed by a street, from the opposite side of the
street.
(d) The names and addresses must be as they appear on City tax
rolls, even if they are wrong or out of date.

The building dep ar tment will assist you in finding the zoning
of the tract, identifying the section of the ordinance and
specifying the v a riation.
The remaining three section address themselves to the three
findings that the Board must make in order to grant a variance.
If the Board cannot agree with any one of these, they will not
be able to grant the variance.
The application will be sent to the Building Official, City
Engineer and Fire Marshal for cormnent on any _facts within their
knowledge which may bear on the case.
(5) Xotice of the h earing will b e published on the Wednesday preceeding
the oee ti ng and will b e maile d by th e building department to the owners
with in 200 feet. The complete application must be received by the close
of busine ss on the Monday preceeding the date of publication in order for us
to mee t th e p ublisher's d e adline.
(6) Should 2ny person desire to appea l a decision or ··che Board, he should
so st a te after the conclusion ·of th~ h ea ring. The chairman will complete
his statement of findings wl1ich will constitute filing of the deci si on.
Minutes of the meeting, subject to approval of the Board, will be peep .ace d
by the close of bu s iness on the following day. A duplicate tape of th e
pro ceedings will be made available to the appellant's attorney upo n request
and up on receipt of co mp e nsation foe th e 120 minute cassettes used for the
duplication. No transc ript is made of the hearings. Minutes o f the pro-
ceedings ace paraphrased as appropriate , in the judgement of the r~cocder,
to reflect points of the discussion pertinent to the decisions rendered .

2. Locate elsewhere on the site which will decrease parking and manuevering
areas.
This variance vtlll not be contrary to the public interest by virtue of the following
facts: 1. There is vehicular access to the rear of the structure from and adjoining
30' street.
2 . The structure will not interefere with ahy utility.
3. Existing buildings on site are in the same alignment and this addition will have
