MEMORANDUM
TO : Zoning Board of Adjustment
FROM : Building Official
SUBJECT : Appeal , 1524 Wolf Run
1 . Copies of all correspondence and notices in thi s case are in-
cluded in your agenda packet . The documents submitted for approval
of the original development plans are on f ile in the Planning Depart-
ment and will be available at the night of the meeting . Permitted
land u se within a Planned Unit Dev elopment i s defined by these approved
plans .
2 . The order of September 27 , 1977 required :immediate cessation of
connnercial operations , which was the act which constituted violation .
A time was allowed to perform the related tasks of removal of equip-
ment . These requirements wer e judged to be r easonable in the light
of the nature of the violative activity wh ich presented no physical
bar to it s :immediate suspen s ion, and the ordinance requirement that
violations cease "forewith11 •
An example of a contrary c ase would be a violation of the ordinance
ari sing from the existence of a structure , and in such a case ,
enou gh time would be allowed to remove the structure, assuming dili-
gent and :immediate execution of the work on the part of the violator .
3 . The appellant requests oh e 11 exception11 to continue the business .
It appear s to this offic e that such an excepti on wo uld be a variance
to the land use provisi ons of the ordinance , which i s not defined by
the ordinance as a requirement to which variance may be granted .
The appellant contend s that enforc ement of thi s provi sion will result
in hard ship . Thi s office cannot concur, in that all fea s ible use
of the property is not ~ost by thi s enforc ement action; the appellant
may continue to use the property for residential purposes as
was done prior to the time the violation occurred. While the
immediate suspension of business will no doubt work a hardship
in terms of loss of business which might have been had by contin-
ued violation, this is a self-created hardship outside of that
which the ordinance accomodates .
This office cannot concur that the intent of the ordinance i s
to allow any land use in residential districts which i s not
compatible with residential use for any length of time .

Village is b e i ng used for purposes other than the residence of
a single family. Th e lot and subdivision are in a Planned Unit
Development District, and Lot 13, Block 1 was designated
exclusively for occupancy of a single family and no corrnnercial
or home occup a tion use is permitted.
You must cease all connnercial operations forthwith and
remove all equipment, furnishings and employees not required
for the hou s ekeeping activities of the members of one resident
family by not later than 8:00 A.M. Monday, October 3, 1977.
Employees on the premises between this date and Oc.tober 3, 1977

for the housekeeping activities of the members of one resident
family by not later than 8:00 A.M. Monday, October 3, 1977.
Employees on the premises between this date and October 3, 1977
may engage in the removal of equipment as stated above,
Any failure on your part to comply with this order will
subject both you and the responsible owner of the property
to charges of violation of the Zoning Ordinance, Ordinance No .
850, and each day such violation is allowed to continue is a

Pursuant to the conversation between Mr . Bill Koehler and our attorneys,
Armogida and Hyde, today, we request a copy of Ordnance 850. Enclosed
is our check in the amount of $2 .00 to cover this fee.
The property located at 1524 Wolf Run was not purchased for business
purposes, but because of special conditions which arose with our
contract at Texas A&M University, our office equipment and certain
personnel were temporarily moved to that address while we attempt
to locate suitable space elsewhere . We are, therefore, asking an
exception to continue under these circumstances until we have an
opportunity to re-locate . A literal enforcement of the provisions
of the ordnance will result in unnecessary hardship upon the company
and the spirit of the ordnance is not, in our opinion, being violated
since the move is merely temporary and has and will continue for only
a brief period of time .
Please forward copies of notices sent concerning this appeal to me

1 . Copies of all correspondence and notices in this ca se are in-

Planning Department and will be availabl e at the night of the
meeting . Permitted land use within a Planned Unit Develop-
ment is defin ed by these approved plans .
2 . The order of September 27 , 1977 required iimnediate cessation
of cormnercial operations, which was the a ct which constituted
violation. A time was allowed to perform the related tasks
of removal of equipment . These requirements were judged to
be reasonable in the light of the nature of the violative
activity which presented no physical bar to its immediate
suspension , a..r1d the ordinance requir·ement that violati ons
cease 11 forthwith".
An example of a contr.:i.ry case would be a violation of the
ordinance arising f r om the existence of a structure, and
in such a case , enough time would be allowed to remove the
struct"Ure , assmning diligent and :iJTJmediate execution of the
work on the pa.rt of the violator .
3 . The appellant requests one t1exc eptiont1 to continue the
business . It appears to thi s office that such an exception
would be a varianc e to the land use provision s of the ordi-
nance , which i s not de:r.ined by the ordinance as a require-
IGent to which variance may be granted .
The appellant contends t hat enforc emen t of thi s provi s ion
will re sult in hardship . This office cannot concur , in that
all fea s ible use of the prop erty i s not l ost by thi s enforce-
me nt a ction ; the appellant may continue to u se the proper ty
for r esidenti al purpo ses as was don e prior to th e t i.me the
violation occurr ed . Wh ile the immediate suspensi on of busi-
ness will no doubt work a hardship in terms of los s of busi -
n ess which might have been had by conti nued viola tion , this
i s a self-created hard ship outsi de of that which the ordinance
accomodates .
Thi s offi ce cannot concur that the intent of the ordinance
i s to allow any land u se in residential districts wh i ch is not
c ompat i ble with residential use for any l ength of t ime .
