a spectacular s i gn to be placed l ess t:h a n 15 feet above ground and that
the sign conformed in all o t her respects to the ordinan e r equirements .
Vir . Martin said that the sign would be 80 ft . from the street and 13 ft .
eig'.1t i nches above ground . He said that the hei g!-J.t of the build ing was
a l imi t , c.::'-eating an unusual circums t ance , that the existing sign was
not effectiv'?.! al'ter dm·k creati ng hardships , ani that i t would be in
the public interest to a llow the sig~ to be low enough t o be masked
from residential areas by t he building .
Ar . Wes Harper examined the plans and p il.o tog.r aplrn and stated that i t was
n ot objectionable to him.

SUBJ ECT : Appeal , 1524 Wolf Run
1. Co pie s of all correspondence and notices in this ca se are in-
cluded in your agenda packet . The documents submitted for approval
of th e original development plans are on file in the Planning Depart-
ment a.rJ.d will be available at the night of the meeti ng. Permitted
land use within a Planned Unit Development is defined by these approved
plans .
2. The order of September 27 , 1977 required i mmediate cessation of
c ommercial operations , which was the act wh ich constituted violation.
A time was allowed to perform the related tasks of removal of equip-
ment . These r equirements we:ro j udged to be reasonable in the light
of the nature of the violative ac tivity which presented no physical
bar to it s immediate suspension, and the ordinance requirement that
violations cease Hforewith 11 •
An exallple of a contrary cas e wouJ.d be a violation of the ordinance
aris i ng fr om the existence of a structur e , and in such a case,
enough time would be allowed to remove the structure, assuming dili-
gent and i mme diate execution of.the work on th e part of the violator.
3. The appellant requests on e 11 exception11 to continue the business .
It appears to tnis office that such an exception would be a variar1ce
to the land use provisions of the ordinance , which is not defined by
the ordinance as a requiremen t to which variance may be granted .
The appellant contends that enforcement of thi s provision will result
in h ardship . This office cannot concur, in that all f easible use
of the property is not _Lo s t by this enforcement action; the appellant
may co:ninue to use the property for residential purposes as
was clone prior t o the time the violation occurred. lfoile the
:irr,::ediate suspension of business will no doubt work a hardship
-i n terms of loss of business which might have been had by contin-
ued violation , this is a self-created hardshi p outside of that
which the ordinance accomodates .
This office cnnnot concur that the intent of the ordinance i s
to allow any land use in residential distri cts i;hich is not
c om.p atible with residential use for any l ength of time .

1 . The applicant requests a variance t o the limit of one
detached sign per building plot in order to install
a sign marking his parkin.g lot entrance on University
Drive . Th ere is an existing sign marking this entrance
which would have been a non-conf orrning use except that
i t i s on the ri gh t-of-way . We must require him to
remove i t from the right-of-way in ord er to comply with
the Traffi c Code , and he cannot move i t back without
t his variance .
2 . A scale sketch of the site is attached. This entrance
i s the only on e which can b e entered by northbound
Texa s Avenu e traffic without ju10ping a median , and I
would agree with the appli cant that i t would be i n t he
pub.Lie intere s t to encourage i ts use by appropri ate
marking . A photo graph of t he existin g s i gn will b e
avai lable at the meeting.

I f some unique circumstance renders a full design impractical~ and if
the B:::ia:-d consents, the appeal may be based on a decision rende.red in writing
by the Building Official in reply to the applic.:mt' s i.iritten inquiry as to the
effect of a particular zoning requirement on a proposed plan. A complete
~pplication for variance raust also be filed along with any drawings or da~a
necessary to sho~J the nature and extent of the variance\
(2) There will be no item placed on the Board agenda nor any notice
published until all of the materials mentioned above are complete and in
hand. We provide no materials to the Board in support of a variance except
that which we receive from the applicant and can reproduce in-house (8 1/2 x
14 max size, line work).

(a) The building department will fill in the dat:e of the hearing
and the date of notification.
(b) The applicant will fill out the rest of the .fonn.
(c) Owners within 200 feet may be determined b:># scale frorn the
1"=100' scale street map series on file in ou_r .office.-·-
o,,ners whose property in any part falls within the 200 foot
distance should be listed. Measurement starts from the
property line of the lot or tract in question, or, if the
tract is bounded by a street, from the opposite side of the
street.
(d) The names and addresses must be as they appear on City cax
rolls, even if they are wrong or out of date.

(a) The building department will assist you in finding the zoning
of the tract, identifying the section of the ordinance. and .
specifying the variation.
(b) The remaining three section address themselves to the three
findings that the Board I!tust make in order to grant a variance.
If the Board cannot agree with any one of these,. they will not
be a ble to grant the variance.
(c) The application will be sent to the Building Official, City
Engineer and Fire :Marshal for comment on any _facts within their
kno~ledge which nay bear on the case.
(5) ~otice of the hearing will be published on the Wednesday preceeding
the m~eting and will be IBailed by the building department to the owners
within 200 feet. The complete application must be received by the close
of busi~ess on the Monday preceeding the date of publication in order for us
to meet the p~blisher's deadline.
(6) Should 2ny person desire to appeal a decisi~n of-·the Bonrd~ h~ should
so st2te o.fter the conclusion ·of the hearing. 'Ihe chairman will comt>lete
