facts of the case being as follows :
The applicant requests a variance from the siffe setback

PR OCE DURE FOR FILING A REQUES T FOR VARIANC E
(1) In order for the Bo a rd t o c on s id e r a cas e , th e r e must be on fil e a
co mplete a pplication for a building permit which h a s b ee n r e jec ted by the
Building Official and a c ompleted "R e quest for Varian c e" application.
I f some unique cir c umstance renders a full design impr a ctical, and if
the Board consents, the appeal may be based on a decision rendered in writing
by the Building Official in reply to the applic a nt 's written inquiry as to the
effect of a particular zoning requirement on a proposed plan. A complete
application for varianc e must also be filed along with any drawings or data
I nece s sary to show the nature and e x tent of the variance·.
(2) There will be no it em pla ced on the Board agenda nor any notice
published until all of the materials mentioned above are complete and in
hand. We provide no materials to the Board in support of a variance except
that which we receive from the applicant and can reproduce in-house (8 1 /2 x
14 max size, line work).

(a) The building department will fill in th e date of the hearing
and the date of notification.
(b) The applicant will fill out the rest of the form.
(c) Owners within 200 f e et ma y be d e termined by scale from the
1 "=100 ' scale street map series on file in our office.
Owners whose prop e rty in any part falls within th e 200 f oot
distance should be listed . Measurement starts from the
property line o f the lot or trac t in question, or, if the
tract is bounded by a street, from the opposite side of the
street.
(d) The names and addresses must be as they appear on City ·tax
rolls , even if they are wrong or out of date .

(a) The building department will assist you in finding the zoning
of the tract , identifying the section of the ordinance and
specifying the variation .
(b) The remaining thr e e section address themselves to the three
findings that the Board must make in order to grant a variance.
If the Board cannot agree with any one of these, they will not
be able to grant the variance .
(c) The application will be sent to th e Building Official, City
Engineer and Fire Marshal for comment on any facts within their
knowledge which may b e ar on the case.
(5) Notice of the hearing will be published on the We dnesday preceeding
the meeting and will be mailed by the building department to the owners
within 200 feet . The complete application must b e received by the close
of busine ss on the Monday preceeding the date of publication in order for us
to meet the publisher 's deadline .
(6) Should any person d es ire to a pp e al a decision of the Board, he should
so state a fte~ the conclusion ·of th~ hearing . The chairma n will complete
•
his statement of findings which will constitute filing of the decision.
Minutes of the meeting, subject to approval of the Board, will be prepared
by the close of business on the following day. A duplicate tape of the
proceedings will be made available to the appellant 's attorney upon request
and upon receipt of compensation for the 120 minute cassettes used for the
duplication. No transcript is made of the hearings . Minutes of the pro-
ceedings are paraphrased as appropriate, in the judgement of the recorder,
t o reflect points of the discussion pertinent to the decisions rendered .

I am in the pro cess of constructing a 614 sq. ft. garage. I looked at the enclosed plot
pJa:tJ. and thonght that ths lot was 100' sq, ft, wide when in fact it iES onl:y 95' ~±de-.
I applied for a building permit and assumed. that when receipt #6693 for permit #56 53

close to the property line. I have checked with my neighbors and they agree that
t he position it is in now will be the visibly desirable ta the appearance of th e
neighborhood as a whole. They have no objections whatsoever.
The follmriY'g alternatives to the requested varia.'fJ.ce are pos sible : To add ?-!ft_. to
existing slab wh ich would leave ?tft. sticking out on one side. Th is would de tra ct
from the appearance of the neighborhood as a whole. My-immediate neighborhood would
object to this alternative. (2) The slab could be broken up and repoured at a cost
of $150 .0b(which I can not afford).
