Koehler Building Official ZONIN G BDA H.D OF AD J USTMENT PROCE DURE FOR FILING A REQUEST FOR VARIA NCE (1) In order fo r the Board to conside r a case , th e re must b e on fil e a complete app lication for a building permit which h a s b een rejected by the Building Official and a completed "Request for Variance" application . If some unique circumstance renders a full design impractical, and if the Board consents, the appeal may b e b ased on a decision rendered in writing by the Building Official in reply to the applicant 's written inquiry as to the effect of a particular zoning requirement on a proposed pla n. A complete application for varianc e must also be filed along wi th any drawings or d ata necessary to show the nature and extent of the v aria nc~. (2) There will b e no item placed on the Board agenda nor any notice published until all o f t he materials mentioned above are complete and in hand. We provide no materials to the Board in support of a variance except th a t which we receive from th e applicant and c~n reproduce in-house (8 1/2 x 14 max size, line work). (3) Application; page (1) (a) The building d e p artmen t will fill in the date of the hearing and the date of notifi cat ion. (b) The applicant will f ill out the rest of the form. (c ) Owners within 200 feet may be determined by scale from the ·1"~100 ' -scale street map series on file in our office. Owners whose property in any part falls within the 200 foot distance should be listed . Measurement starts from the property line of the lot or trac t in qu estion , or, if the tract is bound e d by a street, from the opposite side of the street . (d) The names and addresses must be as they appear on City tax rolls , even if th ey are wrong or out of date. (4) Application; page (2) (a) The building department will assist you in finding th e zoning of the tract, identifying the section of the ordinance and specifying the variation. (b) The remaining three section address themselves to the three findings that the Board must make in ord er to grant a variance. If the Board cannot agree with any one of these, they will not be able to grant the variance. (c) The application will be sent to the Building Officia l, City Engineer and Fire Marshal for comment on any facts within their knowledge which may bear on the case . (5) Notice of the hearing will be published on the Wednesday preceeding the meeting and will be mailed by the building department to the owners within 200 feet. The complete applica tion must be received by the close of busines s on the Monday preceeding the date of publication in order for us to meet the publisher 's deadline. (6) Should any person desire to appeal a decision o f the Board, he s houl d so state after the conclusion of the hearing. Tl1 e chairman will complete ,( his statement of findings which will constitute filing of the decision. Minutes of the meeting, subject to approval of the Board, will be prepared by the close of business on the following day . A duplicate tape of the proceedings will be made available to the appellant's attorney upon request and upon receipt of compensation for the 120 minute cassettes used for the duplication. No transcript is made of the hearings . Ordinance No. 850 Zoning Ordinance Page 42 (b) The enlargement of a building devoted to a nonconforming use where such extension is necessary and incidental to the existing use of such building and does not -increase the area of the building devoted to a nonconforming use more than twenty-five per cent (25 %) and does not prolong the life of the nonconforming use or prevent a re- turn of such property to a conforming use, S7T(U C TUR,£(c) The reconstruction of a nonconforming structure or building on the lot or tract occupied by such building if the cost of reconstruction is less than sixty per cent (60 %) of the appraised value of the structure or building and if the reconstruction would not pre- vent the return of such property to a conforming use or increase the nonconformity of such nonconforming structure or building; 11-B. 4. To initiate on its motion, or cause to be presented by interested property owners, action to bring about the discontinuance of a nonconforming structure under any plan whereby full value of the structure can be amortized within a definite period of time, taking into consideration the general character of the neighborhood and the necessity for all property to conform to the regulations of this ordinance; 11-B. 5. To authorize upon appeal variances of the yard, lot width, lot depth, signs, minimum setback, off-street parking or off-street loading regulations from the terms of this ordinance as will not be contrary to the public interest, where owing to unique and special conditions of the land not normally found in like districts a strict enforce- ment of the provisions of the ordinance by the Building Official would result in unnecessary harqship, and so that the spirit of this ordinance shall be observed and substantial justice done. 11-C ORGANIZATION OF THE BOARD: The Board of Adjustment shall consist of five (5) members who are residents of the City and qualified voters. Each shall be appointed for a term of two (2) years, except that two (2) members appointed initially shall have terms of only one (1) year. After the initial appointments, two (2) members and a chair- man shall be appointed in even numbered years, and two (2) members shall be appointed in odd numbered years to maintain a membership of five (5) members. Members shall be removable for cause by the City Council upon written charges and after a public hearing. Vacancies shall be filled for the unexpired term of any member whose term becomes vacant. However, the City Council may provide for the appointment of four (4) alternate members of the Board of Adjustment who shall serve in the absence of one (1) or more regular members when requested to do so by the Mayor. All cases to be heard by the Board of Adjustment will always be heard by a minimum number of four (4) members. These alternate members, when appointed, shall serve for the same period as the regular members and any vacancies shall be filled in the same manner and shall be subject to removal as the regular members. 11-D RULES AND REGULATIONS: The Board shall develop and adopt rules in accordance with the provisions of this ordinance. Meetings of the Board shall be held at the call of the Chairman and at such other times as the Board may determine.
