(1 ) Item 2 --Mr-. Whitaker's employees poured a garage
slab approximately one foot from the property line
rather than the ?t' required by the ordinance. They
apparently di d not know that the permit had not bee~ issued
or tha t they were supposed to have called for a slab
steel inspection prior to the pour . The location was
discovered on a pre-permit i n spection which we make
before issuing a remodelling or add i t i on permit .
The Building Department would have no objection to
leaving the slab in place and off setti ng the superstruc-
ture to clear the 7i' building line . We do not rega rd
the slab steel as being criti cal for a garage and would
be wi lling to assume that it was placed correctly.
Should the Bo a rd grant the variance a s requested , the
adjacent ne i ghbor would be r e quired to maintain a 15
foot clea rance to any future structure on his property.
(2 ) Item 3 --Dr . Crenshaw desires to move an existing house
from Peyton Street to Banks Street. The lot on Banks St.
is 85 feet deep rather than 100 feet as the ordi nance
requires . Th e lot is bounded by public streets front
and rear, so it is unlikely that it could ever be changed
in the future.
The structure itself has been inspected and found to be sound
and adequate.
Dr . Crenshaw proposes to move the structure a nd add a garage.
The garage as proposed, would have to overlap the rear building
line . As an a lternat e , Dr. Crenshaw would be willing to delete
the garage, but he feels that this would needlessly detract from
the usability of the house and lot.

Approval of the minutes of the meeting of
Hughey moved that the minutes be approved as read. The motion was
seconded by Runnels and unanimously approved .
Agenda Item No . 2 The Board agreed to defer this item .
Agenda Item No . 3 Consideration of a request for variance from
W.E. Crenshaw at 614 Banks Street .
Building Offi c i al Koehler explai ned the nature o f the request.
Mr-. Van Thomps on stated that in his opi nion the l ot was t oo small
a nd the p l acement of the house to be constructed was n ot out of
keeping wi th the present housing in the area. Mr's . Greer said that
she would prefer that the neighborhood stay like it was . Mr . Hughey
pointed out that the single family residence was the least restrictive
use allowed in any zone in Co l lege Station . Mrs. Storts poi nted out
t hat the city c ould not require the land to stay vacant . Hughey
moved that the var iance i n regard to the minimum. lot d epth be granted
for the hous e but that no vari ance be granted t o the setback provisions
for the gara ge . The mot i on was seconded by Storts and unanimously
approved .
Agenda Item No. 2 --Consideration of a request for variance from
Charles E. Whitaker at 1006 Rose Circle .
Koehler explai ned the nature of the request and pointed out that
there had been some confusion c oncerning the issuance of the permit .
Mr . Whitaker explained that he had been unaware of the difference
between a r eceipt for permit fees and the ac t ual building permit
itself, and that he had not been cogni zant of the exact l o cation of
the property line or the requirement f or a 7t f oot setback or the
requirement of a slab steel inspection before the pour . Mr. Jim
Luscombe , the adjoining neighbor, sta ted that he would agree to
refrain from building anything on his property within 15 ft. and
encouraged the board to allow the appli cant t o finish the building he
has started. Koehler stated that he could see no physical problem f or
the city with the building completed as it had been started near the
property line .

Chairman We i ss po inted out that one of the i ssues t o be considered
by the Board was t hat of the characteri stics of the n e ighborhood
and wheth er or no t the Board would accomplish the ends of the
ordinance by grant ing the variance. Mr'. Whitaker stated that he
wo uld be able to offset the building by 7t ft . on the slab but t hat
this wou ld penali ze the remainder o f the neighborhood by the unsightly
appearance of the co n crete slab pro trudi ng from the building. Hughey
moved tha t the varianc e be granted to allow the building to be com pleted
as the slab was now situated . The motion was seconded by Runnels and
unanimously a pprove d.
Ag enda I tem No . 4 --Other Bu siness
The Board considered t he procedures for is suing r emode ling permits and
rev iewed the materi als that are given or presented t o the permit
app licant at the t ime the permit is applied fo r. The Board suggested
that the following steps be taken to prevent t his type of misunderstanding
in the future:
1. :Make clear to a homeowner's permit applicant the difference between
a receipt for fees and a building permit.
2. Question the applicant for homeowner's permit to be cert ain that
he is familiar with the rules and ordinances which would be the
mos t likely source of confusion and misunderstanding.
J. Generate a packet or a sheet of information for a homeowner's
permit applicant which would explain the most commonly
misunders t ood or v iolated requirements of ordinances r egula ting
constructi on .

Ringer moved that the mee t ing be adjourned. The mo t ion was
seconded by Weiss and unanimously approved ..
