MEMORANDUM
TO: Zoning Board of Adjustment
FROM: Jim Callaway, Zoning Official
SUBJECT: Expansion of a non-conforming use -203 Fairview St.
The request before the Board is to allow the expansion of an existing
duplex in a single-family zone. The construction of the expansion has
been initiated by the applicant. The Building Department has issued a
Stop Work notice and the owner has applied for all necessary permits so
as to be able to co mpl e te th e construction.
I have insp e cted thi s prop e rty with representatives of the Building
Dep a rtment and hav e found it to be a dupl e x, with two separate living
units with separate utility me ters. I cannot verify the original
int e rior !ayouts of the t wo units because of the stage of construction.
Th e portion of the p e rmit r e qu e st that requir e s action by the Board is
the enclosure of th e front porch, which increases the floor area of the
non-conforming structure. This expansion is less than the 25 % limit
established by the ordinance. Unl e ss additional information is brought
forward at th e m·eeting, there should be no problem with granting the request
if the Board is so inclined.
This requ e st was not submitted in time for consideration at the regularly
sch e duled meeting. We have asked the Board to meet to resolve this issue
in a timely matter becau s e of the status of the stop-work notice and the
need to issu e th e necessary pe rmits or initiate p ro ceedi~QS in Municipal
Court.

STAFF PRESENT: Zoning Official, Calloway ; Planning Assistants, K,ee and Longley
AGENDA ITEM NO. 1 -Consideration of a r eq uest for the expansion of a non-conf o rming
use in the name of Johnny A. Ma rtinez, 2 03 Fairview Street.
Zoning Official Calloway present ed backg round information concerning the construction
which had beenoccurring witho ut a permit .at the a bove address . A stop work order was
issued and Mr. Martinez was notified of the necessity of ac quiring a building permit
and th a t the Zoning Board of Adjustment would need to authorize the permit sinc e
Mr. Ma rti nez was expanding a non-conf o rming use. The Building Offi c ial informed
Mr. Ca llaway th at the structure is a ctually a r es ide nce with a separate living unit
attached in the rear. Th e structure is in an R-1, s ing le family zone.
Mr. Callaway inf ormed the Board that Mr . Ma rtinez 's request involve d changing th e
interior layout of the structure which would result in two living unit s of app ro xi -
mately eq u al size and enclosing the front porch .
Mat hewson asked about th e ge n eral c haract e r of the nei ghborhoo d. The Board discussed
that th e a rea is largely a single family neighborhood east of Fairview W:tth smaller
rental units a nd non-conforming uses along portions of Fairview and west of Fairview.
Elizabeth Ma rtinez, representing the applicant, explained the reques t. She informed
the Board that the structure was a duple x whe n Mr. Martinez purchased it and that it
needed repair.
Upham stated that the situation appears to be an attempt to go from essentially a
single residence wi th a minimal possibility of being called a duplex to a formal
duplex situation. He stated that the Board's mandate is to try to avoid perpetuating
a situation which is out of phase with th e City 's Plan.
Burke questioned if the aim of the Plan is to bring this a rea back into a single
family area.
Ma thewson asked if a n y one called to object to th e req u est a nd Call away replied that
no one had o bj ected .
Ma thewson moved that the request for a va ria nc e o n th e property located a t 2 03 Fairview
Stree t be grant ed on the g round s tha t the g r an ting of th e va riance wo u ld not represent
a threat to the heal th, we l fare and morals of the citizens of Coll ege Statio n.

Upham st a t e d that thi s is the first case of thi s n a ture for this area to come before
th e Board and th e Board should realiz e that a pr e c e dent will be set if it grants
thi s v a ria nc e . This area will be receiving th e Boa rd's s e al of approval to go from
a basically single famil y are a to a duplex area.
Wagner a s ked for an int e rpretation of Section 4-1.3 . of Ordinanc e 850 referring to
the 25 % limit on enla rgement of a non-conforming use . Does this include r e arrang ement
of interior spac e ?
Callaway r e sponded that the St a ff had discuss e d this issu e and i s looking to the
Board to resolve this point .
Mathewson stated that the Board had, in a previous case, set a precedent that i f any
part of a structure is non-conforming then the entire structure and its associated
structures on the lot are non-conforming .
Callaway explained that in the same case the Board established a policy that in
future cases non-conformities of the t y pe where there is a detached structure, then
the principal structure, in residential cases, would not have to come to the Board .
The Board agreed .
Burke stated that in her opinion, e nlarg e ment is an addition or an increase in the
size of a structure . Wagn e r a greed.
Callaway pointed out tha t a k e y point is whether this proposal will p r o long the life
o f the non-conformity a s stated in S e ction 11-B.3.b. of the ordinanc e .
Uphan st a ted that th e intent of Ordinance 850 is fundamentall y in opposition to this
request .
After further discus s ion, the question wa s call e d.
The motion failed b y the following vote :
Against -Burke, Upham, Wagner, Boughton.
Callaway asked the Board if they would like to consider the enclosure of the porch
separately as it falls below the 25 % expansion limit outlined in Sections 4-C .3 and
11-B.3 of the Ordinance .
Mathewson moved that the variance be granted to property located at 203 Fairview
Street for the purpose of enclosing the screen p o rch with a permanent wall and that
this would not represent a risk to the health, welfare, or morals of the Citizens
of College Station. (Mathewson clarified that this motion involves only the porch
and not the interior design or use).
