(2) The complete appli~ation must b e rec eived by the Zoning Official no later than noon on the Friday preceeding the publicg.tion date. (7) The application must be reviewed by the Zoning Official before it can be considered completed and filed. Notice will be given to the applicant as to this consideration. (8) It is the responsibility of the applicant to complete all phases of the application filing and to check to be sure his application is considered complete by the Zoning Official. (9) The applicant will be notified as to the date the application will be considered by certified mail. There will be no other reminders of the meeting, other than when the applicant phones the office. (10) Notice of the hearing will be published on the Wednesday preceeding the meeting and will be mailed by the office of the Zoning Official to the owners within 200 feet and the applicant. The complete application must be received by noon on the Friday preceeding the date of publication in order for us to meet the publisher's deadline. (11) Should any person desire to appeal a decision of the Board, he should so state after the conclusion of the hearing. The chairman will complete his statement of findings which will constitute filing of the decision. Minutes of the meeting, subject to approval of the Board, will be prepared by the close of business on the following day. A duplicate tape of the proceedings will be made available to the appellant's attorney upon request and upon receipt of compensation for the 140 minute cassettes used for the duplication. I No transcript is made of the hearings. Ninutes of the proceedings are para- phrased as appropriate, in the judgement of the recorder, to reflect points of the discussion pertinent to the decisions rendered. Date: August 6, 1982 On behalf of Broach Oil Company I respectfully request your variance authorization on the following specific items: 1 . Section 6-G.l. (25' front yard with 6' overhang of canopy into front yard). Requested justification: The existing first pump island is approxi- mately 14'-0" from front property line to edge of pump curb and 16' from property line to centerline of canopy columns. 2. Section 6-G.3 To move the canopy foundation, pumps and islands would be of considerable cost. We request authorization to leave the pump islands and canopy columns in their present location with authorization to improve the canopy provided it meets the building code and does not infringe on the front yard setback any further than existing. (7.5 foot side yard) Requested justification: The existing building on the west elevation is approximately 3'-3" from the common property line. The existing wall is con- crete block without windows. The roof is Class 'A' on heavy timber construction which apparently was permitted when the structure was built. Modifications to bring the construction back an additional 3'-3" would be prohibitive. 4103 S. Section 8-D.6 and 8-D.9 (sign ordinance) Requested justification: The Shell sign has been in existence on the corner since the station was built. The sign does not block view at the inter- section. 4. Section 4,C.3 The removal of the sign will cause an economical hardship and absence of easy identity. (25% ffi{pansion of non-conforming use) Requested justification: The existing site and building is obvi- ously well suited for its intended use however, trends in the customer's conve- niences and economic consideration require additional space. The existing building has 1662.28 square feet and under Section 4,C.3 we request the non-conforming building be authorized with an additional 406 square feet of new construction.
