Willis at their called meeting in the Council Room of the College Station City Hall at 7:30 P.M. on Tuesday, August 10, 1976, the facts of the case being as follows: The applicant requests a variance from the rear setback requirements of the Zoning Ordinance in order to construct a residence on his property at 804 Thomas St., Lot 3, Block 3, South- east College Park. ' August 5, 1976 MEMORANDUM TO: FROM: SUBJECT: j _, CITY OF COLLEGE STATION POST OFFICE BOX 9960 11 01 TEXAS AVENUE COLLEGE STATION, TEXAS 77840 Zoning Board of Adjustment Building Official ,!,fl~ Meeting of August 10, 1976 Agenda Item 2: Mr. Willis bought this lot without being aware that there was a storm sewer constructed on it. We cannot find the easement for the sewer on file in the Deed Records, so it appears that Mr. Willis had no way of knowing that his use of the lot would be restricted by the sewer location. There is an alley at the rear of the lot, and setback lines are measured from the edge of the alley. Most of the homes in the area were built under the terms of the old ordinance which would have allowed the setback to be measured from the center of the alley. Mr. Willis asks to be allowed to build up to 20 feet from the edge of the alley. This would cause the house to be 25 feet from the alley center and he would regain the area which was lost to the sewer on the side line. Agenda Item 3: The two Xerox sheets are part of the original plans for the Holiday Mobile Home Park which was constructed prior to annexation. The pads to be built at this time are marked in yellow. I have authorized Mr. Jones to proceed with construction of plumbing at his own risk and without prejudice to this Board's determination. (This is an item which had been scheduled for the July meeting.) Agenda Item 4: Copies of Mr. McCrory's application are enclosed. The survey plat, attached, was submitted by Mr. Steelman on behalf of Mr. Burkhalter, the adjoining neighbor and was done after construction was underway. MEMORANDUM, Zoning Board of Adjustment Page 2 The "single level structure" shown on the plat is an existing structure. The side line clearance problem was not obvious to our inspector when the slab was poured. The plans submitted for permit showed both buildings to have adequate clearance. The original permit plans will be available to you at the meeting. Agemda Item 5: Mr. Landry constructed a duplex on Airline Drive which is the last structure to be built in the block. At the final inspection we found that the dimensions of the parking spaces were less than required by the Zoning Ordinance and refused to issue a certificate of occupancy so that the utilities could be turned on. The contractor and the buyer appeal to the Board and desire that the parking be accepted as is. A majority of the other structures in the block have drives of similar dimensions. They were not detected because final inspections were not made at the time that they were completed, Similar situations exist in West Knoll, Section III. I will ask the City Attorney to be present at this meeting and to be prepared to discuss the options open to the City in dealing with cases arising from refinements of our inspection procedures. TO WHOM IT MAY CONCERN: The Zoning Board of Adjustment of the City of College Station will consider a request from Navajo, Ltd. at their called meeting in the Council Room of the College Station City Hall at 7:30 P.M. on Tuesday, August 10, 1976, the facts of the case being as follows: The applicant requests a permit to expand a nonconforming use by adding four trailer spaces included in the original design but not constructed on their property at 201 West Loop. McCrory at their called meeting in the Council Room of the College Station City Hall at 7:30 P.M. on Tuesday, August 10, 1976, the facts of the case being as follows: The applicant requests a variance from the side setback requirements of the Zoning Ordinance in order to complete construction of an apartment building on his property at 308 Cooner St., Lot 5, Block 3, Cooner Addition. KOEHLER Building Official TO WHOM IT MAY CONCERN: The Zoning Board of Adjustment of the City of College Station will consider an appeal from Larry Landry at thei r called meeting in the Council Room of the College Station City Hall at 7:30 P.M. on Tuesday, August 10, 1976, the facts of the case being as follows: The appellant appeals the refusal of the Building Official to issue a certificate of occupancy for a duplex dwelling unit at 1219 Airline Drive, Lot 5, Block 1, Southwood Valley, Section II.
