I AGENDA ITEM NO. 4: Con s id erat ion of a variance request to Section 8-D.3 Ordinanc e 850 1 imiting the area of a s i gn to 150 square feet. Application i s in the name of Monaco 11, Ltd., dba Aggieland 11 C11 Apartments. Mel Chase, representative of the applicant came forward, identified himself and was sworn in. He gave th e background of the apartments and the existing sign in excess of 180 sq . ft. which replaces 6 non-conforming signs which totalled in excess of 180 sq . ft. wh ich the apartments previously had. (He said they had simply replaced 6 signs with one of equal size). He then expla ined the request citing unique and special conditions wh ich includ ed this exist ing sign not being locat ed in a normal position for a sign to advertise something (it is difficult to see it from a major street). Mr. Upham talked about rules concerning non-conforming uses and the useful 1 ife of a non-conforming sign, plus the fact that the non-conforming detached signs had s inc e been replaced by 2 detached signs. Mr. Chas e pointed out that these signs represented 3 different businesses which have different ownerships, tax numbers, etc. Mr. MacGilvray pointed out the location of th e s i gns on a map on the wall wh ich Mr. Chase had presented at the meeting. Mr. MacGilvray asked what had l ed to any action, and Mr. Upham stated that the sign wh ich had been painted on the building is too large. Mr. Cha se said the sign painter had designed this s i gn to replac e 6 s igns, and that the applicant had believed the painter knew the ordinances. Ownership of the apartments vs. investor s in the apartments was discussed after which Mr. MacG i l vra y interrupted and asked w~at th e request is for. Mrs. Kee pointed out that the r eq uest concerns the sign on the building which is larg er than the ordinance allows, but that staff requests that the Board consid er the 2 detached signs as we ll, because her information from the City Tax Office indicates that al 1 three properties are owned by Callaway Proper- ties. Mr. Chase said that Callaway Properti es had o nl y manage d the properties for 9 months, but is no longer managing them. He added that the books had been changed over on Fe bruar y 6 1983 in the City Tax Offic e. He asked to be al lowed to point out more uniqu e and special conditions citing that the sign could be read from one direction only (not doubl e s ided) and the tax rolls 1 ist the property as zoned both C-1 and R-6, and then he requested clari - fication, because R-6 regulations are being applied to Lots 18, 19 & 20 which are zoned C-1. Mrs. Kee confirmed this, stating that C-1 use allows only one detached sign and is more restrictive than R-6. Mr. Wagner asked if the detached signs are in the Ci ty right- of-way and Mrs. Kee indicated that she bel \eves they are. Mr. MacGilvray asked if there are three signs or one sign which are being considered tonight. Mr. Lindsay requested that any action tonight be 1 imited to the one sign which is 1 isted on the request for variance, that being the sign painted on the brick and masonry wall and would be covered under Ordinance 850 Section 8-0.3. He further stated that the issue is whether that one sign should be allowed to be greater than the allowed 150 square feet in size . Mrs . Kee still requested clarification concerning the two detached signs, and Mr. Lindsay said this should take place at another time when another request for variance, or appeal of a decision is filed. Mr. Upham asked for some kind of proof of separate ownership should these signs come up in the future. Mr. Chase indicat ed that 8 11 of this sign could be sand blast ed fro m the top, and 7 11 from each side, and it would comply but would not be very pretty, or they could go back to more temporary s igns as before citing they had not ceased the u se of the m for 12 months (Ordinance 850 Section 4-D.3. Mrs. Kee passed around pictures of 3 signs advertising 11 Aggi ela nd Apartments 11 , and said there is a question as to whet her these signs are new or non-conforming signs wh ich have been painted and an additional new sign. She sa id the applicant or rather Callaway Prop e rties had been notified in Febr uary that they would be allowed only one sign (for one apartment project), but they apparently decided to refuse to compl y or simply wanted to wait until this request went before the Board. Mrs. Kee furthe r indicated the City received correspondence back in April acknowledging the l etter and referred to "Aggi e land Apartments 11 as 3 apartment comple xes . She exp laine d r l { ZB A Minutes 4-19-83 page 3 that she had me nti o ned in the memo that the application does not refer to the other 2 s igns, but s he i s requesting cl a rification o n them as wel 1. She exp lain ed that the Management is contending that th e 2 sma ll er d e tached signs had only been repainted and the wall sign i s new and was painted on De c em ber 20, 1982. Mr. Upham r e peated an e arli e r r eq ues t to the effect that no deci sio n should be made on anything other than that which is stated in the request for varianc e, which i s one lar ge non-conforming s i g n. Mor e discus s ion fol l owe d after which Mr. L in dsay made a motion to deny a varianc e to the sign (Section 8 -D.3) from the ter ms of thi s ordinanc e as it will be contrary to the pub lic in te r est, due to the lac k of unique and special conditions of th e land not normall y fo und i n like districts a nd beca u se a str ict e n fo rc ement of the p ro- visions of th e ord in a nc e wou ld not result in unn e c ess ary hardship. Mr. Upham seconded the motion which ca rri ed unanimously (4-0). Mr. Cha se indica t ed from the audience that he will want to appeal this, especially con- cerning C-1 a nd R-6 regulations. Mr. MacGilvray informed Mr . Chas e that appeal s of actions of thi s Board s ho uld be taken to a Civil Court. The following information is respectfully submitted for consideration by the Board. It is furnished to more fully explain our answers to the application questions listed below: I. 11 This variance is necessary due to the following unique and special conditions of the land not found in like districts:" • (A) Aggieland 11 C11 Apartments, by virtue of location, is essentially denied public visibility. The 74 apartments, lJ buildings, are located on a blunted pie-shaped tract of 2.78 acres. Yet, for all its size, the blunted end of the tract permits only 192 feet of front street footage. The backside perimeter roughly follows Wolf Pen Creek; this area is streetless and is largely unimproved land. (B) Normal placement of a sign would be fronting on Redmond Drive. Several conditions make this location ineffective: (a) Redmond Drive is a short access street primarily of service only to the apartments on either side. By audit, not to count vehicles belonging to apartment tenants, less than JO vehicles per day use Redmond Drive; (b) The nearest corner of the tract, visible to the more 11 traveled11 street (Texas Avenue), is more than 100 feet away. The largest possible sign if set to face Texas Avenue cannot be seen by traffic as it passes perpe~icularly to Redmond Drive. (MORE) .. Aggieland "C" Apartments Application for variance (Cont'd) Page 2 of 4 Pages (c) Northeast and Southwest the sign is blocked by buildings on both sides; (d) To place our sign at the intersection of Texas Avenue and Redmond Drive, although it is agreeable to the owner of the property, is not allowed by Section 8-D.5. (C) These limitations leave one option --to place the sign on the backside wall of 305 Redmonc!Drive, a building which is removed at that point 188 feet from Texas Avenue. At this nearest viewpoint the sign is only awkwardly visible; it is positioned obliquely perpendicular from the intersection of Texas. Avenue and Harvey Road. It can only be ·seen full-face from a much greater distance (200 to 800 yards) by Northbound traffic on Texas Avenue. It is not seen by Southbound traffic. These visual limitations render the sign less effective than other permitted signs in like districts. (D) In the phrase, "visible from a particular street,11 (Section 8-D.3.), we find basis for the Board to consider the sign's unique characteristics of visibility. As size is relative to the distance from which an object is seen --the sign is less equal to those permitted within 20 feet of curb or pavement edge. Our one option for placement of an entitled sign facing a viable street is at a distance 8 times greater than the allowable limit. And the required distance to view the sign clearly face-on is 30 times the usual and normal limit. The opportunity for readability would be severely compromised if the sign were smaller. (MORE) .• Aggieland 11 c11 Apartments Application for variance (Cont'd) Page J of 4 Pages As to the possibility of a closer viewpoint of the sign: (a) There is no existing sidewalk or pedestrian access; (b) The sign does not face upon any residing tenant's window, balcony, or other residential viewpoint; (c) The public viewpoint from the nearest business location is more than J84 feet away. II. 11 The following alternatives to the requested variance are possible:" (A) To reduce the outer dimensions of the sign. The size would be decreased JJ square feet by sandblasting the outer border 711 on each side and 8 11 top and bottom. This would result in two questions of taste. The background would appear insufficient and the lettering would be graphically imbalanced. This, however, would not effect readability and it would remain an adequate sign. Secondly, the brick surrounding the sign would be bleached-out by the sandblasting; this is likely to result in a 11 halo 11 appearance around the sign. (B) To erect the same lettering without a background bordering. The dimensions of all lettering would equal 82.05 square feet. (C) To resize the bordered sign with smaller lettering. There would be a loss in the ratio of visible sightings; although this might be partially recouped by the use of frequent temporary signs alongside Redmond Drive. III. "This variance will not be contrary to the public interest by virtue of the following facts:" (A) The sign in question is the sole replacement for 6 signs that were recently removed from the premises of Aggieland 11 C11 complex. They were unsightly, in need of maintainance, re-painted and poorly re-lettered. (B) The present sign is less than "spectacular" in that only one color on white was used and it was limited to a minimum of words. There are no moving or projecting parts; no lights were installed.. It was reasoned that plain block lettering, large enough to be quickly readable, would be less likely to arrest the attention of drivers for any undue length of time. (C) In requesting variance and to ?Ilow all possible objections to be heard --we elected to notify every property owner within JOO feet of each apartment complex on Redmond Drive. (D) We have polled owners of adjoining property and have not met with an objection to the sign. In two instances, it was stated that the one sign replacing the six previous, older, signs was an improvement in neighborhood appearances. (E) Improved visibility and appearances of Aggieland "C 11 Apartments will better serve the City of College Station. Visibility and identification are vital if we, as responsible owners, are to maintain parity with the standard of housing provided by apartment complexes in College Station. > • .,, .... . . We are requesting a variance for one sign. It will exceed the usual, but not unprecedented, limit of 150 square feet and will be the only sign serving Aggieland 11 C11 Apartments. The apartments 11 A11 and 11 B 11 have signs of 32 s quare feet each; these have been in service more than ten years and are not new, nor has the position been changed. They were recently repainted to improve appearances. lrour earlier letter represented that our three complexes are not entitled to individual signs. However, the three signs (and more) were originally allowable because the complexes are recorded as individual and separate companies. I am enclosing documents to confi rm this has not changed. As further assurance, please note the following information: 1) Separate tax records are maintained by the City of College Station Tax Office. 2) Individual tax identification numbers are properly filed. 3) All records of ownership are separate and independent. 4) All accounting, bank deposits, and rental ledgers are separate. 5) Investor-owners do not share profit or loss between the complexes. Aggieland is the assumed name under which the businesses are conducted. The separate Registrants are: Monaco I, Ltd ., Monaco II, Ltd., and Posado Del Rey, Ltd. Aggieland is our generic name; the suffix of "A,11 11 B,11 and 11 C," further identifies the separate complexes. Our central office, of course, serves all three companies -not unlike other local management companies who represent more than one apartment complex. I trust this _:!information, historical record, and documentation will explain any question as to the entitlement of three signs.
