reflected in the minutes of the public meeting of and have

specifying the grounds of the illegality. Such petition shall be presented to the
court within ten (10) days after the filing of the decision in the office of the

The meeting was called to order at 7 :02 P .M.
Agenda Item No . 1--Hear Visitors . No one spoke .
Agenda Item No . 2--Develope organizational rules . Mr . Etter moved that the
Board adopt Robe rt 's Rules of Order as their rules of proceedure . The motion
v~s seconded by Ms . Leabo and unanimously approved .
Chairperson Austin stated that Robert 's Rules of Order mentioned that the
chair normally voted in small bodies and that she vould adopt the practice
of voting in all matters .
Agenda Item No . 3--Briefing by staff members . The City Planner revieved
the powers and duties of the Board as expressed in the Zoning Ordinance .
The Director of Public Works discussed building permit proceedures . Mr .
Jones suggested that each action or appeal to the Board should normally
come through some administrative department rather than to be made directly
to the Board or Board members .
City Attorney Levns discussed vnth board members the requirments of
public notice and notice of appeals of decisions of the Bu ilding Official .
The points were discussed that specific notice vias required on cases of
appeal of decisions of the Building Official; that all proceedings of the
Board vere subject to the Open Meetings Law; and that the Board could
determine what notification v~s to be made in variance request cases .
Ms . Leabo felt that the Board should specify who v~s to be notified in
variance cases and suggested that the 200 foot distance specified for
zoning cases might not be adequate . Discussion folloved concerning the
consequences of inadequate notice, the determinB.tion of those to be notified,
the effect of flaws in the application, the method of mailing or delivering
notice , and the ability of the Board to reviei.r its ovn decisions .
The concensus of the Board were : the board should determine vho i s to
be notified on a case by case basis, vnth the Chairperson and the Building
Official making the determination as the request is put on the agenda; that
if the board felt that notice 1,ias inadequate or if a complaint 1,ias made to
the board of inadequate notice, the Board had the prerogative of revie1.i:ing
and affirming, reversing or rescinding its ovn decisions ; that notification
should be by first class mail to the ovner and address of record on the City
Tax Roll ; and that the Board could assume good faith on the part of the
applicant in the correctness of facts submitted by him .

Mr. Jones moved that the Chairperson along vuth City officials determine in
each case vrho is to be notified in order to comply ,.u th paragraph 11 -E.
The motion v78.S seconded by Mr . Etter and unanimously approved.
Ms . Leabo questioned the provision that reque sts-must be acted upon in a
"reasonable time11 • City Attorney Lewis said that 11 reasonable time11 vould
depend on the facts of individual cases and should be decided by the Board
on a case by case basis .
Agenda Item No . 4 --Set meeting dates . Chairperson Austin suggested that,
in viev of the current low number of building permits, the Board set a
regular meeting date and cancel meetings if no business vere presented .
Mr . Jones suggested that a monthly meeting schedule vou ld meet the 30 day
requirements for action of the ordinance . A poll of the members developed
no preference for meeting other than Tuesday, Wednesday or Thursday evenings .
Ms . Austin therefore determined that the Board would meet on call of the
Chair when business v78.S presented . Mr . Jone s vas appointed to pre s ide in
the absence of the Chairperson .
Agenda Item No . 5--0ther Business . Asst . Director of Public Works Ford
pointed out that the developmental control ordinance revie v committee
recently approved by the Council called for one member from the Board to
serve and suggested that a member be appointed . The Chairperson appointed
Ms . Leabo to represent the Board of Adjustment on this committee vi th
Mr . Etter to serve as her alternate .
Chairperson Austin pointed out that a request for a variance had been received
by the Building Official . The City Planner explained that the applicant
desired to build a single family residence vuthin 6t feet of a property line
rather than the ?t feet required, that the applicant ovned the adjacent lot
and had indicated on his application that he intended to construct the next
house st feet off the line in order to maintain the required 15 feet
between structures . Mr . Ford displayed a p.owt ion of the subdivision plat.
Mr . Jones questioned vmy the house size and lot dimen s ions had not been
reconciled by the designer to begin with, and asked ,.mether the construction
v78.S a 11 custom home 11 or a 11 speculative home 11 • No one present could ansFer
these questions. Mr. Dulaney stated that the applicant had told him that
the plans had been approved by the FHA and that they could not be changed
1.uthout re-approval. Mr . Koehler stated that in order for the builder to
convey a portion of the adjoining lot, he wou ld be required to resubdivide
the lots vtlth the approval of the Planning Commission, and that his
alternative to this as to obtain approval of the requested variance .
Ms . Leabo pointed out that to grant this variance vould be to place a
restriction on the adjoining lot vmich could cause complications for a
subsequent o~ner of that lot.
Mr . Jones moved that the Board not act at this time and take up the request
on the next agenda when a representative of the applicant could be pre sent
to resolve the Board 1 s questions. The motion v78.S seconded by Mr . Etter
and unanimously approved .
Mr . Bob Rice came before the Board and stated that he contemplated building a

structure which would require a variance . He questioned whether or not
he must first apply for a building permit. He presented a sketch of his
proposed projec t and a letter addressed to the Building Official. Chair-
person Au stin asked the Building Official if the materials as presented
would be adequate for him to bring this case before the Board . Mr . Dulaney
examined the documents and stated that they wo uld be adequate . Mr . Jones
stated that the Board would not be responsible for approval of the building
permit itself , but would be authorizing the Bu ilding Official to waive a
specific requirement of the zoning ordiance . He suggested that the policy
of the Board should be to act on requests only after the staff had pointed
out the specific provision which the Board was asked to act upon . Mr . Ford
suggested that a standard form of application would clarify proceedure and
should be devised , and the Board concurred . Chairperson Austin determined
that Mr . Rice 's request should be presented to the Board on their next agenda
and that that a meeting date would be set by the Chairperson at a later time .
Agenda Item No . 6--Adjourn . Ms . Leabo moved that the meeting be adjourned .
The mot ion was seconded by Mr . Jones and unanimously approved .

The meeting was called to order at 7:30 P.M.
Agenda Item No. 1 --Approval of the minutes of the meeting of October 15,
1974. The wording of paragraph one, page three, should reflect that the
board concurs that a form should be devised. Mrs. Leabo moved that the
minutes should be approved as corrected. The motion was seconded by
Mr. Jones and unanimously approved.
Agenda Item No. 2 Hear visitors. No one spoke.

Agenda Item No. 3 Variance request from B. B. Scasta, Lot 15, Block 3,
Plantation Oaks Addition, Section 1. The Chairperson pointed out that
the request had been withdrawn and would not be considered by the Board.
Agenda Item No. 4 --Consideration of a variance request from Mr. Bob
Rice, 405 Montclair. The City Planner showed the location and e x plained
that most of the houses constructed in the area were done under Ordinance
No. 38 and under the deed restrictions pertaining to the subdivision
which called for a 5 fo o t side setback line. He said that the Board
was to consider the variance concerning the setback line and the building
permit would be required to comply with the Southern Standard Building
Code when it was applied for.
The Chairperson read a letter from Mr. Carmon Tax and a letter from
Rosa F. Spriggs and others in the immediate area protesting the
proposed variance. The said letters are made a part of these minutes .
Mrs. Leabo asked what the structure would look like. The City Planner
stated that no plan had been received and the Building Official did
not know e x actly what the building would look like until such time the
permit was applied for. Mr. Jones suggested that building permit
applications or a suitable form should be on hand before the board ac t s
in order to prevent confusion in the proceedings of the Board. The
Board agreed that a form should be used when it is devised, but noted
that Mr. Rice had complied with the procedure that had been asked of him.
Mrs. Leabo moved and Mr. Etter seconded that the variance be granted as
requested.
Mrs. Tax expressed concern over the future use of the building for
tenants who would not be members of Mr. Rice's immediate family. Mr.
Dulaney pointed out that the city's policy was to consider the foundation
line to be the edge of the building and that overhang is disregarded.

Mr. Rice said that it was not his intention ever to change the proposed
carport to an enclosed structure, and he also stated that it was not
his intention ever to use the existing converted garage as rental property.
Mr. Tax stated that he had been told by his insurance agent that Mr.
Rice's structure, being in close proximity to Mr. Tax's home, could have
a bearing on his fire insurance rate.
Mrs. Leabo said that the intention of her motion was that the overhang
of the carport would not exceed that of the garage.
Mrs. Leabo's motion to grant the variance was approved unanimously.
Mr. Tax asked about appeal of the Board's decision. Mrs. Leabo quoted
Section 11-H of Ordinance No. 850, which stated that any appeal from
the Board of Adjustment must be through a Court of Record.
Agenda Item No. 5 --Consideration of a recommendation to the City
Council of appointment of alternate members. The Board agreed that an
alternate member would not be likely to adequately prepare for a meeting.
The Board determined that it should wait until such time as the problem
of obtaining a quorum arose and then determine what recommendation to
make to the council.
Agenda Item No. 6 --Other business. A question arose concerning require-
ments of a minimum of 15 feet between buildings. Director of Public
Works Dulaney replied that this too, could be the subject of a variance,
that the original 15 foot requirement was to some extent arbitrary and
that the Board could modify this requirement when circumstances warrant it.
The Chair stated that meetings would continue to be on call of the
Chairperson, but that the preferred time would be, the second Tuesday
of each month and that the time of the meeting would henceforth be
7:00 P.M.
Item No. 7 --Adjourn. As there was no other business, the chairperson
declared the meeting adjourned.

I feel Mr . Galindo 's re quest s h ould be refused . His request is
