It is my understanding that you are considering a
mortgage loan as to the referenced property in this
city. As you are aware, the Zoning Board of Adjustment
has declined to act upon a variance to the city's setback
requirement by virtue of the significant distance involved.
That board has the only authority to permanently approve
this deviation from city ordinance requirements.
However, it is always our policy to enforce such
ordinances with reason and consistent with the public
benefit to be obtained. I have reviewed this matter and
the attendant circumstances thoroughly with the city manager
and we have decided that no public benefit would be gained
from enforcement action. You are hereby advised that the
city does not intend to take enforcement action in connection
with this property, and that the staff considers any future
enforcement activity as to this property to be an exceedingly
remote possibility.
If you have further questions which we may answer, please
let me know.
