Appro val of the minutes of the mee t ing of December 14, 1976. Storts moved that the minutes be approved. Th e mo t ion was seconded by Comstock and unanimously approved. 2 . Considerat ion of a request for variance from Mr . David :83.sc o at 1 203 Pe rshing. Ko ehler explained the nat ure of the reques t and s t ated that, in his op inion, the struc t ures in the ne ighborhood observed a 25 foot rear setback and that t here were no unique conditions of the land . Mr . Ba sco cit ed detached structures a t 1101 and 1103 Pershing and at 1 201 Goode which infringed on a 25 foot setback and whe ther or not they wer e structures by definition, they had the effec t of being s tructures thus creating an unusual situation of t he l and wi th respect to adjoining ac tual uses. Weiss reviewed t he requirements for the granting of a variance . Coms t ock observed tha t the Board could no t grant a variance unless unusual conditions of the land could be shown and that he could see no such conditions . Weiss moved that the variance be granted . The motion was seconde d by Runnels and failed by the f ollowing note : For: None Against : Weiss, Runnels, Coms t ock, Storts 3 . Considerat ion of an appeal from Tom Ch ane y a t 404 Fairview. Koe hler explained that he had refused t o issue a permit for the addition of a bed room suite which contained cooking facilities separate from the existing kitchen in a single family residence on the grounds tha t the separate facilities would creat e a duplex as defined by the Building Depa r tm ent Policy . • • • Mr . Chaney said that the addition was to be used by members of the i med i ate frunily, that entrance to the area could be gained on ly from the ma i n part of the house and that strict appli cation of existing p oli cy could exclude such common uses as a 11 we t bar" or convenience center in a recreation room or den . He suggested that p olicy should be modified so as t o make e nforcement cont ingent upon violation by actual occupancy rather than struc t ural charact eri s t ics in case s where it would be possible to occupy the s t ruc t ure wi thout violating the Zoning Ordinance . We is s ob served t hat the structure could be occupied as a duplex wi thout any modification but that a duplex was not specifically de f ined in the ordinance. Weiss mov ed that the permit be granted, that the Certificate of Occup ancy limit the occupancy of the entire structure to members of one imediate frunily only, that the Building Official ask fo r an amendment t o the Zoning Ordinance t o define a duplex, and in the int erim that any similar cases be referred to the Board. The moti on was seconded by Run nels and unanimously approved. 4 . Co nsid erat ion of a procedure f or se tting mee t ing dates. foehle r sugg es t ed that the Board establish the third Tuesday of each mon th as a regular meeting date subject t o cancellat ion for lack of busines s or lack of quorum and not requiring a call b:; the Ch airman . Wi th th e c onsent of the Board, the Ch airman declared that the th ird Tu esday of each mon th would be the regular meeting dat e. 5. Other Bu siness . Koehler s tated tha t t he City att orney had deter- mined that beginning work without a building permit was an offense sub j ec t t o the penalty provisions of the ordinance and did not require a change in the ordinance. 6 . Runnel s moved that the meeting be a dj ourned. Th e motion was seconded by Coms t ock and unanimously approved .
