Present zoning of land in question ~_;_-=!~~~~~:__~~~JR~-:l.l~~~~~~~~~~~~~ Section of ordinance from which variance is sought 2301. 7 & Nov 77 sign regulation The following specific variation from the ordinance is requested: We would like a variance on the interpretation by some of the city staff as to the meaning of repairs as it pertains to signs. This variance is necessary due to the following unique and special conditions of the land not found in like districts: There is outdoor advertising on only a few lots within the city limits and with the exception of the City's own Welcome signs all were taken ; in through annexation. The following alternatives to the requested variance are possible: Allow the sign to remain as repaired for the duration of its normal structure life. This variance will not be contrary to the public interest by virtue of the following f~ct~: It gives directional information. It is clean and neat in app~arance. It offers an economical means of advertising. It does not block visibility or interfere with traffic control. It was existing ---,---- and only made to look nicer was quite an eye sore before repainting. The this application are true and correct. Coy Perry, Building Official/)' Farmer's Market Sign November 17, 1981 Please refer to Section 105.la of the Building Code which states : Section 105 -Application for Peroit "105.1-Hhen Required (a) Any owner, authorized agent, or contractor who desires .... to erect, or construct a sign of any description, .... shall first make application to the Building Official and obtain the r eq ired permit therefor.?• If Mr. Stabler had applied at this office he would have been required to have a permit, because more than simply repainting was involved. The sign (which is a structure) was essentially constructed and not simply repainted. Please refer to Section 105.l(c) which states: "(c) Ordinary minor repairs may be made with the approval of the Building Official without a permit; provided that such repairs shall not violate any of the provisions of this code." Therefore, had Mr. Stabler contacted me initially prior to performing any work on the sign, he would have been advised of what does and does not require a permit.
