AGENDA ITEM NO. 2
The Ramada Inn presently has a non-conforming sign. The sign is
not in compliance with the Zontng Ordinance for various reasons:
(l) The sign is too close to the right-of-way line
(see Section 8-D.6.) In fact the sign encroaches some
3 1/2 feet over the R.O.W. line.
(2) The sign is too htgh . At the present location the ordinance
would not a1low any part of the sign to exceed 4 1/2 feet.
(See Section 8-D .9 ,)
(3) The present sign exceeds the maxtmum allowable area for
its location (See Section 8-D.9.)
The app1icant is proposing some changes to the existtng sign. These
changes fovo1ve removing the "man" attached to the sign, and re moving the
existing RAMADA face and replacing it with a new face, smaller in area,
but located higher on the poles. The new sign will come into compliance
with Sec t ion 8-D.6 -location from right-of-way and Section 8-D.9 -
maxi'mum a1lowab1e area . However, the proposed sign would be farther out
of comp1tance with Section 8-D.9 -maximum allowable he i ght. The sign as
proposed would be 43 feet high. rt is to the height requirement that the
app1icant is requesting a variance.

8-D.4. MOBILE HOME PARK .DISTRICTS: A "Ground Sign" or "\fall Sign" of not
more than one hundred (100) square feet total area may be erected on th~
property of the mobile home park, and may be indirectly lighted; however, it
shall have no flashing lights or moving parts, and no "Spectacular Signs" may
be installed. See Building Code for permit requirements. This is also applicable
to mobile home parks in P-U-D 1 s.
8-D.5. NEIGHBORHOOD BUSINESS AND ADMINISTRATIVE PROFESSIONAL DISTRICTS: Signs
when attached to buildings shall advertise only services or products which
are offered within the building to which the sign is attached, and such signs
shall not extend above the roof line of such buildings, or more than one (l)
foot from the face of the building. No flashing or moving signs are permitted
and no "Spectacular Signs" are permitted. No detached signs or billboards are
permitted. See building Code for permit requirements. This is also applicable
. to neighborhood businesses in P-U-D 1 s . ·
8-D.6-OTHER DISTRICTS: No sign shall have flashing lights or moving parts
if within fifty (50) feet of a public street. "Spectacular Signs 11 must be installed
with bottom of sign a minimum of fifteen (15) feet above the . ground, and must

8-D.7. BILLBOARDS: No billboards or signs shall be erected advertising products
or services not available on the site, except as provided in Section 8-C.
_8-D.8. STREET NUMBER: A street address number, as designated by the Building
Official, is required for all residences and establishments. It must be readable
from the street and may be on the building or in the yard and may include the
nam·e of the occupant. No permit is required.
8-0,9 QFIACHED SIG ij S: A detached sign, any part of which is nearer to the
curb or pavement edge than (20) feet, may not have any part higher than (4 1/2)
feet above the top of the curb or paveme'nt centerline, whichever is higher.
Detached signs farther than (20) feet from the curb or pavement edge may not
have any part higher above ground at the sign than (1/2) the distance from the
curb or pavement edge; nor may the area of any detached sign exceed either
1). the square of (1/6) the distance in feet from the base of the sign to the curb
or pavement edge or 2). more than one square foot of sign per two feet of plot
frontage on a public street, whichever is greater. No more than (1) detached
sign shall be allowed in any one building plot except when all of the following
conditions are met:
(a). the site (building plot) must be zoned General Commercial C-1,
Commercial Industrial C-2, Planned Industrial M-1, or Heavy Industrial
M-2.
(b). the site must be a minimum size of twenty-five-(25) acres.
(c). the site must have a minimum of 1 ,000 feet of continuous, unsubdi vi ded
frontage on each major arterial on which a sign is requested; only one
(1) sign will be permitted on each major arterial; the major arterials
are designated on the Comprehensive Plan for the City of College Station.

In the absence of Chairman Harper, Commissioner Burke was selected to ch ai r
the meeting.
Mayor Halter was introduced and in a brief ceremony, administered the oath of
office to new board member Dan McGilvrey and reappointed member Vi Burke.
Commissioner Burke then proceeded with the regular items on the agenda.
AGENDA ITEM NO. l -Approval of minutes of April 21, 1981.
Upon mo ti on by Commission er Wagner; second by Commissioner Burke, the mi nut es
were unanimously approved.
AGENDA ITEM NO . 2 -Consideration of a reque s t for a variance to the off-street
parking requirements for an arcade in the name of Edward J. Walsh, 315 Univer s Hy
Drive, College Station, Texas.
Ed Walsh, applicant for the variance, addressed the board and explained he had
been in operation in that location for ten years and still has eight years re -
maining on his lease . The retail budget tapes and record shop he previously
operated in the location has been closed. The present inflationary conditions
of the economy make it infeasible to open another retail outlet, but an arcade
with electronic games, not serving food or beverages, is economically advantageous.
A large amount of parking is not anticipated to be required for this type operation
because this business will depend on foot traffic from other businesses in the area .
Jane Kee explained to the board that in 1980 the Planning and Zoning Commission
established the present requirement of one parking space per 15 s,quare foot, in-
cluding parking for employees, which causes seven spaces to be required for the
proposed business. This exceeds the present variance approval by one space.
Co mmissioner Upham asked when Mr. Walsh received the variance to parking he now
has.
Jane Kee replied it was in August, 1979.
( Commissioner Wagner asked what the hours of operation of the arcade would be.
Mr. Walsh replied he had not made a definite decision, but perhaps it would be
from 9:00 0 a ~m. to 9:00 p.m., and perhaps later on the weekend.

Commissioner McGilvrey asked what was the reason for the variance in 1979.
Mr. Walsh replied that the size of the building was increased.
Commissioner McGilvrey asked how persons who purchased alcoholic beverages at
other locations and brought them into the arcade would be handled.
Mr. Walsh replied he was unfamiliar with State law in this area, but whatever
the requirements of the police department are, he would abide by.
Commissioner Wagner asked where present employees parked.
Wherever they are able to find a space, Mr. Walsh stated . He added the infor-
mation that the Cow Hop had recently relocated two dumpsters which created an
additional two parking spaces behind his building .
Commissioner Upham called the board's attention to the fact that a smaller
business down the street was turned down for a similar request.
Mr. Walsh thought the denial might have been based on the fact that the business
would draw students into an area they had not been going to before since the
location was two streets down from his location.
Commissioner Burke stated it was denied based on the increased parking require-
ments in an already conjested area.
Mr. Walsh asked the board to consider the number of years he had been in business -·
in the· area and also his remaining eight year lease and that he is not proposing
a retail business which he feels would increase automobile to a greater extent
than the business proposed . ·
' Commissioner McGilvrey asked what alternatives Mr . Walsh might have if this
variance is not approved.
Mr. Walsh replied he has no a l ternatives.
Commissioner Burke assured Mr . Walsh the board understands the problems of the
bus i nesses in the Northgate area, but the board must concern itself primarily
with a problem that exists and is in conflict with the best interests of the
community i n that area .
Commissioner Wagner asked wha t the changes in parking requirements might be
if 1 50 square feet of space in the rear of the building were partitioned off.
Mr. Walsh stated there was that much space already partitioned off now as office
space and f or restroom facili t ies .
Mr. Callaway reminded the board there would be a parking requirement for office
use and stated he could not recall exactly what it would be. He further stated
the board might consider the affect of space so partitioned if it were not used.
Commissioner Wagner asked if staff felt the actions of the board had contributed
materially through the past years to better the traffic conditions in the North-
gate area.
Mr . Callaway replied there are three groups involved. The business owners, property
owners and the city. There have been changes through the years in types of busi-
nesses in the area, but overall, there has been no appreciable change either
adversely or correctively in the area .

requirements for an arcade, application in the name of Edward J. Walsh at
315 University Drive, College Station, Texas be considered for approval . Second
·to the motion was given by Commissioner Wagner and approval was denied by the
fo 11 owing vote .
In favor : Commissioner McGilvrey .
Opposed: Commissioners Burke, Upham and Wagner.
AGENDA ITEM NO. 3 -Consideration of a request for a variance to the side yard
setback requirements for the expansion of A & M Presbyterian Church office, 301
North Church Avenue, College Station, Texas.
Jane Kee explained to the board that the var:i:.ance to the side set-back could be
granted under Section 11-B .3 .(B) of Ordinance 850, which allows the enlargement
of a building devoted to a non-conforming use 1!under certain circumstances . If
this variance is granted, this would essentially establish a new side setback for
this lot and any further developments by the Church within these setbacks will
need not come before the board.
Jim Holster, architect representing A & M Presbyterian CF1urch described the
proposed new construction to the board stating it is an expansion of the ex-
isting administrative offices of the building. Seating capacity in the sanctuary
is not being expanded.
Commissioner Wagner asked if the fire marshall had checked these plans.
Mr. Callaway replied he had seen the plans, not in a review for this board,
but in a review for the Planning & Zoning Commission and he had not made any
objections .
Commissioner M~Gilvrey asked if it would be legal to make the new construction
conform to the present line .
Commissioner Upham stated if the variance was denied, essentially that would be
the only alternative. He asked staff if the Church would still need a permit
from the board .
Mr. Callaway answered it would be best for them to resolve it before the board.
Mr. Holster explained the plans had been worked out in the most economical manner
possible. If they tried to go north with the construction it would interfere with
the existing roof line; if they attempted to go south it would interfere with the
wind9ws.
Commissioner Upham stated if it were redesigned for smaller space it could remain
in the present variance. He then asked Jane Kee to read Section ll-B .3(B) of
Ordinance No. 850.
After discussion, Commission er Burke formed the fo 11 owing mo ti on for consideration:
It is hereby moved that the variance to the side yard setback requirements for
the expansion of A & M Presbyterian Church office, 301 North Church Avenue, College
Station, Texas be approved with the stipulation that the approval of this variance
does not approve future construction or expansion of this non-conforming use
without approval of this board.

AGENDA ITEM NO. 4 -Other Business .
Mr. J. W. Wood approached t he board for consideration of a variance to lot
width in the area of University Drive at Fed Mart Drive where a duplex develop -
men t is proposed. He explained he was not asking for approval at this time,
but wanted to get a feeling of the board's attitude toward such · a variance be-
fore proceeding with planning and development of the area. The reason for con-
siderat i on of a variance to t he lot width is to allow the duplexes to be designed
for rear parking. The lots would be deeper than the present requirement and the
square footage of the lot areas will be the same.
Mr. Callaway explained that work in the area of devel oping an Ordinan ce s o this
type development could be allowed had been on going, and at some time in the
future it would probably be s ent to the Planning & Zon i ng Commiss i on .
Mr. Wood said he would like to work toward such an Ordinance .
Commissioner Wagner replied that stri ct interpre t ation had been placed on exist -
ing situations. He then asked were there topographical or other reasons which
could create unique and unusual circumstances which would justify the reduction
of lot width.
Mr. Wood stated there were not. The ir feeling is that by changing the lot size
in this manner it would create a better development with better eye appeal and
more useable rear space to the unit s.
After a further discussion, the board agreed this was not a matter over which
they could make a decision or recommendation, but encourage Mr . Wood to work
with .staff to develop an Ordinance which could and would allow such flexibility.
There being no furt he r business to come before t he body, upon motion by Co mmissioner
McGilvrey; second by Cpmmissioner Wagner, the meeting was adjourned .

ZONING BOARD OF ADJUSTMENT
FILING PROCEDURES
(1) In order for the Board to consider a case, there must be
on file a complete application for a building permit which has
been rejected by the Building Official and a completed "Request
for Variance" application.
+f some unique circumstance renders a full design imprac-
tical, and if the Board consents, the appeal may be based on a
decision rendered in writing by the Building Official in reply
to the applicant's written inquiry as to the effect of a parti-
cular zoning requirement on a proposed plan. A complete appli-
cation for variance must also be filed along with any drawings
or data necessary to show the nature and extent of the variance.
(2) The complete application must be receive d by the Zoning
Board <secretary no later than noon on the Friday preceeding
the publication date.
(3) The applicant must be present at the meeting of the Zoning
Board of Adjustment meeting for the application to be considered.
(4) There will be no item plaC'e d on the Board agenda nor any
notice published until all of the materials mentioned above are
complete and in hand. We provide no materials to the Board
in support of a variance except that which we receive from the
applicant and can reproduce in-house ( 8 1/2 x 14 max. s ize,
li.ne work) .

(a) Must be typed by the applicant.
(b) Owners within 200 feet may be determined by sca le
from the 1"=100' scale street map series on file
in the Office of the Building Official. Owners
whose property in any part falls within the 200
foot distance should be listed. Measurement starts
from the property line of the lot or tract in
question, or, if the tract is bounded by a street,
from the opposite side of the street.
(c) The names and addresses must be as they appear on
City tax rolls, even if they are wrong or out of
date.
(d) Additional notices will be sent to any correcte d
?ddress the applicant supplies, when he feels there
is an error with the tax rolls.

(a). The Zoning Board secretary will assist you in
finding the zoning of the tract, identifying the
s~ction of _the ordinance and specifying the varia-
tion .
(b) The remaining sections address themselves to the
three findings that the Board must make in order to
grant a variance. If the Board cannot agree with any
one of these, they will not be able to grant the
variance.
(c) If you can not fully explain your request by the
questions asked on the form, a letter will be required,
explaining the full implications of the request.
The application will not be considered completed
until this letter is submitted.
(6) The application will be sent to the Building Official,
City Engineer and the Fire Marshall for comment on the case.
(7) The application must be reviewed by the Zoning Board
secretary b e fore it can be considered completed and filed.
Notice will be given to the applicant as to this consideration.
(8) It is the responsibility of the applicant to complete
all phases of the application filing and to check to be sure
his application is considered complete by the Zoning Board
secretary.
(9) The applicant will be notified a s to the date the applica-
tion will be considered by certi fied mail. There will be no
other reminders of the meeting, other than when the applicant
phones the office.
(10) Notice of the hearing will be published on the Wednesday
preceeding the meeting and will be mailed by the off ice of the
Zoning Board secretary to the owners within 200 feet and the
applicant. The ~omplete applicatipn must be recieved by noon
on the Friday preceeding the date of publication in order for
us to meet the publisher's deadline.
(11) Should any person desire to appeal a decision of the
Board, he should so state after the conclusion of the hearing.
The chairman will complete his statement of findings which will
constitute filing of the decision. Minutes of the meeting,
subject to approval of the Board, will be prepared by the close
of business on the following day. A duplicate tape of the
proceedings will be made available to the appellant's attorney
upon request and upon receipt of compensation for the 120
minute cassettes used for the duplication. No transcript is
made of the hearings. Minutes of the proceedings are para-
phrased as appropriate, in the judgement of the recorder, to

corner of carport matches the existing driveway which is 16" from side property line. Design
and pitch of carport roof matches front of house exactly to provide uniform appearance.

Th i s variance is n e cessary due to the following unique and sp e c i al cond itions of
the land not found in like distric t s:
Previous garage was enclosed for additional bedroom and bath. Old driveway will accommodate
3-car carport without any change. We have three cars and would like to cover them. In addi-
pitch (~hich matches the front of existing house).
The followi n g alt e rnatives to th e requested varianc e a r e poss i b le: Not having a covered
area for all three cars and having a driveway 8 1 wider than the carport would look silly.
Can't turn the garage the other direction because the width of the driveway and space next
to it does not allow a normal size ca r to he abl~ to turn 90 degrees into a garage or
carport attached to the side of house facing south (instead of west as is being requested).
There is also an air conditioner unit in the way.
This variance will not be contrary to the public interes t by vir t u e o f t h e followi n g
. "~ f ~c ts : The variance would provide a covered carport that would present a more finished 1
uniform and complete appearance. My immediate neighbor, Dr. Khee Rhee approves the
carport and has constructed a wooden fence that will adjoin the brick columns supporting
my carport on our common property line. (His letter is attached)

RE: Mr. Chalan Jones' Proposed Addition at 2809 Brothers Blvd.
Gentlemen:
I am Mr. Jones' next door neighbor at 2901 Brothers Blvd., and my house adjoins
Mr. Jones' property on the side where he is proposing to add a carport.
Mr. Jones showed me his plans for the proposed addition of a 3-car carport at
the end of his drive-way . As a neighbor, I understand his needs and desire to
have a carport built, and his plans, in my opinion, seem reasonable. I,
therefore, have no objections to Mr. Jones' plans to add such a carport as long
as the following two conditions are met.
1. The Zoning Board of Adjustment, City of College Station, has determined
that the proposed addition is acceptable under the currently applicable
rules and regulations governing the City Zoning Ordinances, including
general appearance, fire hazard and others.
2. The current or all future owners of the property at 2901 Brothers Blvd.
will not be held responsible, legally or otherwise, for any damages or
violations of city zoning ordinances or others arising directly or
indirectly from the proposed addition.
