The followi.ng ·specific ·variation from the ordinance is requested:
We wish to reduce the 15' building line to a 12.85' building line.
This variance is necessary due to the following unique and special conditions of
the land not found in like districts:
Due to the truncated sides of the lot, normally found
at the end of cul-de-sacs, the sl ah was fmmd t .o encroach on ORB coraer. This

The following alternatives to the requested variance are possible:
(1) Tear down the structure (2) Alter the structµre by cutting off the amo11nt of
encroachment (3) Grant a conditional variance causing the building -line to reyert
back to 15' in the event the structure is ever removed by fire, tornado, etc.
This variance wiil not be contrary to the public interest by virtue of the following

ZONING BOARD OF ADJUSTMENT
FILING PROCEDURES
(1) In order for the Board to consider a case, there must be
on file a complete application for a building permit which has
been rejected by the Building Official and a completed "Request
for Variance" application.
If some unique circumstance renders a full design imprac-
tical, and if the Board consents, the appeal may be based on a
decision rendered in writing by the Building Official in reply
to the applicant's written inquiry as to the effect of a parti-
cular zoning requirement on a proposed plan. A complete appli-
cation for variance must also be filed along with any drawings
or data necessary to show the nature and extent of .the variance.
(2) The complete application must .be received by the Zoning
Board <sec:i;etary no later than noon on the Friday preceeding
the publication date.
(3) The applicant must be present at the meeting of the Zoning
Board of Adjustment meeting for the application to be considered.
( 4) There will be no i tern pla?ed on the Board agenda nor any
notice published until all of the materials mentioned above are
complete and in hand. We provide no materials to the Board
in support of a variance except that which we receive from the
applicant and can reproduce in-house ( 8 1/2 x 14 max. size,
line work) .

(a) Must be typed by the applicant.
(b) Owners within 200 feet may be dete:.:-mined by scale
from the 1"=100' scale street map series on file
in the Office of the Building Official. Owners
whose property in any part falls within the 200
foot distance should be listed. Measurement starts
from the property line of the lot or tract in
question, or, if the tract is bounded by a street,
from the opposite side of the street.
(c} The names and addresses must be as they appear on
City tax rolls, even if they are wrong or out of
date.
(d) Additional notices will be sent to any corrected
address the applicant supplies, when he feels there
is an error with the tax rolls.

(a) The Zoning Board secretary · will assist you in
finding the zoning of the tract, identifying the
section of the ordinance and specifying the varia-
tion.
(b) The remaining sections address themselves to the
three findings that the Boar d must make in order to
grant a variance. If the Boar d cannot a gree with any
one of these, they will not be able to grant the
variance.
(c) If you can not fully explain your request by the
questions asked on the form, a ·letter will be required,
explaining the full implicati ons of the request.
The application will not be considered completed
until this letter is submitted.
(6) The application will be sent to the Building Official,
City Engineer and the Fire Marshall f o r comment on the c a se.
(7) The application must be reviewed by the Zoning Board
secretary before · it can be conside r ed completed and filed.
Notice will be given to the applicanD as to this consideration.
(8) It is the responsibility of the a pplicant to c o mpl e te
all phases of the . application filing a nd to check to be sure
his application is considered comple te by the Zoning Board
secretary.
(9) The applicant will be notified as to the date the a pp lica-
tion will be considered by cert-1>-fied mail. There will be no
other reminders of the meeting, other than when the applicant
phones the office.
{10) Notice of the hearing will be published on the Wednesday
preceeding the meeting and will be ma i led by the ·of f ice of the
Zoning Board sec~etary . to the owners within 200 feet and the
applicant. The 'complete applicati9n must be rec±eved by noon
on the Friday preceeding the date of publication in order for
us to meet the publisher's deadline.
{11) Should any person desire to appeal a decision of the
Board, he should so state after the conclusion of the hearing .
The chairman will complete his statemen t of findings which will
constitute filing of the decision. Minutes of the meeting,
subject to approval of the Board, wi l l be prepared by the close
of business on the following day. A duplicate tape o f the
proceedings will be made available to ·the appellant's attorney
upon request and upon receipt of compe nsation for the 120
minute cassettes used for the duplication. No transcript is
made of the hearings. Minutes of the proceedings are para-
phrased as appropriate, in the judgement of the recorder, to
reflect points of the discussion pertinent to the decisions
rendered.
