Kee, Zoning Official SUBJECT: Agenda Items -July 21, 1981 AGENDA ITEM NO. 2 The Planned Parenthood Association is proposing to purchase the prope·rty at 201 Grove Street for a medical clinic. The clinic is requesting a conditional use permit from the Planning and Zoning Connnission on July 16, 1981. The Project Review Committee required 23 parking spaces for the clinic. The house has 2100 sq. ft. and the parking requirement is one space per 100 sq. ft. plus ·one space per two employees. The site plan submitted shows 10 spaces provided on the site. Three spaces off- site, which have been donated by the Unitarian Church, are unacceptable to the P.R.C. The applicant is also requesting a variance to the rear setback. This .is because the present structure encroaches the rear property line and in order to get a building permit this variance must be granted. Mr. Jack Wagner will · be pres e nt to answer questions and site plans will be provided at the meeting. AGENDA ITEM NO. 3 .The applicant (Spearman, Sears and Mur ph y ) is requesting a variance to the side street setback of 15'. The ·structure in question is a 4-plex located in Parkway Plaza Phase 8 which presently has been framed. The side street involved is Barthelow. Th e slab encroaches 2.15' over the side setback. The applicant e x plains the alternat i ves in the applicat i on form enclosed. AGENDA ITEM NO. 4 As you recall Mr. Ed Walsh appeared befor e the Board on Ma y 19, 1981 to request a variance to the parking requirements for an arcade to be located at 315 University Drive. Enclosed in your packet please find a copy of the memo and minutes from that meeting . Dr. Louise Vance has addressed a letter to the Board, which is enclosed, indicating that 6 parking spaces will be allocated for the arcade. Please recall that there is 1 on site space ex isting. ( ( MEMBERS PRESENT: STAFF PRESENT: MINUTES City of College Station, Texas Zoning Board of Adjustment June 16, 1981 7:00 p.m. Chairman, W. W. Harper; Board Members, Dan MacGilvray, G. Wagner, Violetta Burke, Jack Upham; City Council Liaison, Pat Boughton. Zoning Official, Jane Kee; Ass't. Directot of Planning, Jim Callaway; Planning Technician, Joan Keigley. Chairman Harper called the meeting to order at 7:00 p.m. and proceeded to the . first item on the agenda. AGENDA ITEM NO. 1, Approval .of minutes -meeting of May 19, 1981. Mr. MacGilvray offered the correct spelling of his last name and asked that it be corrected. Jane Kee pointed out a typographical error which had been discovered by staff on page 1, Item No. 2 in the second line of the second paragraph wherein "15 square foot 11 should be corrected to "150 square fe et. 11 Upon motion by Mr. Upham, subject to these corrections; second by Mr. MacGilvray the motion was unanimously approved. Before proceeding to the next item, Chairman Harper introduced new members of the Board and staff members and expressed appreciation of staff attendance and support to the Board. , ! AGENDA ITEM NO. 2, Consideration of a variance to sign height requirement of Ordinance No. 850, Section 8-D.9. to raise existing Ramada Inn sign. Application submitted inthe name of Joe A. Ferreri. Board Member Burke entered the meeting at 7:05 p.m. Jane Kee presented the application to the Board and pointed out an error in her membo by stating the new sign as proposed would not be in compliance with Section 8-D.6 -location from right--0f-way. Mr. MacGilvray asked how close the sign would be to the right-of-way and Mrs. Kee answered the sign would need to be another ten feet behind the property line to be in compliance. Mr. Wagner stated he had driven up and down Texas Avenue and was able to see the existing sign from any direction without any problems. Mr. Joe Ferreri, own e r of Ramada Inn, stated the sign is obstructed; and, beside an attempt to correct tha t problem with new construction and remodeling of the complex about to begin it is his desire to refurbish the sign so it will be com- patible with the overall changes that will be made. •. Mr. Wagner stated he did not agree the sign is obstructed. Mr. Ferreri explained another reason for reconstruction of the sign is to bring it ( Zoning Board of Adjustment June 16, 1981 Page 2. high enough so the traveler will be able to see it soon enough to avoid a sudden slow down and stop in order to turn into the driveway. Chairman Harper stated he felt one purpose of the change in the sign would be to improve visability. Mr. Upham expressed th~ idea that portions of the existing sign could be removed and maintenance could be done which would make it feasible to decrease the size of the sign and bring it into aesthetic design which would match the new construc- tion and then this Board would not be involved in the matter. He further stated if the idea is agreeable, Mr. Ferreri would be in order to withdraw this applica- tion from consideration by the Board. Chairman Harper stated if this were to be done, it would have to be understood that the sign would not be increased in height; it would have to remain the same height or be lower. Mr. Ferri stated this would .be agreeable. Mr. Upham then presented the advisory motion that subject to the withdrawal of this application by Mr. Ferreri, this Board would recommend that the existing sign be remodeled, repaired and refurbished at its present location with the understanding that the height is not to be increased. Mr. Ferreri agreed and withdrew his application for variance from consideration of the Board. ( Second to the motion was given by Mrs. Burke and the motion was unanimously approved. AGENDA ITEM NO. 3, Other Business. Jane Kee made the members of the Board aware of the fact that arrangements have been made for all members of the Planning & Zoning Commission and Zoning Board of Adjust- ment to pick up their packets in the Planning Office. When the packets are ready, each member will be notified by telephone. There being no further business to come before the body, upon motion by Mr. Upham, second by Mr. MacGilvray the meeting was adjourned. A physician is the Medical Director and spends 4-6 hours per \·:eek at the Center. Medical students from TAMU College of Medicine rotate through the Center as part of their community health experience. Planned Parenthood ~a~ operated a C~nier in the N~rthgate area for the pa st 6 years. The majority of their pa ti en ts walk or bike from ca mp us or nearby apartments. It is expected that many of the same patients will bike or walk to the new Center. Planned patient load is 4 per hour or 30 per day for an annual total of approximately 7500 patients. In 1980 the Center served 7,383 patients. The Unitarian Fellowship has offered the regular use of three spaces in their parking area adjacent to the proposed parking for the Center (see copy of letter attached). The proposed site comprises a buildin~ that has been in existence more than ·20 years that encroaches on the rear set-back line imposed under present code. With the alley in the rear, this has apparently caused no conflict or othe~ hardship and none is anticipated. One of the unique features of the proposed site is its natural beauty provided by the many large oak trees on the property. Oui' primary goal in planning the needed off-street parking is to do so with the least possible destruction to this attractive area. I will not be selling food or any alcoholic beverages. The purpose of this business will be to attract Texas A&M students to play electronic games. This should keep clear some of the student congestion in the streets on weekend nights. I anticipate most of my business coming from the overflow of students from the nearby bars. People will not drive across town to play pinball since they can do this at any convenience stc.re. In fact sal.es undertaken by the retail record store that was there previously did att~act driving traffic, thus I feel this idea will in fact decrease traffic in the area over the past and also decrease traffic compared to any other retail store idea. This also will be a place for non-drinking students to walk to, particularly if the drinking age is raised to nineteen. In the past I have had three employees; one was full time and two were part time. Two of the three drove to work . With this new business I will have only one employee there at all times. I intend to use three or four shifts of TAMU students, one at a time, all of whom live on campus and thus will walk to 'work . This will eliminate the past need for two parking spaces. I have been leasing this building for ten years and have another eight years on my lease. This idea is particulary attactive to me because I will not have to come up with a large capital outlay, which I do not have, to start the business as I would with a retail idea. Another factor to be considered is the fact that my landlord has designated six additional park spaces in the lot she owns at Northgate for my exclusive use. To summarize, I belive this proposal to be beneficial for both the city of College Station, by decreasing traffic to the area or at the very least not increasing traffic. Also, reducing weekend walking tr affic on the street, and decreasing my present needs for employee p a rking , and for myself, by allowing me to ma ke use of my remaining eight years on my lease without requiring me to invest larg e sums of money in inventory which I do not have and is not economically feasible at any rate g iven the present interest rates. As well, I now have sufficient parking places to meet the city requireme nt s . Kee, Zoning Official SUBJECT: ZBA Agenda Items, May 19, 1981 Agenda Item # 1. The structure in question is located at 315 University Drive and presently houses Budget Tapes & Records. The applicant, Mr. Edward Walsh, wishes to change the use from a retail establishment to an arcade. He is requesting a variance to the off-street parking require- ments. Some background information may be helpful t o the Board. In August of 1979 a variance to the setback and parking requirement was granted in order to enlarge the then existing structure. The structure is now 950 square feet. The parking requirement for the previous retail use was 1 space/300 square fee~ plus 1 space/2 employees. Budget Tapes had three (3) employees which resulted in a parking requirement of five (5) spaces. There is actually one (1) space available on the site at the rear of the building and one space of on-street parking along University Drive. In January of 1980 the Planning and Zoning Commission established a parking requirement for an arcade (1 space/150 square feet -this includes employees ).This results in a parking requirement for the proposed arcade of seven (7) off-street spaces. This is the requirement to which Mr. Walsh seeks a variance. :~- E X C E R\P T F R 0 M M I N U T E S 0 F M A Y 1 9, 1 9 8 1 AGENDA ITEM NO. 2 -Consideration of a request for a variance to the off-street parking requirements for an arcade in the name of Edward J. Walsh, 315 Universi ·ty Drive, College Station, Texas. Ed Walsh, ~pplicant for the variance, addressed the board and explained he had been in operation in that location for ten years and still has eight years re- maining on his lease. The retail budget tapes and record shop he previously operated in the location has been closed. The present inflationary conditions of the economy make it infeasible to open another retail outlet, but an arcade with electronic games, not serving food or beverages, is economically advantageous. A large amount of parking is not anticipated to be required for this type operation because this business will depend on foot traffic from other businesses in the area. Jane Kee explained to the board that in 1980 the Planning and Zoning Commission established the present requirement of one parking space per 15 s.quare foot, in- cluding parking for employees, which causes seven spaces to be required for the proposed business. This exceeds the present variance approval by one space. Commissioner Upham asked when Mr. Walsh received the variance to parking he now has . Jane Kee replied it was in August, 1979 . ( Commissioner Wagner asked wha t the hours of operation of the arcade would be. Mr. WaJsh replied he had not made a definite decision, but perhaps it would be from 9:00 0a.m. to 9:00 p.m., and perhaps later on the weekend. ( ( M1nutes Zoning Board of Adjustment May 19, 1981 Page two. Commissioner McGilvrey asked what was the reason for the variance in 1979. Mr. Walsh replied that the size of the building was increased. Commissioner McGilvrey asked how persons who purchased alcoholic beverages at other locations and brought them into the arcade would be handled. ' Mr. Walsh replied he was unfamiliar with State law in this area, but whatever the requirements of the police department are, he would abide by. Commissioner Wagner asked where present employees parked. Wherever they are able to find a space, Mr. Walsh stated. He added the infor- mation that the Cow Hop had recently relocated two dumpsters which created an additional two parking spaces behind his building. Commissioner Upham called the board's attention to the fact that a smaller business down the street was turned down for a similar request. Mr. Walsh thought the denial might have been based on the fact that the business would draw students into an area they had not been going to before since the location was two streets down from his location. Commissioner Burke stated it was denied based on the increased parking require- ments in an already conjested area. Mr. Walsh asked the board to consider the number of years he had been in business in the area and also his remaining eight year lease and that he is not proposing a retail business which he feels would increase automobile to a greater extent than the business proposed. Commissioner McGilvrey asked what alternatives Mr. Walsh might have if this variance is not approved. · Mr. Walsh replied he has no alternatives. Commissioner Burke assured Mr. Walsh the board understands the problems of the businesses in the Northgate area, but the board must concern itself primarily with a problem that ~xists and is in conflict with the best interests of the community in that area. Commissioner Wagner asked what the changes in parking requirements might be if 150 square feet of space in the rear of the building were partitioned off. Mr. Wals h stated there was that much sp a ce already partitioned off now as office space and for restroom facilities. Mr. Callaway reminded the board there would be a parking requirement for office use and stated he could not recall exactly what it would be. He further stated the board might consider the affect of spa c e so partitioned if it were not used. Commissioner Wagner asked if staff felt the actions of the board had contributed materially through the past years to better th e traffic conditions in the North- gate area. Mr. Callaway replied there are three groups involved. The business owners, property owners and the city.
