Ca l !away Zoning Off i cial f1I NUTES City of Coll ege Stat ion Zoning Board of Adjustment May 20, 19 80 MEMBERS PRESENT: Chair man Harper, Uph am , Wagner, Council Liason Boughton STAFF PRESENT: Zoning Official Callawa y , Planning Assistant Longley Agenda Item No. 1 -Approval of Minutes, Meet ing of April 15, 1 980 - Wagner moved to approve the minutes of the meeting of April 15, 19 80. The motion was seconded by Upham and passe d unanimously. No. 2 -Consideration of a Re uest for a Variance in the name of el, 1201 Merr Oak s Drive Th i s i tem v1as tabled at the revious Chairma n Harper explained the action the Board had taken at the previous meeting an d asked the applicant to pre se nt any addit ion al information relevant to the case. J.A. Spa nn agel presented pictures of the site and explained his need for a vari ance. vJagner a sk ed if any consideration had been given to alternative sites for the propo sed car port. Spannagel repl ied that existing trees limited alternative s . Harper exp l ained the findings require d by the Zoning Ordinance for the granting of a variance and poin ted out that th e requirements for a vari an ce were not evident in this case. Spannagel inquired as to the proper authority for reference of a drainage proble m. Callaway stated that draina ge problems should be referred to the City Engineer. Chairman Harper moved to grant the req uested variance, du e to the unique condition of being situated on a corn e r lot and due to the absence of objections from adjoiner s . The motio n was seconded by l·!agner and failed by th e following vote: For: Opposed: Non e Unani mou s Agend a Ite~ No. 3 -Co ns ideration of a Request for a Variance in the name of Rudolph Pri gge , 815 Texas Ave nue - Ch a irman Harper inquired as to th e use a nd pl aceme nt of th e pr op osed structure . Rudolph Prigge replied that it woul d be used as a n offic e and a waiting loung e Minute s , May 20, 1980 ZBA Meeting Page 2 for customer s . Prigge added that the structure would be placed within three feet (3') of the rear property line. Upham reported on his inve st igation of the request before the Board. In his report Upham described the existing property ownership patterns, locations of Public Rights-of-Way and easements, the locations of structures in the area, and the effect of the requested variance upon development of the adjacent properties. Upham further described the relationship between the proposed building location and the existing gasoline storage inlets. Following his report on the case before the Board, Uph am stated that he felt that the conditions of the site did not warrant the granting of a variance, but that the Board could allow for the expansion of a non-conforming site so long as such expansion did conform with all requirements of the Zoning Ordinance. Harper asked the applicant for co mments or any additional information. Prigge replied that his proposed location was one that would allow customers to park near the facility. Prigge proposed relocating the new facility to the rear of the existing station building. Upham replied that a building or enlargement could be placed in that area and mee t setback requirem en ts. Following a discussion of alternatives for the location of the new facility, Harper moved to authorize the exten s ion of the non-conforming use at 815 Texas Avenue as long as any such extension is in conformity with the requirements of the Zoning Ordinance. The motion was seconded by Boughton and passes unanimously. Agenda Item No. 4 -Adjourn - Wagner moved to adjourn the meeting. The motion was seconded by Harper and passed unanimously. AT!f..
