Bill Koehler, Building Official, has agreed to fill in for me, The following are my comments of the requests before the Board: Item # 2 -This applicant has shown no unique or special condition of the land. The requested variance would provide for building a carport cover to the property line along Carol Street, The side street setback requirement along Carol Street is 15 feet. Item #3 -This applicant has pointed out the width of the street right- of-way along Puryear as a unique condition. (I pointed this out to the applicant as an example of unique conditions of the land). Puryear Street is only developed along one side of this location. Across Puryear from the applicants location is a City park which provides a large amount of open space. I am uncertain with regards to some of the dimensions shown on Mr. Kuders site plan. (This regards typical deminsions I pointed out to the applicant). I will verify or correct these dimensions prior to the meeting. Jl.qe nda Item No . 2 -Con sideration of an Appeal of a Decision of the Zoning Off icial in t he na me of Paul W. Conrad. Ca llaway expl ain ed the ca se before the Board as being an appeal of the deter- minat i on of his office t o apply Section 6-M .l .(e), Ordinance No. 850 to include a pr oosed clock -tow er sign with chimes. Callaway pointed out that the proposed locat1on, Texas Ave nue a t Dominik Drive, was near a neighborhood from which comp laints abou t noise from the adjacent commercial area have been received. Car.rad explained hi s prop osed sign installation to the Board. After playing a recor~in g of the Westminister Chimes to be utilized in the proposed sign, Conrad stated that the chim es would be played on the hour and half-hour and that the hours of operation of the chimes could be regulated. He further stated that th e c hi me operation would probably be timed to correspond with the bus in ess hours of the adjacent shopping center. Upham asked how the bells could be heard at the south end of the shopping center, one half mile from the sign, and not be heard in the residential area 300 feet from the sign. Up ha m asked i f the ampl ifie r system could be utilized to play tapes and as a pu blic addres s system . Co nra d repl i ed t ha t the sy stem could only play pre-recorded carillion music on ly available from his firm. He followed his reply by playing a tape of the -mus i c that was a va ilable. Mathewson asked if this option was available to the bank (the proposed user of the sign). Conrad replied that it was. Ha rp er asked if there were any comments from the audience. Ka the leen Kene fi ck sta ted that the chimes could possibly disturb a small child. El s i e Lynch s ta ted th at the chimes would constitute just one more noise factor wh ich the nei ghborhood did not need or want. ·Ma thewson as ke d if a .time limit on the hours of operation of the chimes would off s et any problems . Upham stated that any fa vorable action would probable include some such time l i mi t . Authu r Br ight s t ated t hat he had no objections to the chimes, but that he was co nc e rned by an y dev iation from the ordinance, El s ie Lyn c h said that each thing added in the area had depreciated the value o f th eir prope ty . Upha m stated a conc ern for any precedent that might be established by a favorable act ion. Ha r per stated q con cern for protecting the residential area along Kyle Street. Mathe son moved to ove rtide the Zoning Officials denial of the construction of a bP ~1 to wer wi th chimes at the new bank, located at the intersection of Texas Aven ue an d Domi nik, with the following conditions: .ti.. Th e hours of operation of the chimes are from 9:00 a,m. to 8 :00 p ,m.; B. The speakers oriented towards the residential area along Kyle shall not be installed; c. The chime music not exceed sixty minutes of any twenty-four hour period. Foll owin g a disc us s i on o f this problem by the Board, the Board moved to adopt the poli cy of giv ing t he Zoning Official discretion in approving building permits for mo dification to t he primary habitable structure so long as that structure itse lf i s not in non -co nformance, and the non-conformance is due to some ansilur or accessory stru ct ure . There being no opposition, the policy was adopted by commom consent. Agen da Item No. 4 -Ad j ourn. Ca l l aw ay discussed the· problem of not being able to issue building permits for res ide ntial cons truction, remodeling, etc. when there was a non-conforming structure on the lot. Following a discu ssion··of this problem by the Board, the Board moved to adopt the policy of giving t he Zoning Official discretion in approving building permits for modification to the primary habitable structure so long as that structure itsel f is not in non-conformance, and the non-conformance is due to some ansilur or acce ssory struct ure.
