As we discussed , the minutes from the February 19, 1980 Zoning Board of Adjustment (ZBA) meeting do not state the exact variance amount that was granted. I have made the interpretation that since the motion to approve did not state otherwise, the variance amount granted is the same as that which is (somewhat unclearly) requested by Mr. Garrison in the ZBA application dated February 8, 1980. The action requested by Mr. Garrison on page one of the application is "a variance for 45 square feet -5' x 9' .4" -towards Madera Circle." I have interpreted this to be a variance request of 5 feet into the required 25 foot front setback, thereby reducing the front setback to 20 feet. · The enclosed documentation includes the ZBA minutes, application , and other pertinent information from the case . MINUTES City of College Station Zoning Board of Adjustment February 19, 1980 Members Present: Chairman Harper, Upham, Wagner, Daughety, Burke, Council Liason Boughton Members Absent: Mathewson Staff Members Present: Zoning Official Callaway, Planning Assistant Longley Agenda Item No.l -Approval of Minutes, Meeting of January 19, 19 80. Harper moved to approve the minutes of January 19, 1980. The motion was seconded by Upham and passed unanimously. Following the approval of the minutes Harper swore in new Board Members Wagner and Dau.ghety, Harper asked Boughton and Daug·hety to serve as voting alternates to the Board. Agenda Item No.2 -Consideration of a request for a variance in the name of L.A. Garrison, 1008 Madera. Mrs. Garrison stated that she would be available to answer questions concerning the request for a variance. -Callaway asked the Board to consider what constitutes a unique and spe c ial condition of the land. Burke stated that poor construction, resulting in the small size of the existing kitchen, is a unique feature of the land. Upham stated that poor planning may not be a unique feature of the land, but that the Board should use common sense in granting relief where necessary . Upham moved to approve the requested variance to the front setback requirement. The motion was seconded by Wagner. Harper asked for comments on or discussion of the motion before the Board . Harper pointed out that the Board does not have authority to amend the Zoning Ordinance, that approval of a request for which there were no unique and special conditions would constitute a change of the Ordinance and make it difficult to deny similar requests in the future. Harper furthe r stated that there were no unique conditions present in the case before the Board, but that the conditions in this case were com mon to lots in College Station. Upham stated that the case before the Board was a mis-use of the land, that all requests before the Board would be considered on an individual basis, and that he would not have made his motion if he felt that it wouls have se t a precedent. Minutes-2/19/80 Page 2 Robert Feiklman spoke in favor of the request, citing the full approval of adjacent neighbors, and the fact that existing vegetation would screen the extension. The motion before the Board was then voted upon, and passed by the following vote: For: Boughton, Upham, Daughety, Wagner Opposed: Harper Abstaining: Burke Harper appointed Burke to replace alternate Daughety in voting on the following business before the Board. A enda Item No.3 -Consideration of a re uest for a variance in the name of General Telephone, Block 7, Tauber Add -ition 200 Nagle . Callaway presented the staff's recommendation of allowing the front setback included inalternative No.3 with no side setback variance, for the proposed expansion to the telephone exchange building. Representatives of GTE (these individuals did not enter their names into the record and wi 11 herein be referred to as 11 GTE 11 ) presented their three alternatives for expanding the exchange building at 200 Nagle. Alternatives included variances to the front, side, and rear setbacks as necessary to provide the needed expansion. Chairman Harper inquired as to the use of that building as a public office. GTE replied that this was no longer a public office. Upham inquired as to the number of parking spaced available for employees and the number of employees at that location. GTE replied that there would be three or four full time employees at that location with occassional additional employees. Boughton inquired as to whether there is a need for public parking. GTE replied that there was no need for public parking. GTE went on to point out that alternative No.3 was least desirable for their expansion due to cable installations and equipment layouts. Upham pointed out that such problems were not unique to GTE. GTE replied that this is true, but they prefer not to encounter such problem s . Wagner inquired as to the importance to be placed on the fact that GTE is a community serveice. GTE replied that the expansion would provide switching service to the University. Harper replied that the facility was in the public interest and the absen c e of opposition from the area indicated compatability with surrounding uses. Har per stated t ha t due to t he heavy pedestrian traffic, and the fact that GTE uti l i zes st reet righ t-of-way for parking, it would not be unreasonable to requi re GTE t o provi de for a sidewalk through their property . . Callaway poi nte d out that where sidewalks are provided, they are usually l ocated within the street right-of-way, and that the result of Alternative No.2 would be to c r eate a 2 foot overhang of parking into street right-of-way along the _ prop os ed bu i l ding expansion. Following fur th er dis cussion of the alternatives presented by GTE, Upham moved to gran t a varia nce, accepting Alternative No.3, subject to a zero lot line clearanc e a l ong the interior lot line with appropriate firewall construction. Minutes City of College Station Zoning Board of Adjustment Regular Meeting January 15, 1980 Members Present: Chairman Harper, Upham, Mathewson, Bailey, Burke, Council Laison Boughton Staff Members Present: Zoning Official Callaway, Planning Assistant Longley Agenda item No. 1 -Consideration of a request for the expansion of a non-conforming use in the name of Acme Glass, 116 Walton Dr.: Mr. Roger Richards presented his request to expand the existing structure at 116 Walton, utilizing the existing slab at the rear of the building, and explained the previous approval of and expriation of a variance for such expansion. Upham asked if consideration had been given to the location of a dumpster after completion of the expansion. Richards replied that the dumpster would be relocated to a lot across the alley owned by Acme Glass. Harper about clearance from the proposed expansion to the existing utilities. Callaway pointed out that such problem would be investigated as part of review of the building permit application. Harper mo ved to grant the variance for the proposed expansion, as such action was not contrary to the public interest, with the condition that a suita ble location for a dumpster and parking of service trucks be approved by the appropriate City Staff. The motion was seconded by Upham and passes unanimously. Upham mov ed that the Board pass a resolution deploring the conditions and the general nuisance of ranges, hot water heaters, rotted crates, weeds and general atmosphere at Wilson Plu mb ing and that such conditions be reffereed to the appropriate staff. The motion was seconded by Bailey and passed unanimously. Agenda Item No. 2 -Consideration of a request to the Parking requirement for an Arcade, 405 University Drive.in the name of John Paul Jones: Fred Shelton addressed the Board, explaining the parking requirements for an arcade established by the Planning and Zoning Commission, his proposal for an arcade at 405 University Drive, and the lack of space for parking at that location ~ Upha m inquired as to any plans for film machines or pornographic materials within the arcade. Mr. Shelton replied that there would be no such machines Minutes January 15, 1980 Page 2 or materials. Bailey asked for the name of the proposed arcade and the status of the alcoholic beverage permit for that location. Mr. Shelton replied that the arcade would be named the "Pinball Wizard" and that the beverage permit would be voluntarily suspended. T. J. Hurst spoke in opposition to the variance, stating _that parking in the area was inadequate, and that high-density establishments should not be allowed to accumulate. Charles Pinnell, representing the A & M Methodist Church, stated that there was a serious parking problem at the Church, that the area was overloaded with cars and people, and that the granting of a variance would add to the problem. John P. Jones addressed the Board, explaining previous proposals and variance requests. The current request was explained as being an attraction to overflow from other establishments and walk in traffic, thus not impacting the parking problem. Upha m pointed out that there were two parking spaces in front of the proposed arcade, the arcade would require six spaces and the large number of potential · "drive-in" costumers. Bailey asked if the City Planner 1 s memo had been considered. Harper read aloud the Planners memo on parking in the Northgate area and requirements for a variance. Upham complemented J. P. Jones for his efforts. Mathewson stated that he felt there would be no overflow crowd from an arcade such as was being proposed. Harper stated that few persons would drive to Northgate to play pinball. Mathewson stated that the request for a variance for the arcade did not violate the intent of the Planning and Zoning Commission when the parking requirement was established. Bailey stated that he could not agree with Mathewson's interpretation of the Commissions intent. Mathewson moved that a variance be granted in the name of John Paul Jones for an arcade at 405 University Drive, which will not serve alcoholic beverages and will not have an alcoholic beverage permit, in that this does not represent an action in conflict with the public welfare and morals of the citizens of College Station and it is in compliance with the · intent of the Planning and Zoning Commission. The motion was seconded by Harper. Charles Pinnell stated that granting a variance would not encourage ad- dressing the Northgate problem. ( I Minutes January 15, 1980 Page 3 Fred Shelton stated that he cannot justify an investment in the remolding at 405 University unless he can operate a profitable business. The variance request failed by the following vote: For: Against: Harper, Burke, Mathewson Bailey, Upham Agenda Item No. 3 --Consideration of a request for a variance in the name of E.S. Camp, 1809 Sabine Court. Bailey stated that he would abstain from voting on the request. E.S. Camp explained his request for a variance to the rear setback for the const ruction of a cabana for the existing swimming pool. Mr. Camp pointed out existing nonconformities on the site and the odd shape of his lot. Following a discussion of the proposal and its relationship to the neigh- borhood, and the unique shape of the lot, Harper moved to authorize the variance to the rear setback, to the extent of 4.5 feet, on the basis that it is not contrary to the public intrest and that there are unique and special conditions on the land. The motion was seconded by Upham and passed unanimously with Bailey ab- staining. The Board 'then discussed selection of a Chairman at meetings when the ap- pointed Chariman was not in attendance, with the Board determining to select a Vice-Chairman from the members in attendance at any meeting from which the Chairman is absent. The Board also discussed establishing a policy regarding the issuance of building permits for single family structures where on-site non-conform- ities did not involve the main structure.
