The applicant requests a variance to the rear yard
requirements, Ordinance 850, so as to construct a garage
approximately t we l ve (12) feet from the rear property line.

The following specific variation from the ordinance is requested : (See attached
plat.) The proposed new garage is located 25'-0" from the rear property
line of the lot owned by Miss Caroline Mitchell. ·If the center.line
of the alley is used as the common boµndry the variance requested
is approx imately 7'-6".
This variance is necessary due to the following unique and special cond itions of
the laI).d not ·. found in like districts:
Existing drive and curb cut ·remain from original structure. Existing
landscaping, trees and shrubs are situated for old driveway condition.
Strict" enforcement of .the zoning ordinance would result in an
unnecessary hardship for the owner.
The followi ng alternatives to the requested variance are possible:

This variance will not be contrary to the public interest by virtue of the following
fci.ct~: (1) An existing alley of 15'-3" wide insures access ta tb·e
structures in the immediate area. ( 2) The new garage wi 11 be 50' -0"
from the existing garage located on Miss Caroline Mitchell's property,
