. Item No. 2 -Reconsideration of a request for a non-conf orming structure
from Holi9ay Oil CQ_,. Thi s item is b_rought beofre the ZB A on
the requ~st of members of the board at the previous discussion
on December 19, 1978.
Item No. 3 -Consideration of a request fo r a non-conforming structure from
Robert Nash. This is a request to build a 12' X 24' carport
which will violate the se t back requirement from the back lot
line.
Item No . 4 -Consideration of a request for a variance from the parking
requirement from Everett Treadway. This item is brought to the
ZBA as a result of the Pla nning and Zoning Commission's conditional
approval. The variance is to allow Mr. Treadway to build eight
parking spaces for his ·dentist office , instead of the required
16-18 spaces .

November 21, 1978:
Hawley moved that the minutes be approved as presented. The motion
wa s seconded by Jone s and u nanimou sly a p p roved.

Koehler e x plained that the proposed addit i on did n o t itself encroach on
any building line, th a t parkin g me t minimum re qu ireme nts a n d that t he
original b u ild ing d id not mee t r ear setb ack requirements.
Mr. Don Ganter said that he and Mr. Anz owned similar businesses in the
area and that parking and pedestrian traffic conditions were severe. He
said that attr acting mo re such traffic wo uld i n creas e the problem .
Mr . Ge orge Bo y ett said t h a t he a n d o thers rep r e sented by him had c omme r -
cial. prop e rty in the area and rec o gn iz e d p a r k ing and t r affic pro blems.
He offered the opinion that further e x pansion should not be permitted
until po s itive s t e ps had be en t aken to a lle v i ate the prob lems t ha t now
e x ist.
Mr. Holliday said that his plan p r ov ided fo r 14 parking spac es which
exceeds the number of spaces provided by many of the existing businesses
mentioned.
The Chair moved that the request be approved because the conditions of
parking had existed f or some time, b ec ause parking on site was sufficient
for the use proposed and because the proposed construction would not
increase the existing non-conformity. The motion was seconded by Jones.
Hawley commented that the addition of space and change of nature of use
would compound a severe problem which already existed.
Th e motion failed by the following vote:

Agenda Item Numb er 3 --Consideration of a request to expand a non-
conforming structure from Larry Hill:
Koeh:Ler exp lained that th e existing residence did not meet rear setback
requirements and that the propos ed expansion was the addition of a
second story wh ich would not .exceed the horizontal limits of the ex ist-
ing structure. · He pointed out that t he Board had considered and rej e cted
an ear l ier propos al and that this request had corrected objectionable
features of the first proposal. He said that the co oking facilities
would have to be deleted.
Mr. Hil l concured wi.th deletion of the c ooking facili ties .

The Chair moved that the request be granted because the e xtension wi ll
not substantially alter the character of the structure or increase the
non-conformity. The motion was seconded by Harper and una nimously
approved.

Co mm issioner Jones asked what could be do ne to expe dite the install ation of a
traffic signal at the interse ction of Texas Avenue and Southwest Parkway . He
noted that several serious accidents had occur e d at this location and that the
Pol ice Department had stat ed that this was the ~ighest accident rate intersection
in the City at this time.
Mr. Mayo explained that the installation was up to th e Highway Department. He
not ed that th e City was going to put up a su rp l·us igria l at the inters ection,
but that it was intall ed at Jersey and Ti mber inste ad.
The Co mmission discussed the met hod by which th e Highwa y Dpeartment decided on
funding and approval of signal installation s ·.

at 301 University Drive, College Station, Texas. I am
presently operating the station and would like to make an
addition to the present structure. I will continue to use
the present office for the retailing of gasoline, and I
am going to use only the side island on Boyett Street for
the sale of this gasoline. The part of the station where
the three (3) service bay areas are located will be converted
to a game room and I need to construct a nonconforming
structure as shown in my plans which are attached.

As per our phone conversation earlier today, I am sending you
the requested information on the Holiday Oil Compnay request
to the Zoning Board of Adjustment.

stated. This fact had slipped my mind. Th e present of f ice
will continue to serve as his office for the retailing of
gasoline. The side island, on Boyett Stree t, which is presently
in use will continue as the only service island under the
proposed plans.
The proposed addition will be in the amount of 492 square feet.
The property is presently zoned C-1. The reason that this
service station is a non-confirming use is that the lot is
exceptionally small and therefore the building violates the
setback requirement of the Zoning Ordinance No. 850.
The case will be heard Tuesday, December 19, 1978, at .7:00 p.m.
in the Municipal Courtroom of the new Police and Municipal
