Item No. 3 -Consideration of a r e que st f or a n on-conforming struc ture from Robert Nash. This is a requ est to build a 12' X 24' carpor t which will violate the s et b ack requirement from the back lot line. Item No. 4 -Consideration of a request for a variance from the parking requirement from Everett Treadway. This item is brought to the ZBA as a result of the Planning and Zoning Commission's conditional approval. The variance is to allow Mr. Treadway to build eight parking spaces for his ·dentist office, instead of the r equired 16-18 spaces. The motion wa s seconded by Jone s and unanimous l y approved. Age nda Item Number 2 Con s ideration of a request to e x pand a non- c o nforming structure b y Holliday Oil Comp any: Koehler e x plained that the proposed addition did n o t itself encroach on any building line, th a t parki ng me t minimum re quirements and that t he origina l bu ild ing did not mee t rear s e tback requirements. Mr. Don Ganter said that he and Mr. Anz owned similar business e s in area and that parking and pedestrian traffi~ conditions were severe. said tha t att r acting more such traffic woul d i n creas e the problem . the He Mr. Geor ge Bo y ett s a id t hat he a nd other s rep r esented by him had comme r - cial. prop e rty in the are a a nd re cogniz e d parking a nd t r aff i c problems . He offered the opinion that further e x p a nsion should not be permitted until po s itive steps had been t aken to alleviate the p roblems tha t now exist. Mr. Holliday said that his plan prov ided f o r 14 park ing spac es which exceeds the number of spaces provided by many of the existing businesses mentioned, The Chair moved that the request be approved because the conditions of parking had existed for some time, b ecause parking on site was sufficient for the use proposed arid because the proposed construction would not increase the existing non-conformity. The motion was seconded by Jones. Hawley commented that the addition of space and change of nature of use would compound a severe problem which already existed. He po i nted out that the Board had considered and rejected an earlier proposal and that this request had corrected objectionable featur e s of the fir st proposal. He said that the cooking facilities would have to be del ete d. Mr. Hill concured with deletion of tbe cooking facili ties . .... The Chair moved tha t the request be granted be cause the e xten sion will not substantially alter the character of the structure or increase the non-conformity. The motion was seconded by Harper and unanimously approved. Agenda Item Number 1 --Approval of the minutes of the meeting of De cem ber 19 , 1978: Harper moved that the minut es be approved wi t h corre ction. The motion was seconded and u nanimously approved. Agend·a Item Number 2 --Reconsideration of a request for a non-con- forming structure from Holid a y Oil Company , 30 1 University Drive: Koehler r ev iewed te stimony fr om t he previous h ear ing . Hu ghey remarked that the n on-confo r.mity of the existing st r uct u re had n o effect on the traffic problem s cite d at the previous hearing . May o said that the parking plan shown was not workable and would probably not be approved b y the City Engineer . He s aid that the purpose of t he addit ion was to c hang e the business t o a more int e nsive use in terms of tra ffic and that this should not be encouraged in the area. Koehler s aid that if obj ectionabl e spaces were del eted there wo uld s till be enough to meet o rdinance re quirement s . Mr . Holiday said that vehicles now park on t h e site in whatever fashion they c hoose after his business closes, and tha t any o r derly system would be a n improv emen t. Hughey said that the ques tion b e f ore the Board is wh ether or not an add i tion could be ma de t o the st r uct ur e and t hat any parking plan within the limits of the ordinance is not the Board 's bus i ness.
