from Holiday Oil CQ_,. Thi s item :i,s b_rought beofre the ZBA on
the requ ~s t of members of th e board at the previous discussion
on December 19, 1978.
Item No. 3 -Consideration of a r e que st f or a n on-conforming struc ture from
Robert Nash. This is a requ est to build a 12' X 24' carpor t
which will violate the s et b ack requirement from the back lot
line.
Item No. 4 -Consideration of a request for a variance from the parking
requirement from Everett Treadway. This item is brought to the
ZBA as a result of the Planning and Zoning Commission's conditional
approval. The variance is to allow Mr. Treadway to build eight
parking spaces for his ·dentist office, instead of the r equired
16-18 spaces.

Hawley moved that the minutes be approved as presented. The motion
wa s seconded by Jone s and unanimous l y approved.

Koehler e x plained that the proposed addition did n o t itself encroach on
any building line, th a t parki ng me t minimum re quirements and that t he
origina l bu ild ing did not mee t rear s e tback requirements.
Mr. Don Ganter said that he and Mr. Anz owned similar business e s in
area and that parking and pedestrian traffi~ conditions were severe.

He offered the opinion that further e x p a nsion should not be permitted
until po s itive steps had been t aken to alleviate the p roblems tha t now
exist.
Mr. Holliday said that his plan prov ided f o r 14 park ing spac es which
exceeds the number of spaces provided by many of the existing businesses
mentioned,
The Chair moved that the request be approved because the conditions of
parking had existed for some time, b ecause parking on site was sufficient
for the use proposed arid because the proposed construction would not
increase the existing non-conformity. The motion was seconded by Jones.
Hawley commented that the addition of space and change of nature of use
would compound a severe problem which already existed.
The motion failed by the following vote:
FOR: Hughey, Jones, Harper

conforming structure fro m Larry Hill:
Koehler explained that the e x isting r es idence did not meet rear s e tback
r e quirements and that the propos ed expansion was the addition of a
second story which would not .exceed the horizontal limits of the exist-
ing structure. He po i nted out that the Board had considered and rejected
an earlier proposal and that this request had corrected objectionable
featur e s of the fir st proposal. He said that the cooking facilities
would have to be del ete d.
Mr. Hill concured with deletion of tbe cooking facili ties .

The Chair moved tha t the request be granted be cause the e xten sion will
not substantially alter the character of the structure or increase the
non-conformity. The motion was seconded by Harper and unanimously
approved.

at JOl University Drive , Coll ege Station, Texas. I am
presently o p erating the station and would like to make an
addition to the pres ent structu re. I 1ill continue to u se
the p rese nt office fo r the reta ili ng of gasoline , and I
am going to use only the side island on Boyett Street for
the sale of this gas oline . The part .of the station wher e
the three (3) service bay areas are located will b e conv erted
to a g ame room and I nee d t o construct a nonconforming
structure as shown in my plans which ar e attached.
The value of the nonconforming structur e wil l be l ess than
60% of the appraised valu e of the conforming structure.
Als o, the n ew nonconforming structure will be constructed in
s uch ma nner allowing me to return at a future date to the
present conforming structure if necessary.

The reason is that I want to maintain sixteen feet from
the house , the fence on the back side and the fenc e in
the front of the building on Eisenhower st ••

built with 2/4 framing with T 111 siding and composition
roofing on a hip roof. -·

Mr. Darr e l Davis spoke in opposition. He stated that although A-P might be
a realistic zone for th e property, he wa nt ed to s e c a 60 f o o t buff e r.
Mr. Cru se pointed out that he was providin g a 2 5 fo ot s et ba c k rath e r th a n th e
15 foot setback required -by ordinance an d that thi s 25 fe e t plus th e 25 fo ot

1 in ing up on Te xas Avenue turning left into the denti st's office. He also
su g gested that there ·might be some attempts to back out onto Tex as from the
pa rk i_ng area.
Ch airman Stov er stated that the parking area was of adequate design and tha t
such backing m ov~ments would be minimal,

Co mm issione r Jo nes asked what c ould be do ne to expedite th e in stallation of a
traffic sign a l at the inter sec tion of Texas Aven ue and Southwest Parkway. He
noted that several s er ious accidents had occured at th is l ocat i on and t hat the
Pol ice Department had stated that this was th e ~ig h est accident rate intersection
in the City at this time.
Mr. Mayo explain e d th at the installation was up t o th e Highwa y Depa rtment . He
not e d that th e City was going to put up a su r p l us s igria l at t he intersection,
but th a t it was intal l ed at Jersey and Ti mber instead.

presently operating the station and would like to make an
addition to the present structure . I will continue to use
the present office for the retailing of gasoline , and I
am going to use only the side island on Boyett Street for
the sale of this gasoline . The part of the station where

As per our phone conversation earlier today, I am sending you
the requested information on the Holiday Oil Compnay request
to the Zoning Board of Adjustment.
Mr. Holiday does propose to use the three (3) service b a y area
you mentioned for the purpose of installing a gameroom, as you
stated. This fact had slipped my mind. Th e present of f ice
will continue to serve as his office for the retailing of

in use will continue as the only service island under the
proposed plans.
The proposed addition will be in the amount of 492 square feet.
The property is presently zoned C-1. The reason that this
service station is a non-confirming use is that the lot is
exceptionally small and therefore the building violates the
setback requirement of the Zoning Ordinance No. 850.
