Item No. 3 -Consideration of a request for a non-conforming structure from
Robert Nash. Thi s is a r e quest to build a 12' X 24' carport
which will violate the set back requirement from the back lot
lirie.
Item No. 4 -Consideration of a request for a variance from the parking
requirement from Everett Treadway. This item is brought to the
ZBA as a result of the Planning and Zoning Commission's conditional
approval. The variance is to allow Mr. Treadway to build eight
parking spaces for his d en tist office, instead of the required
16-18 spaces.

Ko e hler exp lained tha t t h e propo sed add i tion d i d n o t itself encroach on

original building did n ot meet rear setback requirements.
Mr . Don Gant er said t hat he and Mr. Anz owne d s imilar bus i ne sses i n the
are a and t h at p a rki n g and pedestri a n traf f ic conditions we r e s e vere. He
said t h at at tract i ng mo re such t raffic would i ncre ase t h e problem.
Mr. George Boyet t sa i d that h e a n d others rep resented by him had commer-
c ial p r o perty in the a rea and r eco gn ized parkin g and traffic problems .
He off e r ed the opini on that furthe r e x p a n s ion should not be permitted
until p ositive steps had been taken to allev iate the pro blems that now
e xis t.
Mr. Holliday said that his plan provided for 14 p arking s p aces which
e x ceeds the number o f spaces provided by many of the exist ing businesses
mentioned,
The Chair moved that the request be approve.cl because the conditions of
parking h ad ex isted for some time, because parking on s i t e was suf fici ent
f or the u s e proposed arid because the proposed construction would not
increas e the e x isting non-conformity. The motion was seconded by .Jones.
Ha wley c omm ented that the addition o f s p ace and c h a nge of nature of u se
would comp ound a severe problem which_ already exi s ted.

Ag e nda Item Number 3 --Consideration of a request to expand a non-
conformin g structure from Larry Hill:
Koehler explained that the existing r esidence did not meet rear setback
requirements and that t he propo sed expansion was the addition of a
second story which would not e xceed th e ho rizont a l limits of t he exist-
ing structure. He pointed out that the Board had considered and rejected
an earlier proposal and that this request had cor.rected obj ectiona.ble
features of the first proposal. He said that the cooking facilities
would have to be del eted.
Mr . Hill concured with d eletion of the cooking fac ilit ies . .•
The Chair moved that the re que st b e granted because the extension will
n ot substantially alter the character of the structure or increase the
non -c onformity . The motion was seconded by Harp er and unanimously
approved.

Dear Sir:
I have leased the Phillips Si x t y -Six Self Servic e Station
at JOl University Drive, College Station, Texas. I am
presently op erating the station and would like to make an
addition to the pres ent structure. I will continu e to u se
t he present office for the reta iling of gasoline. and I
am g oing to use only the side island on Boye tt Street for
the sale of this gasoline. Th e part of the station where
the three (J) service bay areas are located will be converted
to a game room and I need to construct a nonconforming
structure as shovm in my plans wh ich are attached.
The value of the n on conformi n g stru cture will be l ess than
60 % of the appraised value of the conforming structure.
Also, the new nonconforming structure will be constructed
such mann e r allowing me to return at a future date to the
present conforming structur e if necessary.

to sixteen feet. •
The reason is that I want to maintain s i xteen feet from
the house , t he f ence on the bac k side a nd the fence in
the front of the building on Eisenhower st ..
I am g oing to build a t welve foot by twenty f our f oo t
carport and s t orage building,mostly s torage .It will be ·
built. with 2/4 framing with T 111 siding and comp os ition
roofing on a hip roof. -

traffic signal at the int ersect ion of Tex as Avenue and Southwest Parkway. He
noted that several serious accidents had occu red ~t th is locatio~ and that · the
Pol ice Department had stated that this was th e ~i~hest acc ident rat e i ntersection
in the City at this time.
Mr. Mayo expl a in e d that the installation was up to the Highway Department. He
not e d that th e Ctty was go i ng to put up a surplus s i~na l at the in tersect ion,_
but that it was intalled at J e rs e y and Ti mber inst ead.

Agenda Item Number 1 --Approval of the minutes of the meeting of
Dec ember 19, 1978:
Harper moved that the minutes be app r oved with correct ion . The
motion was· seconded and unanimous ly approved.
Agenda Item Number 2 --Reconsideration of a request for a non-con-
forming structure from Holiday Oil Company , 301 University Drive:
Koehler reviewed testimony from the previous hearing. Hu ghey
r em arked that the non-con fo r,mity of the exist ing struc ture had no
effect on the traffic problems cited at the previous hearing.
Mayo said that the parking plan shown was not workable and would
probably not be approved by the City Engineer. He said that the
pur po se o f t h e add ition was t o chan ge the bus i ness to a more intensive
use in terms of traffic a nd that this should n ot be encouraged in the area.
Koehler said that if ob jectiona ble sp a ces were deleted there would
still be enough to meet ordinance requirements.
Mr. Holiday said that vehicles now park on the site in whatever fashion
they choose after his business clo ses , a n d t hat any orderly system would
be an improvement.
Hughey said that the question before the Board is whether o r not an
addition could be made to the s t ructure and tha t ·any parking plan within
the limits of the ordinance is not the Board 's business.
The Chair moved that the request be a p proved because the conditi ons of
parking had existed for some time;becuase p arking on the site wa s s u f-
ficient for the use proposed and because the proposed construction would not
increase the existing non-conformity. The motion was seconded by Harper
and was approved by the following note:

Har p er said that h e could see no inf ormat i on to show the reason for
hardship, if any, or any unique condition nec es s itating this particu lar
plan.
The Chair moved that the request oe taole ~ until , fur ther information
could be ootained. The moti on was seconded b y Jones. The Board
discussed the fact that the City would now be faced wi th the expense
o f re-publication and notification. The motion and second were
wi thdrawn .

Ma y o said that the Planning Comm ission had approved t he Conditional Use
Permit and .a p arking plan for the numoer of spaces proposed , out that
the Board wo uld s til l have to determine whether ox not a v arian c e should
be granted to a llow t he re duced n umoe r of spaces. He said that the
reason offered for the variance is that the nature of the p ractice does
n ot require this numoer of spaces and that the app l i c a nt is not utilizing
al l o f the area of the existing structure which influences the parking
requirement·. He said that he questioned any showing of conditions of .
the land. Koehler said that this use in a residential z one required
a conditional use permit and that no change in use could be made, o ther
than reversion to a residence without obtaining a new use permit.
He said that this could oe t aken as . a feature of t he land.
The Chair mo ved that thevariance be granted becau se use of the prop erty
required a conditional us e pe rmit a nd because the required number of
spaces were not necessary to this permitted use. The motion was seconded
by Harper and unanimously a pp roved .

Mr. Bormann stated that th e residents were not affraid of the A-P zoning but
that they had no assurance that the plan would be built as shown by Mr. Cruse .
Mr. Darrel Davis spoke in opposition. He stated that although A~P might be
a rea l is~ic zone for the property, he wanted to see a &O f oot buffer.
Mr. Cruse pointed ou t that he was providing a 25 foot setback rath e r than the
15 foot setback required by ordinance and that this 25 feet plus the 25 foot
setback of the houses on Mile Drive left a 50 foot undeveloped strip.
Commissioner Jones stated that he felt the 60 fo ot buffer was not a realistic
demand. He also pointed out that if the property were left R ~l, it could be
develo pe d into small lots with small houses which would have an adverse effect
on · the value of houses on Mile Dri~e.
Th e public hearing was closed.
Commissioner Mathewson moved that the Comrni.sston r:ecornmend C!pprovC!l of the

he would only have two patlents overlapping at any one time, He explained that

and as many nurses ernpolyed. He stated that he w6uld have only himself and
one nurse-receptfontst in the buildtng , He advised that the rest of the space
v-1ou 1 d be used for · a 1 ab and a darkroom .
Commissioner Sweeney stated that he felt a problem could be created by people
lining up on Texas Avenue turning left into the dentist 1 s office. He also
suggested that there ~ight be some attempts to back out onto Texas from the
PC!rki _ng area.
Chairman Stover stated that the parking area was of adequate design and that
such backing movements would be minfmal .
Commissioner Mathewson moved that the permit be granted on the following con-

Commissioner Jones asked what could be done to expedite the ins ta lla tion of a
traffic signal at the intersection of Texas Av e nue and Southwest Parkw a y . He
noted that several serious accidents had occu red ~t this locatio~ and tha t the
Pol ice Department had stated that this was the highest accident rate in tersection
in the City at this time.
Mr. Mayo explained that the installation was up to t he Highway Department . He
noted that the Ctty was going to put up a su rp lus s igna l at th e intersecti on,
but that it was intal Jed at J ersey and Timbe r i nst e a d .
The Com miss ion discussed the method by which t he Highway Dp eartme nt decid e d on
funding and approval of signal installations~

Agenda Item Number 1 --Approval of the minutes o f the meeting of
December . 19, 1978:
Harper moved that t he minutes be approved with corr ec tion. The
motion was· s econded and unanimously app r ove d.
Agenda Item Number 2 --Reconsideration of a request for a non-con-
f o rming structure fro r'.1 Holiday Oil Company , 301 University Drive:
Ko e hler revi e wed test imony fro m the prev ious hearing. Hughey
remarked th a t the n on-confo r,mity o f the existing structu re ha d no
effect on the traff ic problems cited at the previous hearing.
Haya said that the parking plan shown was not workable and would
probably not b e appr o ved by t he Cit y Eng ineer. He said that t he
pu rpos e o f the add i tion wa s to change the b u sines s t o a more intens ive
use in t erms of t raffic a nd th at this · s h ould not be encouraged i n t he a r ea.
Koehler s a id that i f ob jectionable spaces were dele te d there would
still b e enough to m22t ordinance r equirer.ie n ts ·.
Nr. Holiday .said that vehicles now park on the site in whatever fashion
they_ choose after his business close"s , and that any orderly system would
·be an improvement •
Hughey said that the question before the Boa rd is whe ther or no t an

Mayo said that the Planning Co mmission h a d approved the Cond itiona l Use
.Permit and a parking plan for the number of spaces proposed, but that

be granted to allo~.r the r e duce d number of s paces . He said that the
reason offere d for the variance is that the nature of ·the practice doe s
not r equire this m:mber of spaces and t h .::.t thP-applicant is no t utilizing
all of the area of the existing structure whic h influences the parking
requirement. He said that he questioned any showing of conditions of
the land. Koehler said that this use in a residential zone required
a condition~l use permit and that no change in use could be made, other
than reversion to a residence without obtaining a new use permit.
He said that th is could be taken as a feature of the land.-
The Ch air moved that the v ariance be granted because use of the property
required a conditional use permit .and because the required number of
spaces were not necessary to this permitted use. The motion was seconded
by Harper and unanimously approved.

December 19, 1978:
Har per moved that the minutes be approved with corre ction. The
mo tion was s e conded and unanimously approved.
Agenda Item Number 2 --Reconsideration of a request f or a non-con-

Koehler reviewed testimony from the previous hearing. Hughey
remarked th at the non-conf o r.mity o f the existing st ruct ure had no
effect on the traffic problems cited at the previous h ear ing .
