Item No. 3 -Consideration of a request for a non-conforming structure from Robert Nash. Thi s is a r e quest to build a 12' X 24' carport which will violate the set back requirement from the back lot lirie. Item No. 4 -Consideration of a request for a variance from the parking requirement from Everett Treadway. This item is brought to the ZBA as a result of the Planning and Zoning Commission's conditional approval. The variance is to allow Mr. Treadway to build eight parking spaces for his d en tist office, instead of the required 16-18 spaces. Mr . Don Gant er said t hat he and Mr. Anz owne d s imilar bus i ne sses i n the are a and t h at p a rki n g and pedestri a n traf f ic conditions we r e s e vere. He said t h at at tract i ng mo re such t raffic would i ncre ase t h e problem. Mr. George Boyet t sa i d that h e a n d others rep resented by him had commer- c ial p r o perty in the a rea and r eco gn ized parkin g and traffic problems . He off e r ed the opini on that furthe r e x p a n s ion should not be permitted until p ositive steps had been taken to allev iate the pro blems that now e xis t. Mr. Holliday said that his plan provided for 14 p arking s p aces which e x ceeds the number o f spaces provided by many of the exist ing businesses mentioned, The Chair moved that the request be approve.cl because the conditions of parking h ad ex isted for some time, because parking on s i t e was suf fici ent f or the u s e proposed arid because the proposed construction would not increas e the e x isting non-conformity. The motion was seconded by .Jones. Ha wley c omm ented that the addition o f s p ace and c h a nge of nature of u se would comp ound a severe problem which_ already exi s ted. He pointed out that the Board had considered and rejected an earlier proposal and that this request had cor.rected obj ectiona.ble features of the first proposal. He said that the cooking facilities would have to be del eted. Mr . Hill concured with d eletion of the cooking fac ilit ies . .• The Chair moved that the re que st b e granted because the extension will n ot substantially alter the character of the structure or increase the non -c onformity . Agenda Item Number 2 --Reconsideration of a request for a non-con- forming structure from Holiday Oil Company , 301 University Drive: Koehler reviewed testimony from the previous hearing. Hu ghey r em arked that the non-con fo r,mity of the exist ing struc ture had no effect on the traffic problems cited at the previous hearing. Mayo said that the parking plan shown was not workable and would probably not be approved by the City Engineer. Hughey remarked th a t the n on-confo r,mity o f the existing structu re ha d no effect on the traff ic problems cited at the previous hearing. Haya said that the parking plan shown was not workable and would probably not b e appr o ved by t he Cit y Eng ineer. He said that t he pu rpos e o f the add i tion wa s to change the b u sines s t o a more intens ive use in t erms of t raffic a nd th at this · s h ould not be encouraged i n t he a r ea. He said that the reason offere d for the variance is that the nature of ·the practice doe s not r equire this m:mber of spaces and t h .::.t thP-applicant is no t utilizing all of the area of the existing structure whic h influences the parking requirement. He said that he questioned any showing of conditions of the land. Koehler said that this use in a residential zone required a condition~l use permit and that no change in use could be made, other than reversion to a residence without obtaining a new use permit. He said that th is could be taken as a feature of the land.- The Ch air moved that the v ariance be granted because use of the property required a conditional use permit .and because the required number of spaces were not necessary to this permitted use.
