Ringer moved that the minutes be approved as pre sented . The motion
was seconded by Hawley and unanimously approved .
Agenda Item Numbe r 2 --Consideration of a request for a varianc e
from Robert Nash , 301 Poplar Street:
Harper revie~IBd the Board 's previous consideration s of the matter. (Hughey
joined the meeting , but did not assume the chair). Mr . Nash explained
his submissions and his absence from previous meetings . He explained that
the position of major trees blocked vehicular acce ss to a structure
except i n this location . He said that further expansions could be made
without harm to the trees .
Mr . Wilcox introduced his mother 's letter of March 17 , 1979 and said that
their conc ern 1 s were a possible restriction of use of their property and
a deter i oration of present value of their property due to cro~tling on
the ad j acent property. He said that th ere is room on the property for the
construction within the setback r equirement .
~ughey asked what unique circumstance existed . There ~~s no reply.
Mr . Broushard pointed out his adjoining property and said that he had
no objection .
Koehler said that there would be no effect on adjoining setback, that he
had no specifics about Mrs . Arnold 's ob j ection and that he could see no
detriment to the City 's interest i n the proposal .
The Chair mo ved that the variance be granted because there was no detriment
to the public interest . The motion was seconded by Ringer and failed by
the f o l lo~tlng vote :

Koehler said that he had not recommended to the applicant that he be
present . The Board agreed that a repre sentat i ve of the applic ant shou ld
hen ceforth be present in each case .
Koehler explained that the di screp ancy had been found by a survey and
that it would be difficult to detect otherwise . He pointed out that the
house was complete CLDd Ci ty inspectors had not noticed the probl em.
Harper sai d that this appeared to be a serious brea_ch of public open
space . Hughey remarked that a variance pre vented the-City from making
fur ther compl aint . Koehler explained that a comp l aint could be filed
in Mun icipa l Court a gai nst the builder for having deviated from plans,
but that the trauma of a failure of c l osing wh en an enchroachment is
di s covered renders further penalty superfluous. Ringer remarked on the
hardship of r em oving a part of the structure.
Harper said that if a var iance is granted , the structure thenceforth
as sumes the status of a non-conforming structure and than any further
building permits , except for interior remod eling , must have the p er-
mission of the Board .

a non -conforming u se from Jerry Ma jors at 107 College Avenue :
Koehler summar iz ed the pr oposal and explained the previous variances .
Mr. Ma jors de s cribed his propo s ed structure and said that he had rented
adj acent property for parking , but that hi s bus i ness was mostly p ede -
strian .
Harper ask e d about notification . Koehler said that i t had not been
sent for this proposal , but it wa s not r e quired except by policy.
He said that the notice would be identi cal to that g iven for the last
month 's action and that the adjacent ovmers were the lessor s to this
bus iness . He remarked that any use of the property interfered vdth
traffic and was , to that extent , detrimental to a publ ic interest, but
that thi s would be so whether or not the extensionnis allowed. Harper
remarked that the overall public intere st is unclear in this case .
The Chair mov ed that the exten s ion be a l lowe d b ecause of the unique
shape of the land and becau s e no substantial de t riment to the public
i nterest can be identified . The motion was seconded by Ha wley and
unanimou s ly approved .

Dr . McMath brought to the Board 's attention that his firm had mod ified
building plans to add 2000 square feet of buil ding area and explained

-the effect on the previous variance to p arking requirement s . The Board
concurred that the varia..r1ce was .n ot affe cted by the additional area .
Dr . McMath said that his project designers were unaware of the r estriction
on detached signs . He pointed out that the size and configuration of his
tract was such that the l;mit should not reasonably apply . He pointed
out that i:f the properties we r e seperately oi..med more signs ·would be
allowab l e . He said that his firm 's op eration was substanti all y different
fr om r etail u ses and therefor uni que , and that he could imagine no
detriment to the public :L~terest . He said that the distances involved
made any s ingle sign ineffective and thus created a hardship.
The Board discussed . the question of th e logic of the regulation and agreed
that the proposal was not ob jectionable . Th ey discus sed the delay
i nvolved in obtaining an ordinance amendm en t . They agreed that the problem
had to do with the provi s i on of the ordinance not being appropriate
or applicable to thi s size of tract, and that a variance would amount
to changing the ordinance .
Ko ehler recommended that the variance be denied in favor of recommending
to the Counc i l to change the ordinance because he could see no circum-
stance of this tract that wa s not true of any substantial commercial
tract in t h e City, He said that he felt that the public interest ·would
be served by change of ordinance rather than stretching the variance
procedur e .
Hu ghey moved that the r equest be tabled until the next regular meeting
of the Board where the progress of an ord inance change could be eval-
uated . The motion was seconded by Hawley and un an imously approved .
The Board asked the Council Liaison to convey t o the Council and
Commission their recommend a t ion to con s ider a c hange in the ordinance
in as early an action as possible .

1 . The request for variance at 2817 Celinda results from
the builders having erred in locating the house on the lot.
This is a very easy mistake to make on a cul-de-sac, and
it is also likely to escape the notice of the inspector.
The problem in this case was discovered by the surveyor
preparing a plat for finance purposes .
The house has been completed since June , 1978 . The hard-
ship involved in removing it is obvious . The problem is
difficult to discern ;athout measurement and the purpose
of open space requirements on this lot appears to be ful-
filled .
2 . Mr . Nash should be present to explain his request . TVJO
of the persons notified have expressed their opposition to
the proposal.
Mr . Nash has erected a temporary structure which vdll have
to be removed if it is not portable. We have not investi-
gated the structure at this time .

I have received y our notice r egarding the request for a non-conforming
structure on the above-captioned lot .in the mail today. Inasmu ch as I
reside in Dallas and it is i mpossible f e>r me to rearrangO ''I!Y work schedule
on such shart notice to be able to be present at the meeting on 'IU.esday,
March 20 , 1979, I would like to submit this letter as a protest.
I own the lot directly adjacent to the lot in q!lestion . My concern is
that granting this variance could cause some problem in the future .
If a new building were erected on my lot , and if I am c:>rrect in inter-
preting the set-back cited on the inf Jrmation sheet tor ~p Zoning to be
the same ·a s that of C Zoning , -vihich wo:ild permit l:>t line b:iilding, this
would not l ea ve the necessary 15 feet b etween structures . /1lso , I am
c oncerned that if I •·iere to sell my lot in the future , the overbuilding
on the adjacent lot mi ght might be harmful to the value of rr..y property.
'Ihereiore, I do not feel this variance should be arbitrarily granted .
nor is :. (~ssential ,since there is adequate space to b!.tild this structure
within the permitted area on the l ot.
1lhile I ieel there is no hardship inv~lved, but merely a preference,
>-ihich would not seam to me to be adequate grounds for violating the City
Ordinance, I do not want to incon11enience the adjoining own~r and would
have no objection t' his erecting a portable structure to serve his
purpose in :.the set-back area, as it COLlld be moved later on if necessary.

to sixteen feet.
The reason is that I want to naintain 'sixteen feet f.rom
the house , the fence on the back side and the fence in
the front of the building on Eisenho~er St ••
I am going to build a t~elve foot by twenty four foot
carport and storage buildlng,mostly storage.It will be
built with 2/4 framing with T_111 siding and co;nposition
roofing on a hip roof.
The lot is #5 in the College Vista division BK.B. It is
on the co~ner of Eisenhower and Popla r. It is z oned R/2
duplex ••

This l etter is in referance to the storage building
I want to build. First of a ll I :recieved a letter
from City Hall saying there would be a mee ting on.
Tuesday night but it didnt say that I had to be .
their. ·But the reason I missed· t he mee·ting was -··
because I had to work late.I typad the information
asked for and bought it in to Miss Albraght
But ·my problem is if' I move the storage building
closer to the house I would have to cut do~ a
tree that I wa."'lt to save.And if' I join it to the
house I would have to cut some large limbs off
atree and that rrnuld kill the tree.Also it would
make it hard to g et a concrete truck in to pour
a slab for an add on to the house.
The ~is zoned for duplex and sometime in the
fJ f?ert
future I have intentions of adding on between the
house and storage building.If this plan would be
approved now, this would result in a lower· construction
cost in the futu_re.

imous vote.
The Board is required oy ordinance and by statute. to grant
variances only when the following facts are shown oy testi-
mony or other evidence suomitted by the applicant :
1. Th ere is some unique and specia l condition of the land
not normally found in like di st ricts .
2. Following the r equirements· of the ordinance would
result in unnecessary hardship.
3 . Approval will not be contrary to the public interest .
The Board cannot grant any variance where all of these facts

1 . The applicant claims that the ordinance does not define
a plot of land . This is incorrect.
Section l-D .14 specifically defines a building plot as being
11 bounded by the property line".
When Section 8-D.6 prohibits more than one detached sign on
any one building plot, it is speaking of that area of land
under one oimership without regard to any number of contiguous
seperately described tracts of which the ownership may be com-
posed , and without regard to any leases or other private agree-
ments .
2 . The fact of so large an area of land being restricted to
one sign appears illogical , but it is certainly not unique.
Most of the recently developed retail commercial tracts have
similar frontage and, in addition, have multitudes of seperate
tennants with more definable outdoor advertising needs . They
abide by this ordina.~ce as it is written .
3. The applicant does not attempt to show any element of
hardship. If the applicant has funds available for outdoor
advertising, a portion of these funds may well be required to
remove the existing sign . The planning and graphic design he
may have to do to combine the purposes of both signs into one
structure are not unusual requirements and are done regularly
by other businesses of lesser size and, presumably , lesser
resources .
4. The applicant does not address the public interest. In my
opinion, the public interest ~~uld be served best by a regu-
lation which would recognize the obvious differences between
a 37 acre tract with frontage on major roads which are not
intervisible, and a 50 foot wide commercial lot in a strip
of such lots . This , ho wever , is a legislative function which
should lie with the City Council.
If the Board grants this variance , we may be assured of an
inundation of such requests and would have no means to decide
among them . The Council , if they saw fit to change the ordi-
nance , could also specify the criteria which would justify
more than one sign . ·
5. I recommend that the Board consider denial of the variance
a nd recommend to the applicant and t o the Council that the
present ordinance be amended with respect to the number of
detached signs on large tracts . The applicant may initiate
such a change in the . same fashion that "re-zoning" petitions
are made .

The primary reason for appearing before the Zoning Board of
Adjustment is to request a clarification, and variance if
necessary, to allow Agency Records Control, Inc. to install
a second detached sign on its property.
In addition to the abov e request, ARC cur rently has a park-
ing variance in effect and wishes to inform the Zoning
Board of Adjustment of a minor change to one of the existing
buildings. Either myself or some other ARC representative
will be present at the meeting to answer questions anyone
might have . If you have any questions prior to the meeting,
please give me a call.

The Zoning Board of Adjustment will consider a request for a non-conforming
structure from Mr. Robert Nash, 301 Poplar, at their regularly scheduled
meeting at City Hall at 7:00 P.M., Tuesday, March 20, 1979, the nature of
the meeting being as follows:
The applicant requests permission to build a non-conforming
structure. The structure, a storage unit, will violate the
set-back requirement of the Zoning Board of Adjustment.
