Box 4213 Bryan, Texas 77801 Dear Mr. Boyd: This is your confirmation that this office has determined that you~ proposed chain link fence with plastic blinds installed .does not meet the requirements of Sec. 6-J, Ordi- na nce 850, for use as a screening fence. Your requested appeal of this determination will be forwarded to the City of College Station Zoning ,Board _of Adjustment as per our telephon e convers a tion of May 4, 1979. Said appeal will be presen ted to the board on May 15, 1979 at 7:00 P.M. in the Council Ch am bers, City Hall, 1101 Texas !\venue. Please f orward to my office a written request for this appeal, stating your reasons for requesting said appeal, so that this infor- mation may be for warded to the board. Enclosed pl ease find a copy of pages 29 and 30 of Ordinance 850. Section 6-J sets forth the requirements for screening fences. ' "'· ( ( MEMBERS PRESENT: MEMBERS ABSENT: VISITORS PRESENT: MINUTES ZONING BOARD OF ADJUSTMENT May 15, 1979 Chairman Harper, Bailey, Boughton, Mathewson Jones Zoning Official Callaway, Planning Assistant Longley AGENDA ITEM NUMBER 1 -Approval of the Minutes of the Meetings of March 20, 1979 and April 17, 1979: Chairman Harper reported that copies of the Minutes of March 20, 1979, had been forwarded to those former board members who had served on the Board at that meeting and that these Minutes were acceptable to all such former members he had been able to contact. Mathewson moved that the Minutes of the meeting of March 20 be approved. The motion was seconded by Bailey and unanimously approved. Mathewson moved that the Min~tes of the meeting of April 17, 1979 be approved. The friotion was seconded by Boughton and unanimously approved. Chairman Harper advised the Board that items number three (3) and four (4). had been withdrawn, leaving only item number two (2) for the Board 1 s consideration . AGENDA ITEM NUMBER 2 -Consideration of a Request for a Variance from Agency Records Control. Mathewson stated that the Zoning Board of Adjustment's function in the case is a moot question, that the variance should be denied, that the question of a second detached sign should be addressed by the Planning and Zoning Commisssion by an amendment to the Ordinance, and that the item should be taken off the table so as to dispose of the case. Dr. Wallace McMath stated that he felt the Board had indicated in the past that if an ordinance providing for a second detached sign was not adopted the Board would provide for such a sign by granting a variance. Chairman Harper stated that there were no unique and special circum- stances existed as necessary for the basis for granting a variance j o-r the Agency Records Control Site. Chairman Harper moved that the requested variance for a second detached sign, as requested by Agency Records, be approved because a hardship existed and there was no detriment to the public interest. The motion was seconded by Mathewson and failed by the following vote: Aye: None Against: Unanimous OTHER BUSINESS: Mathewson suggested that the Zoning Board of Adjustments not hear any variance request which required action on the part of the Planning and Zonfog Commission unless such variance was first presented to the Commission with the Board hearing appeals only. .. · ( ( ( . I I I Mi.nutes -2- The Board reaffirmed its policy of requ1r1ng that all request for a variance having been formally refused a building permit prior to submission to the Board. The Board further stated that any item which would require consideration by the Planning and Zoning Corrmission as well as action by the Board be considered first by the Planning and Zoning Commission prior to submission to the Board and that the Corrmission be requested to forward recommendations where appropriate. Said fence is required by ordinance alon~ lots 4 and 5, block C, College Heights Addition.
