The request for a variance to allow a second detached sign on the Agency Records Control site (agenda item No. ?.) was pre- viously tabled and has been placed on this agend a at the di_rect t on of the Board. This r equest was tabled until the Board could determ ine what prog r ess had been made with regards to addressing t he ques tion of more t han one detached sign on a large tract by amendment to the existing ordinance. At this time the City Planner is pr eparing an amend ment t o the Zoning Ordinanc e t o address this and several sign related pr obl ems . This is bein g done a s dire cted by th e Plan nin g and Zo ning Co mmission. There are several important points the Bo ard should consider in addressing this request: (1). The probl em o f being limited to one de tached sign for a large tract is co mm on to all large co mmercial deve - lopments in College Station. Culpepper Pla za, K-M art, , and Fed Mar t ar e prime examples._ ( 2). 1 _\[he granting of a variance in this case wou d amount to changin g th e ordinance, setting a precedent for other large tracts to follow without establishing proper guidelines. (3). An ordinance to address this problem is being prepared. We do not yet know whether or not this ordinance will provide for an additional sign for industrial situations. -(4.). Although there will be some 11 delay 11 for ARC ·to wait for the passage of an amendment, I do not feel ·that the fact that a contract to violate the Zoning Ordinance has been entered into by ARC constitutes a justifiable hardship. 2. Mr. Bruce Boyd, 503 Eisenhower, is preparing to move into his new office facility at that address (agenda item No. 3). He is required by ordinance to erect a screeni ng fen c e between his office facility and the adjacent developed residential properties . • Memorandum Page 2 Mr. Boyd proposed to construct a six (6) foot chain link fence along his property line and install plastic "blinds" to provide screening. However, after examining two similar fences, I felt that I could not accept such an installation as meeting the requirements of Section 6-J of the Zoning Ordin an ce. I feel that Mr. Boyd has a justifiable basis for appeal as he was advised when he applied for his building permit that such an instal- lation would be acceptable. This type of fence was accepted by the Building 0fficial during the time he was responsible for interpreting the Zoning Ordinance. However, I cannot find any such fences that were indeed accepted as a required screen fence . Examples of this type of fencing may be seen at: (1). Behind Pepper Tree Apartments along the rear edge of the parking lots. (Pepper Tree is located off Longmire Drive in Southwood Valley). (2). Around the back yard of a home located at the northwest Earner of the inteisection of Munson and East Woodland Parkway. 3. An application has been received in the na me of Charles Johnson for a varianc e to the rear yard requirement f or a proposed rental storage facility (Agenda Item No. 4). The applicant has requested that this item be forward ed to the Board as he feels that his proposal would be " ... best suited ... " for that location (please see attached application). The app licant claims that the or dinance does not define a plot of l a.Dd. This i s incorrect . Section l -D.14 specifically defines a building plot as being "bounded by the property line". Whe n Section 8 -D.6 prohi bits more than one de tached sign on a.~y one buil ding plot, it is speaking of that area of land und er one o~mership without regard to any nuinber of contiguous seperately describ ed tracts of which the ovmership may be com- posed , and without r egard to any l eases or other private agree- ments . 2 . The fact of so large a,.vi area of land bei ng restricted to one sign appears illogical, but it i s certainly not unique . Most of the recently developed retail commercial tracts have similar frontage and , in add i tion , h ave multitudes of seperate tennants with more definable outdoor adverti sing needs . They abi de by thi s ordinance as it i s written . 3 . The app l icant does not attempt to show any element of hardship . I f the applicant has funds availabl e for outdoor ad vertisi ng , a porti on of t h ese funds may we l l be required to remove the existing sign . The planning and graphic design he may have to d o to combine the purposes of both signs into one stru cture are not unusual requirements and are done regularly by other bus ines s es of lesser size a nd, presumably , lesser resources . Page 2 4. The applicant does not address the public interest . In my opinion, the public interest would be served best by a r egu- lation which would reco gn ize the obvious differences between a 37 acre tract with frontage on major roads which are not intervisible , and a 50 foot wide commercial lot in a strip of such lots . This, howeve r, is a legislative fun ction which should lie with the City Council . If the Board grants this variance , we may be a ssured of an inundation of such requests and would have no means to decide among them . The Council, if they saw fit to change the ordi- nance , could also specL.-"y the criteria whic h would justify more than one sign . 5. I recommend that the Board consider denial of the variance and recommend to the applicant and to the Council that the present ordinance be anended with respect to the number of detached signs on larg e tracts . The applicant may initiate such a change in the same fashion that "re-zoning" petitions are made . Consideration of a request for the expansion of a non- conforming structure in the name of Phillip Noe. 4. Other Business. 5. Adjourn. ( I ( mNUTES ZONING BOARD OF ADJUSTMENT May 15, 1979 MEMBERS PRESENT: Chairman Harper, Bailey, Boughton, Mathewson MEMBERS ABSENT: Jones VISITORS PRESENT: Zoning Official Callaway, Planning Assistant Longley AGENDA ITEM NUMBER 1 -Approval of the Minutes of the Meetings of March 20, 1979 and April 17, 1979: Chairman Harper reported that copies of the Minutes of March 20~ 1979, had been forwarded to those former board members who had served on the Board at that meeting and that these Minutes were acceptable to all such former members he had been able to contact. Mathewson moved that the Minutes of the meeting of March 20 be approved . The motion was seconded by Bailey and unanimously approved. Mathewson moved that the Mfn~tes of the meeting of April 17, 1979 be approved. The motion was seconded by Boughton and unanimously approved. Chairman Harper advise'd the Board that items number three (3) and four (4), had been withdrawn, leaving only item number two (2) for the Board's consideration. AGENDA ITEM NUMBER 2 -Consideration of a Request for a Variance from •'' .. Agency Records Control. Mathewson stated that the Zoning Board of Adjustment's function in the case is a moot question; that the variance should be denied, that the question of a second detached sign should be addressed by the Planning and Zoning Commisssion by an amendment to the Ordinance, and that the item should be taken off the table so as to dispose of the case. Dr. Wallace McMath stated that he felt the Board had indicated in the past that if an ordinance providing for a second detached sign was not adopted the Board would provide for such a sign by granting a vari'ance. Chairman Harper stated that there were no unique and spectal circum- stances existed as necessary for the basis for granting a variance for the Agency Records Control Site. Chairman Harper moved that the requested variance for a second detached sign, as requested by Agency Records, be approved because a hardship existed and there was no detriment to the public interest. The motion was seconded by Mathewson and failed by the following vote: Aye: None Against: Unanimous OTHER BUSINESS: Mathewson suggested that the Zoning Board of Adjustments not hear any variance request which required action on the part of the Planning and Zoning Commission unless such variance was first presented to the Commission with the Board hearing appeals only. ( ( ( Mi.nutes -2- The Board reaffirmed its policy of requ1r1ng that all request for a variance having been formally refused a building permit prior to submission to the Board. The Board further stated that any item which would require consideration by the Planning and Zoning Corrmission as well as action by the Board be considered first by the Planning and Zoning Commission prior to submission to the Board and that the Commission be requested to forward recommendations where appropriate. Dexter Mr. Hickman will apply for the appropriate permit upon the Board's approval of the additions to the structure. The permit will reflect any changes necessary to make the structure sound as well as the work which has been completed without a permit. Mr. Hickman has obtained the services of an engineer to specify any necessary changes in the structure and permit approval will be based upon that engineer's reco mmendations. Should the Board choose not to grant the expansion, this office will require demolition or restoration to original condition of unapproved portions to be accomplished within thirty (30) days of the Board's actions. This is not · a request for a varia nce, but is rather a request for approval of cha nges in a "non-conforming" structure. The changes may be summarized as follows: 1. The addition of an exterior deck to the second level of the structure as shown in the accompanying drawing 2. The addition of approximately 200 square feet of windows to ventilate the attic, insulation of the attic,and flooring so as to allow storage there 3. The addition of a 30 square foot oalcony at the attic level (also shown in drawing) My reasons for these changes may be summarized as follows: 1. The deck outside the second level will improve the energy efficiency of the entire house. It will provide · shade foy - the first level and it will provide a cool and private outside space for the second level. Air conditioning needs should thereby be substantially reduced for the entire building. 2. The changes in the attic will insulate and ventilate a space that wa s previously entirely unventilated. The hip-roof design of this building, together with its minimal overhang make soffit vents impossible . In the sunnner air will circulate freely through the open windows and insulation will , minimize radiant heat from the sun through the roof . In the winter the closed windows will collect the heat of the sun and the insulation will retard its dissipation. The result will be lower heating and cooling costs for the entire structure. A byproduct of this improvement will be attic storage space . 3. The captured solar energy in winter should enable the growth of plants during those months during which it would b.e too cold for them to grow outside. In this connection !._included in my plan a small a small balcony outside one of the windows where plants can be aired on those winter days when weather permits. In accordance with City Ordinance number 850, these changes do not increase· the area of the building devoted to a non-conforming use, nor do they prevent a return of such property to conforming use (section 11-B-3-b). These changes do not prolong the life of the nonconforming use. Moreover, they may be construed as less detrimental to the environme~t than the original use (section 11-B-3-c) in that the entire structure becomes more energy efficient upon their completion . 7~ d~~-:: Larry A.
