TYPE OF DEVELOPMENT:
This permit is valid for site fill and roadside ditch grading within the University Drive right-of-way
ONLY.
Contractor shall prevent silt and debris from leaving the site in accordance with the City of College
Station Drainage Policy and Design Criteria. Owner and/or contractor shall be responsible for any
damage to existing city streets or infrastructure due to heavy machinery and/or equipment.
This permit, being temporary, is valid only within sixty (60) days of the date shown below, and is
not intended to allow the complete development of the site. Any work performed after the
expiration of this permit is not covered, and is considered unauthorized.
In accordance with Chapter 13 of the Code of Ordinances of the City of College Station, measures
shall be taken to insure that debris from construction, erosion, and sedimentation shall not be
deposited in city streets, or existing drainage facilities .
I hereby grant this permit for development of an area inside/outside the special flood hazard area.
All development shall be in accordance with the plans and specifications submitted to and
approved by the City Engineer in the development permit application for the above named project
an al of e es and ordinances of the City of College Station that apply.

The tract of land is located at t h e northeast corner of
University Drive and Spring Loop. The legal d escription is
University Park Phase II and is approximately 1.3 acres in si z e .
The site consists of grassland with numerous large oak trees.
Traversing the tract from west to east is a n a t u ral ditch that
eventually discharges into Burton Creek. The latest Federal
Emergency Management Agency (FEMA) maps (48041C0142 C) show that
a portion of the tract is in the regu latory 100-year flo o d plain.
The site is zoned R3 and is owned by Scott Eidson, Ka rbrooke,
Inc., 2700 East Bypass, Suite 2000, College Station, TX,
(409) 693-2467.
The proposed alterations to the tract i n clude the
application of fill material and re-grading of a d itch along the
University Drive right-of-way. A previous permit wa s obt a ined for
filling this site however the permits time limit has expired.
EXIST ING DRA INAGE BASIN DESCRIPTION :
The main creek traversing the site discharg es into Burton
Creek. The creek is in an area not studied by FEMA nor included
in the College Station "DRAINAGE SYSTEM ANALYSIS " or the Col l ege
Station "DRAINAGE POLICY AND DES I GN STAND ARDS". The FEMA Base
Flood Elevation (BFE) at the creeks confl u ence wi t h Burton Creek
is approximately 269.50.
The drainage basin consists of prima rily residential areas
with 95 acres entering the site and 128 acres leaving the site. A
drainage area map is included in the Appendix for review .
FIL L AREA :
Excavated silt taken from a drainage ditch behind Crystal
Park Plaza in College Station will be wasted at the site . The
fill will not exceed 5 feet i n height, will b e seeded and
sedimentation fencing installed to prevent ero sion until a
healthy ground cover is established. To my knowled ge there is no
governmental agency that regulates the placement of this type of
waste material.
To determine the effect of the fill material which will be
placed adjacent to the creek a comp u ter model o f the cree k f rom
University Drive to the confluence with Bu rton Creek was prepared
and two hydraulic analysis were ran to determine first, the
existing water surface elevation and second, to what limits the
fill material could be added without affecting t h e water surface

elevation dramatically. The fill adjacent to the creek will be
placed in a flat, low velocity area.
A runoff coefficient of 0.6 was used for

The addition of the fill to the site will not raise the
water surface elevation more than 0.02 feet. Copies of the
drainage analysis and a grading plan showing the limits of the
proposed fill is included in the Appendix.
No additional runoff from the site will be generated due to
the alterations because there is no change in the type of
material.
DI TC H RE-GRADIN G:
At present there is an existing meandering ditch entering
the site from a 42'' culvert under University Drive. The ditch
parallels the Texas Department of Transportation (TXDOT) right-
of-way for approximately 100 feet and then cuts across the site
to the main ditch. This ditch is clogged with sediment and will
be re-graded to function properly.
The ditch cross section was designed with slopes consistent
wi th TXDOT requirements and the velocity was held at 4 feet per
second to avoid erosion . Upon completion of the re-grading the
ditch will be seeded and sedimentation fencing will be installed
until a hea lthy ground cover is established. A copy of the
proposed ditch improvements and a recently received TXDOT permit
is included in the Appendix for review.
CONCLU SIO N:
This project is in compliance with the City's Stormwater
Design Standards.

The Texas Department of Transportation (TxDOT) offers no objection to the location on the right-of-way of your proposed
drainage ditch improvements line as shown by accompanying drawings and notice dated lli!/97 except
as noted below.

It is expressly understood that tl&e TxDOT does not purport, hereby, to grant any right, claim, title, or easement in or upon this
highway: and it is further understood that the TxDOT may require the owner to relocate this line, subject to provisions of
governing laws, by giving thirty (30) days written notice.
You are requested to notify this office prior to commencement of any routine of periodic maintenance which requires pruning
of trees within the highway right-of-way, so that we may provide specifications for the extent and methods to govern in trimming,
topping, tree balance, type of cuts, painting cuts and clean up. These specifications are intended to preserve our considerable
investment in highway planting and beautification, by reducing damage due to trimming.
The installation shall not damage any part of the highway and adequate provisions must be made to cause minimum inconveniences
to traffic and adjacent property owners. In the event the Owner fails to comply with any or all of the requirements as set forth
herein, the State may take such action as it deems appropriate to compel compliance.
• General Special Provisions:
Traffic Control Plan must meet with TMUTCD for Major operation work area near
shoulder and shall be left up overnight.
All equipment shall be parked on ROW line or at construction trailer after
working hours.
• Revegetation Special Provisions: In order to minimize erosion and sedimentation resulting from the proposed installation, the
project area will be revegetated ·
~in accordance with TxDOT's Standard Specification Item 164 'which specifies the appropriate grass seed mix to be used , or

Please notify Mr. Delmar L. Smith ( 409) 778-8054 forty-eight ( 48) hours prior to starting
construction of the line in order that we may have a representative present.

The line will be constructed and maintained on the highway right-of-way as shown on the attached drawing and in
accordance with t4e rules, regulations and policies of the Texas Department of Transportation (TxDOT), and all
governing laws, including but not limited to t he "Federal Clean Water Act," t he "Federal Endangered Species Act," and
the "Federal Historic Preservation Act." Upon request by TxDOT, proof of compliance with all governing laws, rules, and
regulations will be submitted to TxDOT before commencement of construction.
Our firm will use Best Management Practices to minimize erosion and sedimentation resulting from the proposed
installation, and we will revegetate the project area as indicated under "Revegetation Special Provisions."
Our firm will insure that traffic control measures complying with applicable portions of the Texas Manual of Uniform
Traffic Control Devices will be installed and maintained for the duration of this installation.
The location and description of the proposed line and appurtenances is more fully shown by _ __,~------complete

RE: Unauthorized Fill within the Flood Plain at University Park 2, Block Y
Dear Mr. Eidson :
As we have discussed , you are responsible for submitting the necessary documentation to
support the fill that was placed at the above referenced location as well as plans to
excavate a channel within University Drive right-of-way . Since there has been no
documentation submitted as of this date and the fact that this site is located within a
special flood hazard area inundated by a 100 year flood, you will be required to begin the
immediate removal of this fill material . Please notify this office as to your work schedule
by December 30, 1996 . If you are in the process of submitting this information, please
have your engineer submit a letter stating that this fill will not create a hazard to the
surrounding properties .

It bas been brought to my attention by our city inspector, Mr. John Logan, that fill has been placed
beyond the limits of fill indicated on the Grading Plan for University Parle Phase II Block Y . It is
your responsibility to have the fill removed from its present location and placed within the area
outlined as the limits of fill. In addition to this violation appropriate erosion control must be
installed and maintained immediately downstream of the fill to contain the fill on site .
You are currently operating under an expired development permit, Development Permit No. 444 .
1bis permit must be renewed prior to the continuation of work on this site . If these items are not
completed prior to September 2, 1997, the City of College Station will take code enforcement
action.

TYPE OF DEVELOPMENT:
This permit is valid for site fill and roadside ditch grading within the University Drive right-of-way
ONLY.
Contractor shall prevent silt and debris from leaving the site in accordance with the City of College
Station Drainage Policy and Design Criteria. Owner and/or contractor shall be responsible for any
damage to existing city streets or infrastructure due to heavy machinery and/or equipment.
This permit, being temporary, is valid only within sixty (60) days of the date shown below, and is
not intended to allow the complete development of the site. Any work performed after the
expiration of this permit is not covered, and is considered unauthorized.
In accordance with Chapter 13 of the Code of Ordinances of the City of College Station, measures
shall be taken to insure that debris from construction, erosion, and sedimentation shall not be
deposited in city streets, or existing drainage facilities .
I hereby grant this permit for development of an area inside the special flood hazard area. All
development shall be in accordance with the plans and specifications submitted to and approved by
the City Engineer in the development permit application for the above named project and all of the
codes and dinances o, e City of College Station that apply . _
