As the correspondence indicates , I have been in contact with Dr. and Mrs . Fedorchik since December 1, 1995 in order to repair a concrete flume located behind their residence at 3011 Coronado Drive. This flume was damaged as a result of a swimming pool being constructed at their home . The letters outline what was done to bring closure to this item . However, as of October 7, this repair was not made and I think a letter from the City Attorney's Office would get their attention . The flume has been repaired as requested, but the fresh concrete was defaced prior to hardening . As with any construction project, it is the responsibility of the contractor to "protect" the fresh concrete in order to provide a smooth finish . I have enclosed copies of photographs taken of the areas effected . Please .make arrangements to correct these areas by May 31 , 1996. This damage was a result of the construction of your swimming pool. On January 11, 1996 I met with Mr. Tom McKenzie to di scuss the time frame by which these repairs would be completed. We mutually agreed to have the damaged areas repaired by April 30, 1996 . This date would allow him the opportunity to sched ule a contractor to make the necessary repairs. I followed up with an inspection on May 8, 1996 and found that the repaire d areas had been defaced prior to the concrete hardening . In the correspondence dated May 8, 1996, I asked for th e damaged are as to be repaired by May 3 1, 1996 . Unfortunately, the re have been no efforts to remediate this situation as of this date . Therefore, I will forward all past correspondence to the City Attorney's Office if you fail to respond within seven (7) day s of receipt of this letter. As stated before, I will be happy to meet with you at your con venience to discuss the situation. If you would like to schedule a time to meet on site, I can be contacted at 764-3570 . As of this date, I have not received any information that would ind icate your plans . For this-reason, I am making a final request to receive this information . If you fail to respond by January 12, 1996, I will be forced to send this violation to Municipal Court for processing. Although you were exempt from the permitting requirements of the Drainage Ordinance, you must meet all of the requirements of this ordinance and the Drainage Policy and Design Standards. The purpose of this policy is to protect, maintain and enhance the public health, safety and general welfare by establishing minimum requirements to control the adverse impacts of storm water runoff. Please inform me of your plans so that enforcement citations are not issued . As I stated before, I will be happy to meet with you at your convenience to discuss the situation . I have reviewed the information you submitted in reference to French's Concrete proposal . The contractor proposes to apply an epoxy to the damaged area prior to placing the grout that will smooth out the defaced areas . In your submittal , you indicated that Mr. French could complete this work within two weeks of notification . Please notify him as soon as possible because I will make an inspection of the site on October 7, 1996 to determine if the repairs were made. She stated that Tom McKenzie, with Sun Pools, would be calling me about when and how the repairs would be made. This phone call should be coming in the next few days. I asked if this call was in response to the certified letter sent to her this week. She said that she had not received this letter, so I told her about the January 12 deadline as to communication. It was mutually agreed upon to have the damaged areas repaired by April 30, 1996. Mr. McKenzie has come forward stating he is more than willing to repair any damages that WeTe a result of his operations, but he does not want to be penalized by being responsible for damages he feels were not made by Sun Pools. Although Mr. McKenzie has made this commitment to make the necessary repairs, the ultimate responsibility rests upon the shoulders of the property owner. I will make an inspection of the flume on May 1, 1996 to determine if the requested repairs were made. If these areas are not repaired at this time, I Will be forced to begin code enforcement until the repairs are made .
