Box 1448 Norfolk, NE 68702 College Station, Texas 77842-9960 ( 409) 764-3500 Tuesday, May 20, 1997 RE: Code violation at Super 8 Motel -301 Texas Avenue; Lot 1, Block 1, Spartan 8 Subdivision To Whom It May Concern: I am writing to inform you of a code violation that exists on the subject property, and of the City's intent to enter into code enforcement to gain compliance. The site is in violation of Section 8.10 of Ordinance No. 1638, the Zoning Ordinance of the City of College Station. This section requires that a screening fence be installed between commercial and residential property, and it requires that the owner of the commercial property is responsible for such installation. In order to come into compliance with the screening requirement, you are required to construct a 6' fence of wood or comparable material between your property and Lot 70 of the Beverly Estates Subdivision. Another section of fence is required between your property and Lot 6 of the Burkhalter Addition. Since July of last year, several members of the City's Staff have been in verbal contact with the manager of the Super 8 Motel in an effort to gain compliance. We have received verbal assurances that the fence will be built On March 3 of this year, I spoke with the manager over the phone, who again assured me that the fence would be installed within the next "month or two". As of today's date, there is no fence between the motel site and residential development I regret that I must now serve formal notice of the City's intent to file charges against this property. If compliance has not been gained by the end of 30 days from receipt of this letter, we will cite you for each day that the property is not in compliance. A Zoning Ordinance violation is considered a separate offense for each day of violation, and each offense could cost up to $2000.00 a day, with a minimum fine of $25 .00 a day. Grimes who lives at 739 Shady Lane, and next to the new super 8 Motel at Texas and Cooner. He spoke of two problems . First, he feels that the drainage from the electric substation that used to flow across the motel property into Texas Avenue is now being diverted onto Mrs . Grimes property by the curbing installed as part of the motel construction . He feels that this drainage should be taken to Texas Avenue throu g h the motel site rather than be allowed to be dumped on Mrs . Grimes side yard . Second, he feels that we were remiss in not requiring a masonry wall between the motel and Mrs . Grimes home as would be required by Bryan Zoning Ordinance . The fairfield motel next to the Super 8 was required to install a wall between their site and Mrs . Grimes home, and he thinks Super 8 should also . After speaking with you and Sabina, I spoke with him earlier today and informed him that an enforcement letter would be sent out to correct the drainage diversion and to construct a wood screen fence per our ordinances . I told him that we would send a copy of the enforcement letter to him so he would be aware of the process, and he asked that a copy also be sent directly to Mrs . Grimes . RE: Super 8 Motel -Electric Service Dear Ray: In accordance with your request , we have rev iewed the load and service requirements for the new Super 8 Motel proposed for construction at the corner of S. Texas A venue and Cooner Street. We have planned the on-site electric dis tribution layout to serve this project to be underground, in accordance with the requirement s of your City's line extension policy. Enclosed herewith for your review and use are fi ve (5) copies of our proposed electri c distribution layout for this facility . A diskette has been provided which includes this project electrical layout for your use. A 500 kVA, three-phase, 12,470 GND Y/7,200 volt primary to 208Y/120 volt secondary pad-mounted transformer has been planned for installation to provide the requested service utilization voltage level for the Super 8 Motel. Metering is proposed to be accomplished at the east side of the building using 1200/5 ampere current transformers and a meter with demand indication of at least 6.0. Specifications for your use in purchasing this .transformer are enclosed. In accordance with your City policy, the developer should plan to furnish and install , in compliance with City specifications, all required electrical conduit and pour the required concrete pad for said 500 kV A transformer. The electric layout drawing enclosed provides details regarding the required number and sizes of conduit, installation depth, proposed condu it locations , riser pole conduit requirements, etc; the transformer pad details should be furnished when the dimensions of the transformer proposed to be used are known. In accordance with the new policy of your City, the developer is responsible for reimbursing your City for 20% of the cost of installation , including labor, materials, and standard fee percentages for engineering and overhead cost for the proposed electric layout. We compute that the 20 % contribution required for the Super 8 Motel computes to be $3, 188.20. This cost estimate was calculated based on a total project cost estimate of City of College Station December 20, 1993 Page Two $15,941.00. The total underground cost includes a standard allowance of 30% to cover your City's labor related overhead costs , 7% material handling costs, and 8.5% to cover your City's administrative and engineering costs.
