This variance is necessary due to the following special conditions:
Special Condition Definition: To justify a variance, the difficulty must be due to unique circumstances
involving the particular property. The unique circumstances must be related to a physical characteristic of the
property itself, not to the owner's personal situation. This is because regardless of ownership, the variance will
run with the land.
Example: A creek bisecting a lot, a smaller buildable area than is seen on surrounding lot s, specimen trees.

SUBJECT: 316 SUFFOLK (ZBA) —Variance Request
Staff reviewed the above - mentioned variance application as requested. Your project
has been scheduled for the next available Zoning Board of Adjustment (ZBA) meeting
on Tuesday, May 5, 209, 6:00 p.m. in the City Hall Council Chambers, 1101 Texas
Avenue.
Please provide staff an overhead view of the property which shows the following:
1.) The current location of the coop.
2.) The distances from each dwelling structure to the coop (this includes dwelling
units located on your property and the adjacent properties),
3.) The location of where the coop is legally allowed.

CHAPTER 2
ANIMAL CONTROL
SECTION 1: PERMIT REQUIRED TO KEEP LIVESTOCK
OR POULTRY WITHIN CITY LIMITS
A. LIVESTOCK AND POULTRY DEFINED
No person shall keep livestock or poultry within the limits of the City of College Station
without first obtaining and thereafter keeping in force a permit permitting him to do so. The
term livestock includes specifically but not exclusively horses, mules, asses, swine, cattle,
sheep, goats, and rabbits; the term poultry includes specifically but not exclusively chickens,
turkeys, geese, ducks, pigeons, and guineas.
B. TERMS FOR GRANTING PERMITS
Said permits shall be granted or allowed to remain in force only when the regulations as
follows are observed:
(1) The livestock and poultry shall be kept within structures, enclosures, or tethered, and
not permitted to run at large.
(2) The manure and debris incident to the maintenance and care of livestock or animals
shall be scraped from roosts and floors and raked from pens or areas with such fre-
quency as to prevent the same from serving as breeding places for insects and from
emitting noxious odors.
(3) The manure and debris scraped or raked as provided in paragraph (2) above, shall
immediately be collected and either placed and kept in a waterproof and insect proof
container until removed from the premises, or treated immediately and periodically
thereafter with a chemical as directed by the manufacturer thereof that is manu-
factured and sold as an effective agent for preventing flies and other insects from
breeding in manure and debris.
(4) The inside walls, ceilings, roosts, and floors of the structure in which the livestock or
poultry is housed shall be treated and kept treated with effective material manu-
factured and sold for the control of flies, mites, and lice and applied according to the
manufacturer's directions.
(5) The structure or enclosure within which the livestock or poultry are confined shall be
not less than one hundred feet (100) from any dwelling house other than that
occupied by the owner of the livestock or poultry.
C. PROCEDURE FOR OBTAINING PERMITS
The procedure and requirements for the granting and keeping in force of permits shall be as
follows:

(1) Application Requirements
Any person desiring a permit permitting him to keep livestock or poultry within the
city limits shall file an application with the City Manager or his delegate on a form
provided by him for that purpose. Said application shall among other things call for:
(a) The name and address of the applicant; the estimated average number and
types of livestock or poultry to be kept;
(b) A description of the structures and the facilities to be used for the enclosure
of the livestock or poultry and for the disposal of the manure and debris
incident to their maintenance and care; and,
(c) The distance to the adjacent residence from the outside boundaries of the
structure or fence in which the livestock or poultry are to be enclosed.
(2) Application Fee
The application shall be accompanied by a fee in an amount which shall be set by
the City Council by resolution from time to time.
The applicant or permit holder shall pay a fee for all permit inspections,
reinspections and inspections resulting from allegations of non - compliance. Such
payment shall be a condition of the permit.
(3) Inspection of Facilities
When an application has been filed in proper form, the City Manager or his delegate
shall inspect the premises wherein the livestock or poultry are to be kept. If the
premises are in compliance with the ordinance, the City Manager or his delegate
shall issue a permit which shall be valid for a period of one year from the date of the
inspection.
(4) Variances
(a) Variances to the terms of this ordinance may be granted by the Zoning
Board of Adjustment. In the event of a request for variance, the City
Manager or his delegate shall prepare an opinion as to whether the same is
in compliance with the regulations and submit it to the board for its consider-
ation. Prior to review by the board, the City Manager or his delegate shall
notify in writing, by U.S. Mail, all property owners within two hundred feet
(200) of the applicant's property.
(b) The Zoning Board of Adjustment shall hold a hearing and provide all
interested persons an opportunity to appear and present evidence. Upon the
close of the hearing, the Zoning Board of Adjustment shall issue an order
granting or denying the permit.
(c) The Zoning Board of Adjustment, when so requested and after a hearing,
may vary the application of any provision of this ordinance to any particular
case when, in its opinion, the enforcement thereof would do manifest
injustice and would be contrary to the spirit and purpose of this ordinance or
the public interest, and also finds all of the following:
(i) Special conditions and circumstances exist that are peculiar and are
not applicable to other property;
(ii) Special conditions and circumstances that result from the action of
the applicant;

(iii) Granting the variance requested will not confer on the applicant any
special privilege that is denied by this ordinance;
(iv) Granting of the variance will be in the harmony with the general
intent and purpose of this ordinance and will not be detrimental to
the public health, safety and general welfare.
(d) In granting the variance, the Board may prescribe a reasonable time limit
within which the action for which the variance is required shall be com-
menced and /or completed. In addition, the Board may prescribe appropriate
conditions and safeguards in conforming with this ordinance. Violations of
the conditions of the variance shall be deemed a violation of this ordinance.
(5) Permit Renewals
A permit shall be valid for one (1) year from the date of issuance. The same may be
renewed by the filing of a renewal application from the City Manager or his delegate
on a form provided by him for that purpose and the payment of a renewal application
fee in the amount set by resolution from time to time.
(6) Permit Violations: Hearings by City udge
The City Manager or his delegate may make periodic inspections at the permitted
premises. As a condition of this permit, the permittee shall allow the City Manager
or his delegate onto the premises for the purpose of inspection during normal
business hours. Permittee shall pay a re- inspection fee, as set by resolution from
time to time, whether the inspection is an annual permit renewal inspection or an
unannounced inspection to ascertain whether the regulations as hereinbefore pro-
vided are being observed. If the City Manager or his delegate finds that the afore-
said regulations are violated, he may issue a citation for the permittee or applicant to
appear in municipal court before the judge to answer such charges. If, after a hear-
ing, the judge finds the aforesaid regulations have been violated, it shall then order
the permit cancelled.

D. EXEMPTIONS
Pot - bellied pigs that by habit or training live in association with man shall be exempt from the
permitting requirement of this section. No permits will be required for properties zoned A -O,
A -OX or A -OR.
(Ordinance No. 2265 of September 11, 1997)
E. PENALTY FOR VIOLATIONS
Violations of this section of the ordinance shall be punished in accordance with Chapter 1,
Section 5 of this Code of Ordinances.

SECTION 2: ANIMALS AND FOWL REGULATED
A. DEFINITIONS
(1) 'Animal' shall mean any and all types of allowed animals, male or female,
singular and plural, warm or cold - blooded.
(2) 'Fowl' shall mean any and all fowl, domesticated and wild, male and female,
singular and plural.

Mr. Hilgemeier,
At the time of the variance hearing at the Hillel Foundation site, we
strongly suggested that the Public Hearing signs be made more visible
to passers by. we recommended that any corner lot have an easily
read sign on each street. we are pleased to see that the sigh at 316
Suffolk Avenue is larger. The location of a single sign means that
it is not easily read on either street. Once again we earnestly
request that a sign be placed on each street in the most visible spot
possible.

I was under the impression that a Poultry Permit has already been granted by the City. If that's true, where does the
100 ft. requirement apply? Is that the variance being applied for?
It occurs to me that any variance from the 100 ft. requirement in the Livestock Permit code, is an issue that should go
directly to the City Council. It's not a zoning issue, but a city ordinance issue, which they are clearly in violation of.
The permit should be immediately resended by the city, until such time as a deviation is granted by the City Council.

Although I love both chicken and cabrito, having livestock in our neighborhood is not what I moved here for. If I
wanted that environment, I would have located outside the city limits.

Hello Neighbors:
I'm thinking about applying for a large animal permit in order to keep goats in my yard. As you know
my yard is quite large, the boys are getting busier and going away to college and it's getting more
difficult for me to manage. I worry about the anit -green aspect of firing up the lawn mower and weed
eater each week. If I could get the goats to work on the grass, problem solved! As a bonus, my family
(or the neighborhood) could have a barbeque when the herd gets too large. Cabrito is quite delicious!

It seems to me that the chicken coop would almost have to be an appendage to

add up the feet. as to the depth -- surely the house covers quiet a few feet, therefore
leaving little room for a chicken coop. If I were going to raise animals or poultry,
think the country is the place to live, and not the city. Debby could probably start a
whole country farm, as she owns six lots. Hey, Debby how about us\ going together
and buying some cows -- milk, butter, fertilizer for our lawns, and maybe even make
cheese. I get the idea that the council and the city employees don't pay much

There might be another change of plans; so to speak. The Texas Local Code states that we have to q&ertise the
time and location of any public hearing 15 days prior to the meeting. Well, if we were to post the changes and
still have the meeting on May 5th we would be in violation of that rule.
So right now I am waiting to hear from Bob about the possibility of bumping the meeting to another date, or if

we believe that we should express our current position regarding the variance
hearing scheduled for May 5. Although we were not asked our feelings regarding
poultry next door (316 Suffolk Avenue) prior to the permit being issued, we
originally thought we would not attend the meeting because we did not want to
create a problem. As we have learned more, we have become concerned about the
process that lead to the upcoming hearing. we now intend to attend the hearing to
learn more about this process and how it can be improved. Although we might not
have objected to granting the permit, we certainly would not have endorsed it. one
concern is how the city could allow the chickens to be housed in the structure that
does not conform to the current code before the variance has been authorized.

Technical Abstract: Salmonella and Campylobacter can contaminate chicken transport coops due to feces left by flocks
positive for these zoonotic pathogens. This talk focuses on published research which reports the prevalence and numbers of
Salmonella and Campylobacter in transport coops, the results of this contamination and efforts to remove it. Both Salmonella
and Campylobacter have been reported in transport coops prior to use, even after washing and sanitizing. Data will be
presented showing that cross contamination can occur due to Campylobacter or Salmonella contamination in transport coops.
Broilers from an uncontaminated flock can become positive simply due to exposure to contaminated feces during transport
and holding in the coop. This contamination has been shown to remain on the carcass during processing, creating a food
safety concern. Some washing and sanitizing procedures have been developed that are reported to lessen the prevalence of
Salmonella and Campylobacter on coop surfaces in experimental conditions. Fecal contamination on coop surfaces can be
lessened significantly by a water spray and under some circumstances addition of a sanitizing step further lowers the numbers
of bacteria and the prevalence of pathogens. Allowing contaminated fecal matter to dry out in cages for 24 to 48 hours has
been shown to be an effective means to lower the numbers of Campylobacter in transport coops. Washing and sanitizing
transport coops under commercial conditions at processing plants has also been shown to be helpful to lower bacterial
numbers. However, other studies have been published showing that commercial coop washing procedures can break down
due to human error, incorrect application of chemical or incomplete removal of fecal matter. Some procedures that have been
tested and found to be effective are impractical due to logistical or economic constraints. The overall conclusion is that cage
washing and sanitizing is an expensive proposition with questionable efficacy. Therefore, more research is warranted to
uncover the most efficient means to sanitize coops.

Dear Mr. Hilgemeier:
It is with regret that I write to express my opposition to the Hugh Stearns request for a variance on the
setback of his poultry structure. The Stearns are admirable people who by their own considerable toil
have sought to improve their property. However, because the Stearns and the City did not take the right
action at the right time for the right reason, they have placed subdivision members in the very painful
position of having to choose which friend/neighbor they will support and which they will not. The
discord that this issue has produced within a normally friendly, cooperative neighborhood may well
not quickly, if ever, abate.
My home is across Park Place from the Stearns' side lot line, one lot west. I believe my residence's
distance to be a few feet more or less than 100 feet from their chicken yard, though no measurement has
been made.
My concerns center on chicken manure water run -off from the poultry yard in heavy rains, the pollution
of our ground water, chicken manure odor and proliferation of poultry operations throughout the
neighborhood. The Stearns' poultry house is higher than the street level by several feet and the yard
slopes south toward the street, which is graded to carry water past both the front and the side of my lot.
I expect that heavy storm water run -off will exit their sloping yard into the street almost directly across
from my house on the way to the storm sewer. In the event of a rain storm, the street fills with water,
washing toward my lot before it reaches the corner and continues south along my west lot line,
collecting in "my" gutters at points where the grades are lower than normal. That water remains for 24
hours or more until it evaporates; the sediment carried by the water remains until I sweep it up - -or on
occasion, the City street cleaning vehicle comes by.
Please be aware that I would have to oppose the variance even if I weren't concerned about polluted
water run -off, polluted ground water, unpleasant odors and additional poultry facilities. Voting "for" the
variance is tantamount to voting for the practice of evasion of and disregard for adhering to codes
and ordinances of the City. This is not the first time (perhaps the fourth ?) in this neighborhood that a
homeowner has put significant funds and effort into a City permitted project in defiance of existing
codes and statutes, and then after the fact pleaded with his neighbors to indulge him and to allow the
project to stand because his funds would be lost if they didn't, in short-- "Help me or bear the guilt."
Please help us to put a stop to this abusive modus operandi for skirting codes and ordinances.

Thanks for contacting the City regarding the Zoning Board of Adjustment meeting scheduled for 5 May. The City
Manager's office forwarded your e-mail to me and asked that I provide some background on the case at 316
Suffolk.
On 4 March, Hugh Sterns applied for a permit to keep poultry at 316 Suffolk. The permitting process for keeping
poultry inside the city limits is provided in Chapter 2 of the College Station Code of Ordinances. The Code of
Ordinances requires that structures or enclosures used to house poultry be located at least 100 feet from
neighboring residential structures. We typically send a Code Enforcement Officer out to the site to verify that the
enclosure complies with City Code before issuing the permit and, in this case, it did not. Therefore, Mr. Sterns is
pursuing a setback variance from the Zoning Board of Adjustments as provided for in the ordinance.
The Zoning Board of Adjustment meeting will include a public hearing where any interested party can provide
their thoughts and comments regarding the case. To my knowledge, a poultry permit has not been issued for 316
Suffolk but I'll be able to verify that first thing Monday morning and report back to you then. In the interim, I
trust this information is helpful.

residential lot in the Oakwood Subdivision, Further, I am very concerned about how this situation has progressed

person(s) responsible for granting the existing Poultry Permit are guilty of gross incompetence. Or, perhaps it is

is a current member of the P&Z Commission.
This failure is inexcusable.
The chicken coop in question is approximately 94 feet from my front porch and front door step. My house
is the only one in Oakwood that faces the newly created barnyard. 1 see the chicken coop in question every day
from my kitchen window, my breakfast window and my master bedroom window as well as from my front door.
This is unacceptable. I love animals and I love fresh yard eggs as much as any person, but I didn't move into the
historic Oakwood division of College Station over 21 years ago to live among them.
Mr. Hilgemeier, I am further requesting from you a written response detailing how this permit was allowed in the
first place. I want to know who signed off on it and why the existing city ordinance was not obeyed. It is my intent
to see that the responsible person(s) for this violation of the public trust are held accountable. To that end I will
work very hard to see that any involved council members or P &Z committee members are replaced at the earliest
possible opportunity.

I have lived here in this house for forty four years, and have never heard of anything
like this in our neighborhood in that whole time. I feel that everyone feels the same
way as Mrs. Tomlin, and especially if they had to look at it and smell it every day.
Even though I am unable to attend the meeting, I feel the same way as she does,
and if I wanted a barn yard, I would have moved to the country- -out of the city
limits. I can't imagine what would happen in Pebble Creek if this happened there- -
think everyone in the city of College Station would be against it. I hope the city will
hear the outcry from our historic sub division. Sincerely, Betty Woods -- have
already heard some of the opinions of this from some of the larger subdivisions, and
it was not positive.

I would very much apppreciate knowing about the timeline for
the permit for chi Nens and the request for the variance
and when it was known that there would be a need for a
variance. i would also like to know when the city first
learned that there were chickens in the pen. i know the
facility does not meet current code with my house and the
house behind them and i have been told that it does not
meet code for the house at 802 Park Place. is this
correct?
i have observed that the chickens were removed from the
site on Monday.
I think it is truly unfortunate that the city allows
livestock in residential neighborhoods such as ours with no
input from those that will be impacted. I would like to do
whatever I can to help develop a system that would prevent
situations such as this that causes conflict between and
among neighbors.
Your assistance will be greatly appreciated.

Thanks for contacting the City concerning the upcoming variance request at 316 Suffolk. I'll try to address your
questions in the order they were asked.
• The application for the poultry permit is dated March 10th and the Zoning Board of Adjustment (ZBA)
application is dated March 27th. Therefore, I assume that Mr. Stearns realized a variance was needed
sometime between March 10th and March 27th.
• I first learned that chickens were in the coop last weekend. On Monday I visited the site to confirm that
was the case. Later that day we contacted Mr. Stearns to make him aware that he was in violation of
W;
City Code. His response indicated that he would have the chickens removed within the next couple of
days.
• City code requires structures housing poultry to be located at least 100 feet from neighboring residential
structures. As currently located, the chicken coop is less than 100 feet from the homes at 310 Suffolk
and 511 Dexter. However, it is located more than 100 feet from the home at 802 Park Place.
• The ZBA meeting on May 5th will include a public hearing where interested parties can share their
thoughts and opinion regarding this matter.

Although, I am extremely fond of chicken and eggs; I believe it would be inappropriate to raise chickens in our
neighborhood. The lots are relatively small and it will not allow adequate distant from adjacent neighbors without
being a nuisance I will not be able to attend the variance meeting, therefore I request you count my
e-mail as a vote against granting the variance.
