PC: Case file #09- 00500069 CHAPTER 2 ANIMAL CONTROL SECTION 1: PERMIT REQUIRED TO KEEP LIVESTOCK OR POULTRY WITHIN CITY LIMITS A. LIVESTOCK AND POULTRY DEFINED No person shall keep livestock or poultry within the limits of the City of College Station without first obtaining and thereafter keeping in force a permit permitting him to do so. The term livestock includes specifically but not exclusively horses, mules, asses, swine, cattle, sheep, goats, and rabbits; the term poultry includes specifically but not exclusively chickens, turkeys, geese, ducks, pigeons, and guineas. B. TERMS FOR GRANTING PERMITS Said permits shall be granted or allowed to remain in force only when the regulations as follows are observed: (1) The livestock and poultry shall be kept within structures, enclosures, or tethered, and not permitted to run at large. (2) The manure and debris incident to the maintenance and care of livestock or animals shall be scraped from roosts and floors and raked from pens or areas with such fre- quency as to prevent the same from serving as breeding places for insects and from emitting noxious odors. (3) The manure and debris scraped or raked as provided in paragraph (2) above, shall immediately be collected and either placed and kept in a waterproof and insect proof container until removed from the premises, or treated immediately and periodically thereafter with a chemical as directed by the manufacturer thereof that is manu- factured and sold as an effective agent for preventing flies and other insects from breeding in manure and debris. (4) The inside walls, ceilings, roosts, and floors of the structure in which the livestock or poultry is housed shall be treated and kept treated with effective material manu- factured and sold for the control of flies, mites, and lice and applied according to the manufacturer's directions. (5) The structure or enclosure within which the livestock or poultry are confined shall be not less than one hundred feet (100) from any dwelling house other than that occupied by the owner of the livestock or poultry. C. PROCEDURE FOR OBTAINING PERMITS The procedure and requirements for the granting and keeping in force of permits shall be as follows: 2 -1 Rev. 12/00 (1) Application Requirements Any person desiring a permit permitting him to keep livestock or poultry within the city limits shall file an application with the City Manager or his delegate on a form provided by him for that purpose. Said application shall among other things call for: (a) The name and address of the applicant; the estimated average number and types of livestock or poultry to be kept; (b) A description of the structures and the facilities to be used for the enclosure of the livestock or poultry and for the disposal of the manure and debris incident to their maintenance and care; and, (c) The distance to the adjacent residence from the outside boundaries of the structure or fence in which the livestock or poultry are to be enclosed. (2) Application Fee The application shall be accompanied by a fee in an amount which shall be set by the City Council by resolution from time to time. The applicant or permit holder shall pay a fee for all permit inspections, reinspections and inspections resulting from allegations of non - compliance. Such payment shall be a condition of the permit. (3) Inspection of Facilities When an application has been filed in proper form, the City Manager or his delegate shall inspect the premises wherein the livestock or poultry are to be kept. If the premises are in compliance with the ordinance, the City Manager or his delegate shall issue a permit which shall be valid for a period of one year from the date of the inspection. (4) Variances (a) Variances to the terms of this ordinance may be granted by the Zoning Board of Adjustment. In the event of a request for variance, the City Manager or his delegate shall prepare an opinion as to whether the same is in compliance with the regulations and submit it to the board for its consider- ation. Prior to review by the board, the City Manager or his delegate shall notify in writing, by U.S. Mail, all property owners within two hundred feet (200) of the applicant's property. (b) The Zoning Board of Adjustment shall hold a hearing and provide all interested persons an opportunity to appear and present evidence. Upon the close of the hearing, the Zoning Board of Adjustment shall issue an order granting or denying the permit. (c) The Zoning Board of Adjustment, when so requested and after a hearing, may vary the application of any provision of this ordinance to any particular case when, in its opinion, the enforcement thereof would do manifest injustice and would be contrary to the spirit and purpose of this ordinance or the public interest, and also finds all of the following: (i) Special conditions and circumstances exist that are peculiar and are not applicable to other property; (ii) Special conditions and circumstances that result from the action of the applicant; 2 -2 Rev. 12100 (iii) Granting the variance requested will not confer on the applicant any special privilege that is denied by this ordinance; (iv) Granting of the variance will be in the harmony with the general intent and purpose of this ordinance and will not be detrimental to the public health, safety and general welfare. (d) In granting the variance, the Board may prescribe a reasonable time limit within which the action for which the variance is required shall be com- menced and /or completed. In addition, the Board may prescribe appropriate conditions and safeguards in conforming with this ordinance. Violations of the conditions of the variance shall be deemed a violation of this ordinance. (5) Permit Renewals A permit shall be valid for one (1) year from the date of issuance. The same may be renewed by the filing of a renewal application from the City Manager or his delegate on a form provided by him for that purpose and the payment of a renewal application fee in the amount set by resolution from time to time. (6) Permit Violations: Hearings by City udge The City Manager or his delegate may make periodic inspections at the permitted premises. As a condition of this permit, the permittee shall allow the City Manager or his delegate onto the premises for the purpose of inspection during normal business hours. Permittee shall pay a re- inspection fee, as set by resolution from time to time, whether the inspection is an annual permit renewal inspection or an unannounced inspection to ascertain whether the regulations as hereinbefore pro- vided are being observed. If the City Manager or his delegate finds that the afore- said regulations are violated, he may issue a citation for the permittee or applicant to appear in municipal court before the judge to answer such charges. If, after a hear- ing, the judge finds the aforesaid regulations have been violated, it shall then order the permit cancelled. (Ordinance No. 1970 of August 27, 1992) D. EXEMPTIONS Pot - bellied pigs that by habit or training live in association with man shall be exempt from the permitting requirement of this section. No permits will be required for properties zoned A -O, A -OX or A -OR. (Ordinance No. 2265 of September 11, 1997) E. PENALTY FOR VIOLATIONS Violations of this section of the ordinance shall be punished in accordance with Chapter 1, Section 5 of this Code of Ordinances. DEFINITIONS (1) 'Animal' shall mean any and all types of allowed animals, male or female, singular and plural, warm or cold - blooded. If that's true, where does the 100 ft. requirement apply? Is that the variance being applied for? It occurs to me that any variance from the 100 ft. requirement in the Livestock Permit code, is an issue that should go directly to the City Council. It's not a zoning issue, but a city ordinance issue, which they are clearly in violation of. As you know my yard is quite large, the boys are getting busier and going away to college and it's getting more difficult for me to manage. I worry about the anit -green aspect of firing up the lawn mower and weed eater each week. If I could get the goats to work on the grass, problem solved! Technical Abstract: Salmonella and Campylobacter can contaminate chicken transport coops due to feces left by flocks positive for these zoonotic pathogens. This talk focuses on published research which reports the prevalence and numbers of Salmonella and Campylobacter in transport coops, the results of this contamination and efforts to remove it. Both Salmonella and Campylobacter have been reported in transport coops prior to use, even after washing and sanitizing. Data will be presented showing that cross contamination can occur due to Campylobacter or Salmonella contamination in transport coops. Broilers from an uncontaminated flock can become positive simply due to exposure to contaminated feces during transport and holding in the coop. This contamination has been shown to remain on the carcass during processing, creating a food safety concern. Some washing and sanitizing procedures have been developed that are reported to lessen the prevalence of Salmonella and Campylobacter on coop surfaces in experimental conditions. Fecal contamination on coop surfaces can be lessened significantly by a water spray and under some circumstances addition of a sanitizing step further lowers the numbers of bacteria and the prevalence of pathogens. Allowing contaminated fecal matter to dry out in cages for 24 to 48 hours has been shown to be an effective means to lower the numbers of Campylobacter in transport coops. Washing and sanitizing transport coops under commercial conditions at processing plants has also been shown to be helpful to lower bacterial numbers. However, other studies have been published showing that commercial coop washing procedures can break down due to human error, incorrect application of chemical or incomplete removal of fecal matter. Some procedures that have been tested and found to be effective are impractical due to logistical or economic constraints. The overall conclusion is that cage washing and sanitizing is an expensive proposition with questionable efficacy. The Stearns are admirable people who by their own considerable toil have sought to improve their property. However, because the Stearns and the City did not take the right action at the right time for the right reason, they have placed subdivision members in the very painful position of having to choose which friend/neighbor they will support and which they will not. The discord that this issue has produced within a normally friendly, cooperative neighborhood may well not quickly, if ever, abate. My home is across Park Place from the Stearns' side lot line, one lot west. I believe my residence's distance to be a few feet more or less than 100 feet from their chicken yard, though no measurement has been made. My concerns center on chicken manure water run -off from the poultry yard in heavy rains, the pollution of our ground water, chicken manure odor and proliferation of poultry operations throughout the neighborhood. The Stearns' poultry house is higher than the street level by several feet and the yard slopes south toward the street, which is graded to carry water past both the front and the side of my lot. I expect that heavy storm water run -off will exit their sloping yard into the street almost directly across from my house on the way to the storm sewer. In the event of a rain storm, the street fills with water, washing toward my lot before it reaches the corner and continues south along my west lot line, collecting in "my" gutters at points where the grades are lower than normal. That water remains for 24 hours or more until it evaporates; the sediment carried by the water remains until I sweep it up - -or on occasion, the City street cleaning vehicle comes by. Please be aware that I would have to oppose the variance even if I weren't concerned about polluted water run -off, polluted ground water, unpleasant odors and additional poultry facilities. Voting "for" the variance is tantamount to voting for the practice of evasion of and disregard for adhering to codes and ordinances of the City. This is not the first time (perhaps the fourth ?) in this neighborhood that a homeowner has put significant funds and effort into a City permitted project in defiance of existing codes and statutes, and then after the fact pleaded with his neighbors to indulge him and to allow the project to stand because his funds would be lost if they didn't, in short-- "Help me or bear the guilt." Please help us to put a stop to this abusive modus operandi for skirting codes and ordinances. The City Manager's office forwarded your e-mail to me and asked that I provide some background on the case at 316 Suffolk. On 4 March, Hugh Sterns applied for a permit to keep poultry at 316 Suffolk. The permitting process for keeping poultry inside the city limits is provided in Chapter 2 of the College Station Code of Ordinances. The Code of Ordinances requires that structures or enclosures used to house poultry be located at least 100 feet from neighboring residential structures. We typically send a Code Enforcement Officer out to the site to verify that the enclosure complies with City Code before issuing the permit and, in this case, it did not. Therefore, Mr. Sterns is pursuing a setback variance from the Zoning Board of Adjustments as provided for in the ordinance. The Zoning Board of Adjustment meeting will include a public hearing where any interested party can provide their thoughts and comments regarding the case. To my knowledge, a poultry permit has not been issued for 316 Suffolk but I'll be able to verify that first thing Monday morning and report back to you then. I think it is truly unfortunate that the city allows livestock in residential neighborhoods such as ours with no input from those that will be impacted. I'll try to address your questions in the order they were asked. • The application for the poultry permit is dated March 10th and the Zoning Board of Adjustment (ZBA) application is dated March 27th. Therefore, I assume that Mr. Stearns realized a variance was needed sometime between March 10th and March 27th. • I first learned that chickens were in the coop last weekend. On Monday I visited the site to confirm that was the case. Later that day we contacted Mr. Stearns to make him aware that he was in violation of W; City Code. His response indicated that he would have the chickens removed within the next couple of days. • City code requires structures housing poultry to be located at least 100 feet from neighboring residential structures. As currently located, the chicken coop is less than 100 feet from the homes at 310 Suffolk and 511 Dexter. However, it is located more than 100 feet from the home at 802 Park Place. • The ZBA meeting on May 5th will include a public hearing where interested parties can share their thoughts and opinion regarding this matter.
