HomeMy WebLinkAboutStaff Report►hiIa i ► Lei 9Jy October 18, 2004 TO: Planning and Zoning Commission FROM: Alan Gibbs, Development Engineer Email: agibbs @cstx.gov SUBJECT: REPLAT for VILLAGES OF INDIAN LAKES PH 1 LOTS 7 -9 BILK 8 Item: Public hearing, discussion, and possible action on a Replat for the Village of Indian Lakes Phase 1 Lots 7 -9 Block 8 consisting of 3 lots on 5 acres generally located at 3697 Calusa Springs Drive. (04- 00500229) Applicant: Paul Clarke, Owner/ Developer Staff Recommendations: Staff recommends approval, with the condition that a public water line is constructed in accordance with city standards, including city- approved construction plans and a fire flow analysis. Item Summary: This item is a public hearing. The owner is proposing to replat 3 existing lots into 2 lots along Calusa Springs Drive. Both proposed lots have access to streets and utilities. Construction plans and a fire flow analysis have not been submitted for review at this time. The applicant contends that this replat is not subject to fire flow requirements, which were adopted as an amendment to the Subdivision Regulations in August 2004, due to the Vesting Statute, outlined in Chapter 245 of the Texas Local Government Code. However, city staff has made a determination that replats are considered new projects, and are therefore not vested under Chapter 245. The applicant and his representative will be present to present their opinion regarding vesting and fire flow requirements. Under the UDO, the applicant has the ability to appeal staff's determination, which may be placed as a separate item on a subsequent Planning & Zoning Commission agenda.
