Thank you for the submittal of your DEVELOPMENT PLAT application. As discussed on the
phone with Jeff Robertson of McClure & Browne yesterday, the email correspondence sent from
Morgan Hester on November 16, 2012 stated that a subdivision plat was not necessary and that
a development plat would not be required either if each of the proposed tracts were at least 5
acres, had access, and were for single - family use of the owner, member of the owner's family or
for agricultural uses. It appears that the proposed division of the tract meets these requirements
so a plat application is not needed.
For the single family homes to be constructed on the proposed tracts, the division of land will
need to be formalized, as only one home is permitted on a tract of land, and City building and
fire code requirements will need to meet with each building permit. For questions regarding
these requirements, please feel free to contact Terry Boriskie, Plans Examiner, in our Building
Division.
As an application is not needed, staff will process a refund of the application fee. If you have

Good morning,
Thank you for your email. We've had some time to consider this further and have made the following
findings. Your email indicated an exception to the Subdivision Plat requirement; however, in such
cases, the City still has the right to require a Development Plat (UDO Section 3.3.A.2 'Development
Plat Required'). The exemption for a Development Plat is as follows:
- The tract is at least 5 acres;
- The tract has access;
- The development is single - family home for the use of the property owner or a member of the
property owner's family, an accessory structure(s) of the home, and /or an accessory
structure(s) for the benefit of agricultural uses.
In other words, we believe that it is possible to have multiple tracts without platting as long as each
tract is at least 5 acres, each tract has access to Rock Prairie Road (keep in mind that driveway
spacing along Rock Prairie Road is 300'), and each tract contains a home that is occupied by a
family member. Please also keep in mind that the applicable fire protection measures will apply;
each home will have to be sprinkled and fire access will need to be provided.
Additionally, each tract will need to be defined by metes and bounds description.

Morgan/Carol,
I found the section I was looking for in the UDO:
Section 12- 3.4.1.c.1
Exemptions from Subdivision Plat Requirement.
The following subdivisions are exempt from Subdivision Plat requirements:
1) A division of land into parts greater than five (5) acres within the City limits and greater than ten (10) acres
in the extraterritorial jurisdiction of the City of College Station, where each part has access and no public
improvement is being dedicated;
From my understanding of this, if the property owner divides his property into tracts larger than 5 acres within
the City limits, he doesn't have to plat unless he has to dedicate public infrastructure. If the owner configures
his lots such that each one has access to a public street with adequate driveway spacing, it seems that the plat is
not required. Can you clarify why it would be necessary in this case?
