(2) Plat approval and filing will be conditioned upon the City's receipt of financial surety in the amount of $214,841 (which includes a contingency amount of $19,531) representing the amount shown in the Engineer's Opinion of Probable Costs dated December 5, 2012 for the public infrastructure shown in the plans submitted with the captioned plat ( "Public Infrastructure "). We further acknowledge that the site plan for Lot 1, Phase 13A will require the entire water line design contained in the Public Infrastructure plans to be completed and that the certificate of occupancy for Lot 1, Phase 13A will be conditioned upon completion of such water line loop. Let me know if you have any questions. Andy, I apologize for not being able to return your call from this afternoon asking about the status of the project. I hope this email will suffice as a response. The construction documents for the final plat are still under review by Erika and she hopes to have that review completed on Thursday. I will mention that with the water line going outside the boundary of Phase 13A plat, it necessitates an off -site easement (at least a temporary blanket) for it through the unplatted Phase 13B. Beside the design of this water line and responding to Erika's comments that are forthcoming, getting those easement documents submitted to the City is probably your critical path.
