The following issues remain: (1) The applicant needs to be the owner, (2) 1 do not have agreement of CSU to the abandonment, (3) since Betty Stetz has not been responsive we should be able proceed, but, if you have a copy and verification of the registered letter sent to her at 1306 Garden Lane, Bryan 77802 please forward and (4) Cox included the condition that the developer enter into an agreement to pay the cost of relocation. Has an agreement between the developer and Cox been signed by both parties? Verizon signed the consent for abandonment. This leaves electric and sanitary sewer. The abandonment ordinance will have to be conditioned upon the relocation of those utilities, acceptance by the City, and dedication and filing of an alternate easement. Also, there appears to be another easement along Texas Avenue. The abandonment metes and bounds from Kling extends through this easement, however, that portion of the easement along Texas Avenue would not be abandoned. The key thing in this is that I noticed that you are the applicant and Legal wants the applicant to be the property owner. However, the applicant signature spaces are signed by Dean Schieffer and Donald Andreski. The application should be filed and signed by the property owners. Last time we talked it was on hold because legal wouldn't let a conditional abandonment proceed to council. Bob says it can now be scheduled for the next council meeting because legal let the ice rink abandonment go through conditional. The Sonic Restaurant is approximately 1,718 square feet requiring a fire flow of 1,500 gpm per the 2000 International Building Code. Using the updated College Station water system model in MIKE NET and the required fire flow, the existing water lines and hydrant will provide sufficient flow and pressure for fire flow conditions. With the exception of pipe 2447 with a velocity of 17 fps, velocities in the water lines were kept below 12 fps. Pipe 2447 is a short section of six inch (6") waterline, 34 feet, which remained under Cooner Street with the construction of the Super 8 Motel at Texas and Cooner. Although the velocity in this line is above the recommended maximum, velocities above 12 fps were present under fire flow conditions prior to the construction of the Sonic Restaurant. Pressure in the system was maintained above 20 psi during fire flow conditions, with the lowest pressure at node 2073 of 40 psi. Please see the attached MIKE NET report for pipe and node locations. We have attached 1 full set of plans and an Easement Dedication Sheet. Planning: Comment: Provide a general note that all roof and ground-mounted equipment shall be screened from view or isolated so as not to be visible from any public right-of-way or residential district within 150' of the subject lot, measured from a point five feet above grade. Such screening shall be coordinated with the building architecture and scale to maintain a unified appearance. Answer: This note has now been added. Comment: Please include the patio seating area in the parking calculation. Please include in the parking legend the parking required as well. Answer: We have made this calculation more obvious. Comment: Please be aware that only one directional sign per driveway cut. It appears that two are being proposed on Cooner? (Signs are permitted separately) Answer: We will only provide one directional sign per driveway curb cut. Comment: (FYI) Please be aware that no structure (awnings or canopies) are allowed in the building setbacks. Answer: We understand. The plans currently do not show an encroachment. Comment: Staff would like to encourage the developer to provide pedestrian access from the abutting commercial sites (i.e. sidewalks or a decorative paved pathway) Answer: These pathways are not possible due to gradinglADA issues. LandscauinglStreetscauing!Buffer Comment: Provide a general note that 100% coverage of groundwater, decorative paving, decorative rock, or a perennial grass is required in parking lot islands, swales and drainage areas, the parking lot setback, right-of-way, and adjacent property disturbed during construction. Comment: The irrigation plan is showing irrigation in the TxDOT ROW, this will require a permit. Answer: Irrigation will not be constructed in TxDOT ROW. An irrigation plan will be submitted prior to C.O. Comment: Please delineate the property line on the landscape and irrigation plan. Answer: Property line has been added. Comment: Please provide a north arrow and scale. Answer: Provided. Comment: There appears to be a significant grade change along the street frontages of the subject property. Please be aware that streetscape plantings will need to comply with Section 7.5.E.k. (5) of the (UDO) Unified Development Ordinance. All screening shrubs will be required to screen the parked cars (Drive-thru parking) from the public rights of way (Texas Avenue and Cooner Street). The grade change may require larger shrubs to comply with the screening requirements or planter boxes to keep smaller shrubs on grade. Answer: Understood. Screening shrubs have been added along Cooner. Additional retaining wall has been added along Texas to aid with the grade difference. Comment: The on-site utility easement was abandoned by the City upon certain conditions. It is my understanding that until the conditions are met the easement remains. I have included the conditions below Please address the process for which the conditions are to be met, the easement be officially released and filed for record and a building permit can be issued for a structure over the area occupied by the easement. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION, TEXAS, that a 20 foot wide strip of land previously platted as a public utility easement, which crosses and lies within Lot 2 of the Republic Bank Addition in the City of College Station, as described on Exhibit "A" attached hereto, be abandoned and vacated by the City only upon completion of the following conditions: 1. That the applicant relocated the rerouted sewer and electric infrastructure to a replacement public utility easement; 2. That the City Engineer approve the rerouted sewer and electric infrastructure; and 3. That the applicant dedicate to the City the replacement public utility easement until such time as the above conditions are met by the applicant and accepted by the City. PASSED, ADOPTED and APPROVED this 29th day of April, 2004. Answer: Understood. Electrical: Comment: Developer installs conduit per city specs and design. Answer: Understood. Comment: Developer is responsible for the cost of relocating the existing underground electrical lines. (We have been working with Mitchell & Morgan on the relocation route and cost of relocation of existing electrical lines.) Answer: Understood. Comment: Developer pours transformer pad(s) per city spec and design. Answer: Understood. Comment: Developer installs pull boxes as per city specs and design. (pull boxes provided by City). Answer: Understood. Comment: Transformer location on site plan as proposed is okay. Answer: OK Comment: (FYI) The landscape plan must match the site layout. Answer: It matches. Comment: How does the landscaping shown on the plan screen to transformer? Answer: Shrubs have been added around the transformer. Engineering: Comment: Label retaining wall on site plan. Answer: This has now been labeled. Comment: Sheet 6 show provides a detail of the proposed retaining wall. It does not appear this is a final design as the note says "submit sealed engineering drawing". In my opinion this detail ought to be the wall being approved or the contractor needs to submit any changes to the Building Official for final approval. You could change the note to read "submit to Building Official for approval". Answer: Note has been changed to read submit to Building Official. Comment: Sewer easement (PUE) is required to be 20-ft in areas where the line depth is greater than 6-ft. Answer: This PUE has been changed to 20 feet in this area. Comment: Why is the waterline from across the street 3-in? If it is 3-in it will be considered an extension of the public main and will have to be designed accordingly. If it is a 2-in line, it will be considered a 2-in service line and installed accordingly. Answer: Waterline has been changed to 2 inches. Comment: In construction notes, please refer to the Unified BCS details and specifications for water and sewer since there is not a COCS document per se. Answer: Construction notes have been changed accordingly. Comment: One of the purposes of the newly adopted UBCS standards to provide approved details and specifications. Please include the approved details in the plan set in lieu of others or refer to the UBCS details and specs in construction notes. Answer: A reference has been made in the construction notes. Comment: If approved, this Site Plan will require off-site construction. Do you have anything in the writing granting permission for construction on the off-site property? Answer: Yes we have permission from the bank for this construction. We will have the bank send a letter to the City with this information. Comment: Developer provides temporary blanket easement for construction purposes. (To release temporary blanket easement developer provides descriptive meets and bounds easements for electric infrastructure as installed. Answer: A temporary blanket easement has been submitted. Miscellaneous: Comment: Irrigation system must be protected by either a Pressure Vacuum Breaker, a Reduced Pressure Principle Back Flow Device, or a Double-Check Back Flow Device, and installed as per City Ordinance 2394.
